2. Mandatory Disclosures
Conflicts of interest:Per 2 CFR§1402.112,non-Federal entities and their employees must take
appropriate steps to avoid conflicts of interest in their responsibilities under or with respect to Federal
financial assistance agreements.In the procurement of supplies,equipment,construction,and services by
recipients and by subrecipients,the conflict of interest provisions in 2 CFR§200.318 apply. Non-Federal
entities,including applicants for financial assistance awards,must disclose in writing any conflict of
interest to the DOI awarding agency or pass-through entity in accordance with 2 CFR§200.112.
Recipients must establish internal controls that include,at a minimum,procedures to identify,disclose,
and mitigate or eliminate identified conflicts of interest. The recipient is responsible for notifying the
Service Project Officer identified in their notice of award in writing of any conflicts of interest that may
arise during the life of the award,including those that reported by subrecipients. The Service will
examine each conflict of interest disclosure to determine whether a significant potential conflict exists
and,if it does,work with the applicant or recipient to develop an appropriate resolution. Failure to
resolve conflicts of interest in a manner that satisfies the government may be cause for termination of the
award. Failure to make required disclosures may result in any of the remedies for noncompliance
described in 2 CFR§200.339,including suspension or debarment(see also 2 CFR Part 180).
Lobbying:The recipient must not use any federally appropriated funds(annually appropriated or
continuing appropriations)or matching funds under a Federal award to pay any person for lobbying in
connection with the award. Lobbying is influencing or attempting to influence an officer or employee of
any U.S.agency,a Member of the U.S.Congress,an officer or employee of the U.S.Congress,or an
employee of a Member of the U.S. Congress connection with the award. The recipient must complete
and submit the SF-LLL,"Disclosure of Lobbying Activities" form to the Service Project Officer

Other Mandatory Disclosures:Recipients and subrecipients must disclose,in a timely manner,in
writing to the Service Project Officer identified in their notice of award or pass-through entity all
violations of Federal criminal law involving fraud,bribery,or gratuity violations potentially affecting the
Federal award.Non-Federal entities that receive a Federal award including the term and condition

PAYMENTS
1. Domestic Recipients Enrolled in Treasury's ASAP System
The recipient will request payments under this award in the U.S.Treasury's Automated Standard Application for Payment
(ASAP)system.When requesting payment in ASAP,your Payment Requestor will be required to enter an Account ID.The

REPORT
1. Interim Financial Reports
The recipient is required to submit interim financial reports on a annual basis directly in GrantSolutions. The recipient must
follow the financial reporting period end dates and due dates provided in GrantSolutions. The interim reporting due dates are
available by signing in to GrantSolutions and selecting the menu for Reports>Federal Financial Report.The GrantSolutions

SPECIAL TERMS AND REQUIREMENTS
1. Environmental Compliance Reviews
Full compliance with environmental laws is not yet complete for this project. Project planning and
coordination tasks can proceed;however,no ground-disturbing work or project implementation actions
can occur until the Service has notified you in writing that project implementation work can begin. The
Partners Program Biologist will assist you with completion of the Federal compliance processes;
however,recipients of Federal funds are ultimately responsible for ensuring that all applicable Federal,
State,and local permits are obtained for work performed under this Cooperative Agreement.
As a condition of award,the Recipient and their sub-recipient(s)and contractor(s)must not begin any
potentially impactful work related to this award until the Service has notified you in writing that such
work can begin. Recipients and sub-recipients of Federal grants and cooperative agreement awards must

comply with the requirements of the National Environmental Policy Act(NEPA),Section 7 of
Endangered Species Act(ESA),and Section 106 of the National Historic Preservation Act(NHPA).
REPORT
1. Interim Performance Reports
The recipient is required to submit interim performance reports on a annual basis directly in GrantSolutions. The recipient must
follow the performance reporting period end dates and due dates provided in GrantSolutions.The interim reporting due dates are
available by signing in to GrantSolutions and selecting the menu for Reports>FPR
2. Final Reports
The recipient must liquidate all obligations incurred under the award and submit a final financial report in GrantSolutions no later
than 120 calendar days after the award period of performance end date. The GrantSolutions financial report data entry fields are
the same as those on the SF-425,"Federal Financial Report"form. See also our instructional video on"Completing the Federal
Financial Report(SF-425)".
The recipient must submit a final performance report no later than 120 calendar days after the award period of performance end
date. Performance reports must contain:1)a comparison of actual accomplishments with the goals and objectives of the award as
detailed in the approved scope of work;2)a description of reasons why established goals were not met,if appropriate;and 3)any
other pertinent information relevant to the project results. Please include the Service award number on all reports.
The recipient must follow the final Federal Financial Report and the final Performance Report reporting period end dates and due
dates provided in GrantSolutions.The final reporting due dates are available by signing in to GrantSolutions and selecting the
menu for Reports>Federal Financial Report or Reports>FPR
3.Reporting Due Date Extensions
Reporting due dates may be extended for an award upon request to the Service Project Officer identified in the notice of award.
The request should be sent by selecting the award in GrantSolutions and selecting send message.The message must include the
type of report to be extended,the requested revised due date,and a justification for the extension. The Service may approve an
additional extension if justified by a catastrophe that significantly impairs the award Recipient's operations. The recipient must
submit reporting due date extension requests through GrantSolutions to the Service Project Officer identified in their notice of
award before the original due date.The Service Project Officer will respond to the recipient after approval or denial of the
extension request.
4. Significant Developments Reports
See 2 CFR§200.328(d). Events may occur between the scheduled performance reporting dates that have significant impact upon
the supported activity.In such cases,recipients are required to notify the Service in writing as soon as the recipient becomes
aware of any problems,delays,or adverse conditions that will materially impair the ability to meet the objective of the Federal
award.This disclosure must include a statement of any corrective action(s)taken or contemplated,and any assistance needed to
resolve the situation.The recipient should also notify the Service in writing of any favorable developments that enable meeting
time schedules and objectives sooner or at less cost than anticipated or producing more or different beneficial results than
originally planned.

SCOPE OF WORK
1. Project Description
The Service hereby incorporates the recipient's application submitted to and approved by the Service into these award terms and
conditions.
This award is made based on Service approval of your application signed on July 12,2021,hereby
incorporated by reference into this award. Funds under this award are to be used to complete work
outlined in the attached Scope of Work and completed SF424 forms. The Service Project Officer
identified in the Project Contacts section of this letter will be substantially involved in this project
including,but not limited to: (A)participating and collaborating with you and other project partners,in
carrying out the Work Plan and/or Landowner Agreement;(B)reviewing and approving each stage of
work;and(C)closely monitoring or otherwise providing operational involvement during the project.

This Cooperative Agreement(Agreement) is entered into pursuant to authority contained in the
Partners for Fish and Wildlife Act(P.L. 109-294),the Fish and Wildlife Coordination Act(16
U.S.C. 661 et seq.) and the Fish and Wildlife Act of 1956(16 U.S.C. 742a j),as amended. This
project was selected for funding because the Fort Worth Nature Center&Refuge shares a
common objective with the U.S.Fish and Wildlife Service (USFWS)to enhance habitat for the
benefit of Federal trust species on non-federal lands, and the project supports priority actions
identified in the Regional Partners for Fish and Wildlife Program(Partners Program) Strategic
Pian.
The Fort Worth Nature Center&Refuge, 9601 Fossil Ridge Road, Fort Worth, TX 76135,
hereby agrees to participate with the USFWS in conducting certain habitat improvement
practices on non-federal lands located in Tarrant County, State of Texas,as identified in the
Agreement's exhibit: 32.834295°, -97.474823°.
In signing this Agreement and receiving a Notice of Award Letter,the Fort Worth Nature Center
&Refuge joins as a participant with the USFWS and agrees to complete the habitat improvement
project with financial or material support provided by the USFWS.Any donation of supplies,
equipment, or direct payment from the USFWS to the Fort Worth Nature Center&Refuge for
carrying out the habitat improvements is included in Agreement. The habitat improvement
activities conducted pursuant to this Agreement are not to replace, supplement or otherwise
contribute to any mitigation or compensation that may be required of the Fort Worth Nature
Center& Refuge, or other parties, as a result of any mandated requirements.
Background
The Fort Worth Nature Center&Refuge is a natural area comprised of forests,prairies, and
wetlands allowing visitors to step back in time and experience what the Fort Worth/Dallas
Metroplex was like in the early 20th century. The inception of the Fort Worth Nature Center&
Refuge was based on protecting the local watershed.
The Fort Worth Nature Center& Refuge covers 3,621 acres and includes over 20 miles of hiking
trails,making the park one of the largest city-owned nature centers in the United States. In 1980
it was designated as a National Natural Landmark by the U.S.Department of the Interior. With
the ever growing population of Fort Worth and the surrounding communities,having a place to
explore and enj oy the outdoors is important for area residents. The Fort Worth Nature Center&
Refuge is home to many native habitats to discover on a self-guided or staff-guided hike. Staff
members offer many programs throughout the year providing opportunities for visitors to learn
about our natural world.
In addition to education,the Fort Worth Nature Center&Refuge is a shining example of land
stewardship and was recognized with a Lone Star Land Steward award in 2009 by the Texas
Parks and Wildlife Department. Resource management staff work hard to preserve our
ecosystems by promoting best practices to enhance the fauna and flora.Managing a residential
bison herd and implementing prescribed fires are two of many ways that the Fort Worth Nature
Center&Refuge ensure local and migratory wildlife have a sustainable home.

Project Summary
The project site sits at a unique crossroads of several large ecosystems: Fort Worth Prairie and
the East and West Cross Timbers. As annual rainfall diminished east to west,forests transition
into woodlands,then savannas and prairies. In Fort Worth,these ecosystems grade into one
another over a short distance and host distinct vegetation communities based upon soil.The Fort
Worth Prairie is characterized by limestone soils while the Cross Timbers are characterized by
sandy soils.
The Fort Worth Nature Center&Refuge(hereinafter Recipient)will work collaboratively with
the USFWS's Partners Program to enhance a degraded 75-acre prairie site by mulching
woody/understory vegetation encroachment. Within a 3-5 year time after mulching,it is
anticipated that the site will have a follow-up treatment of herbicide and prescribed fire by the
Recipient. These conservation treatments will improve ground-level cover conditions,provide
essential nesting habitat, and enhance the overall plant diversity benefiting numerous migratory
and resident grassland game and non-game bird species,monarch butterflies, and other pollinator
species.
This project supports Secretary oflnterior Priority I Creating a conservation stewardship
legacy second only to Teddy Roosevelt by improving habitat for migratory wildlife and resident
game and non-game species.Also,the project supports Secretarial Priority If Improving the
overall landscape to create outdoor recreational opportunities. Finally,the project support

Secretarial Priority 3. Restoring trust with local communities, strengthen regional strategic plans
and priorities, and 3.a. Be a better neighbor with those closest to our resources.
Scone of Work
Project Description
The objective of this Agreement is for the Recipient and USFWS's Partners Program to work
collaboratively in restoring a degraded 75-acre prairie site by mulching woody/understory
vegetation encroachment. Improved ground-level cover conditions will provide essential nesting
habitat and enhance the overall plant diversity of the site,thus benefiting numerous migratory
and resident grassland game and non-game bird species,monarch butterflies,and other pollinator
species.
Roles/Responsibilities of USFWS and Recipient
The USFWS will:
• Award $10,000 to the Recipient for equipment rental and herbicide purchase to treat 75
acres of brush(>51% canopy cover) on at the project site.
• Have substantial involvement with the Recipient throughout the entire Agreement term in
order to support actions needed and to provide technical advice to ensure that the project
is designed and constructed per the Agreement and functions as intended.
• Develop management recommendations,implementation actions,and monitoring
strategies for the project.
• Provide advanced notice prior to accessing the project to evaluate and monitor
management strategy effectiveness.
• Assure regulatory compliance with National Environmental Policy Act, Endangered
Species Act,National Historic Preservation Act, and any applicable federal statutory
rule/regulation.
• Not assume jurisdiction over any premise served by this Agreement. The USFWS
assumes no liability for damage or injury other than that caused by its own negligence, on
the above acreage.
• Not be held liable in any way to restore the project site to its prior condition upon
termination or expiration of this Agreement.
The Recipient will:
• Demonstrate progress on the agreement within 12 months of the Notice of Award Letter
date and the project must be completed within 36 months of that date. The USFWS
reserves the right to re-obligate funds if progress during this period is not met. If
Recipient is unable to commence or complete work identified in this Agreement,the
Recipient must notify the USFWS Project Officer a minimum of 30 days prior to request
an Extension of Time.
• Furnish the necessary personnel,materials and services,and do all things required to
accomplish the project objectives.
• Within a 3 year timeframe after mulching provide a follow-up treatment(spot treatment)
of herbicide at the project site.

• Within a 5 year time timeframe after mulching, pending site conditions, implement a
prescribed fire at the project site
• Furnish written notification for USFWS concurrence any deviations from the procedures
or objectives specified in this Agreement prior to implementation.
• Refund to the USFWS monies provided by the USFWS which prove to be cancelable
obligations or unallowable costs in accordance with appropriate Code of Federal
Regulation and unexpended should the Recipient be unable to complete the provisions of
this Agreement.
Monitoring
Monitoring will be accomplished by the Recipient and the USFWS Project Officer. A
monitoring plan will be developed between the Recipient and USFWS Project Officer to
determine the most appropriate plan for the project.

Payment(ASAP) system. When requesting payment in ASAP,the Recipient's Payment
Requestor will be required to enter an Account ID. The number assigned to this award is the

Under the terms and conditions of this award,the Recipient must maintain an active SAM

registration at https://www.sam.siov/12ortal/SAM/#1 until the final financial report is submitted or
final payment is received,whichever is later. If the Recipient's SAM registration expires during
the required period, the USFWS may suspend payment under this and all other USFWS awards
to the Recipient until the SAM registration is updated.
Conflict of Interest
The Recipient must notify the USFWS in writing of any actual or potential conflicts of interest
that are known at the time of application or that may arise during the life of this award, in the
event an award is made. Conflicts of interest include any relationship or matter which might
place the Recipient, the Recipient's employees, or the Recipient's Sub-Recipients in a position of
conflict,real or apparent,between their responsibilities under the award and any other outside
interests. Conflicts of interest may also include, but are not limited to, direct or indirect financial
interests,close personal relationships,positions of trust in outside organizations,consideration of
future employment arrangements with a different organization, or decision-making affecting the
award that would cause a reasonable person with knowledge of the relevant facts to question the
impartiality of the Recipient,the Recipient's employees, or the Recipient's future Sub-
Recipients in the matter. Upon receipt of such a notice,the USFWS Project Officer in
consultation with their Ethics Counselor will determine if a conflict of interest exists and, if so,if
there are any possible actions to be taken by the applicant to reduce or resolve the conflict.
Failure to resolve conflicts of interest in a manner that satisfies the USFWS may result in the
project not being selected for funding.

Revision/Modification Procedures
Revisions to this Agreement may be proposed by either party and shall become effective upon

Agreement Length and Termination Procedures
The works of improvements should be completed no later than 36 months from the Notice of
Award Letter date. The term of this Agreement(also referred to as the habitat retention period)
will expire on August 1,2031. This Agreement may be modified at any time by mutual written
consent of the parties. It may be terminated by either party upon 30 days advance written notice
to the other party. The Agreement may be terminated by either party upon providing 30 days
advance written notice to the other party. However, if the Recipient terminates the Agreement
before its expiration, or if the Recipient should materially default on these commitments,then the
Recipient agrees to reimburse the USFWS prior to final termination for the prorated costs of all
habitat improvements placed on the land through this Agreement. After giving such notice,the
Recipient shall bring its activities to a prompt and orderly close avoiding new costs to the extent
possible. The Recipient shall submit a final summary of costs (and invoice,if appropriate)for
approval of the USFWS. Project property shall be disposed of in accordance with the property
terms of this Agreement,if any, or,in the absence of such terms, as agreed by the parties in a
termination settlement. For these purposes,the total cost of the habitat improvements to the
United States is agreed to be $10,000

Pesticide Product Provision
This Pesticide Product Provision is pursuant to and guided by authorities contained in USFWS
and U.S. Department of the Interior(DOI)policies and directives (517 DM 1,569 FW 1,524
DM 1, 242 FW7). It is the responsibility of all persons using a pesticide product to read and
follow the applicable label and to comply with all federal, state, and local laws and regulations
relating to the use of such pesticide product. Before using any pesticide product,be certain it is
registered for use in your locality. Failure to apply a pesticide in accordance with the stipulations
specified on the product label is not only a violation of federal and state law but it will render
this Agreement null and void.

RECOMMENDATION:
It is recommended that the City Council:
1.Auhorize the exe=ion of a cooperative a0reementwith the U.S. Fish and Wildlife Service in an
arroun:no-to exceed$10,(140.40 in reimbursement for habits-enhancement activities of past oak
savannah and native grassland habitat at the Fart Warlth Mature Center and Refuge;and
2_Adopt the a--ached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Operating Federal Furl by Ti 9,D00.00.
DISCUSSION:
The Fort Worth Mature Center and Refuge will work collaboratively with the U.S. Fish and Wildlife Service
(USFW)Partners Program to enhance a degraded 7&acre post oak savannah site by mulching
wcad&nderst.ory vegetation encroachment.Within a three-to-five year time after mulching,the site will
have a follow-up treatment of herbicide and a prescribed bum by City of Fort Worth staff_These
conservation treatments will improve ground-level cover conditions,provide essential nesting habitats,and
enhance the overall plant diversity benefiting numerous migratory and resident grassland game and non-
game bird species,monarch butterflies,and other poll inator species.
The USFW will provide a W%%cost share on a reimburseable bases up to ID,OD0.DO,funding the rental of
a land clearing machi ne and the purchase of herbicide,along with developing management
recommendations,implementation actions,and monitoring strategies for the project
The City of Fart Worth will provide a 05%%cast share far this project consisting of T319,D00.00 for in-kind
services in the farm of operating the machine rented,applying herbicide,and conducting the prescribed
bum.Mulching will be completed within twelve months, herbicide treatment will be completed within three
years of completing mulching and a prescribed burn well be cornpkeled within five years of completing
mulching.
The Fort Warth Mature Center and Refuge is located in COUNCIL DISTRICT 7, but serves the entire city_
FISCAL INFORIAATION I CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
appropriation ordinance,furds will be available in the current aperating budget,as appropriated,in the
Grants Operating Federal Fund_The Park&Recreation Department(and Financial Management
Services)will be responsible for the collection and deposit of funds due to the City_Prior to an expenditure
being made,the Park&Recreation Department has the responsibility to Val id ate the availability of funds.
This is a reimbursementgrant.
