HomeMy WebLinkAboutContract 51916-A1 Date Received: 07/01/2022 Permit No.: SWFMA-22-0024 Time Received: 3:41 pm City Secretary No.: 51916-Al AMENDMENT TO CITY SECRETARY CONTRACT NO. 51916 STORMWATER FACILITY MAINTENANCE AGREEMENT This AMENDMENT TO CITY SECRETARY CONTRACT NO. 51916, STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized Assistant City Manager,hereinafter referred to as the "City", Quail Valley Devco VLO, LLC hereinafter referred to as the "Landowner", and the Walsh Homeowners Association I, Inc., hereinafter referred to as the "Association". RECITALS WHEREAS, the City of Fort Worth ("City") and Walsh Ranches Limited Partnership and Quail Valley Devco II,LLC("Previous Landowner")and the Walsh Homeowners Association I,Inc. ("Association") made and entered into City Secretary Contract No. 51916 (the "Agreement") to authorize the use of on-site stormwater management facilities (the "Facility") to be constructed and maintained on a portion of Previous Landowner's property; and WHEREAS, the Agreement was recorded with the property records of the Parker County as document No. 201903694 which is one and the same as City Secretary Contract 51916; WHEREAS, the Previous Landowner has subsequently sold, transferred, or conveyed the real property more particularly described in the Agreement to Quail Valley Devco VLO, LLC "Landowner" according to Instrument no. 202148529, Deed Records, Parker County, Texas, hereinafter called the "Property", who has requested the City to consider certain location and design changes; and WHEREAS,the Agreement contains exhibits"A"and"B"that depict the location and design specifications of the Facility; and OFFICIAL RECORD CITY SECRETARY Revised 03/01/2022 BN FT. WORTH, TX WHEREAS,it advisable to execute this Amendment to the Agreement to revise exhibits"A" and"B" in the Agreement to depict changes location and design changes; and NOW THEREFORE, City and Landowner, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the Agreement, consisting of a revised location description of the Facility. 2. Exhibit B is hereby replaced with Exhibit B-1 attached hereto and incorporated herein to the Agreement, consisting of revised design specifications of the Facility. 3. This Amendment shall be filed with the City Secretary as an amendment to the Agreement and also recorded among the land records of Parker County, Texas, and shall constitute a covenant running with the land, and shall be binding on the Landowner, its administrators, executors, assigns, heirs and any other successors in interests, including any property owners association. 4.
