HomeMy WebLinkAboutOrdinance 25608-06-2022 ORDINANCE NO.25608-06-2022 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, SUBJECT TO RECEIPT OF THE GRANT, IN THE AMOUNT OF $86,872,545.00, FOR THE PURPOSE OF FUNDING ALLOWABLE EXPENSES RELATED TO THE AMERICAN RESCUE PLAN ACT STATE AND LOCAL FISCAL RECOVERY FUNDS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund, subject to the receipt of the grant, in the amount of$86,872,545.00, for the purpose of funding allowable expenses related to the American Rescue Plan Act and Local Fiscal Recovery Funds. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: The purpose of this Mayor and Council Communication (M&C)is to appropriate the second tranche of funds received from the United States (U.S.)Treasury under the American Rescue Plan Act(ARPA)State and Local Fiscal Recovery Funds(SLFRF). In March 2021 the President of the United States signed ARPA, providing aid and relief to various sectors of the U.S.economy. The City of Fort Worth's allocation of ARPA SLFRF totals$173,745,090.00,of which a first tranche(50%), in the amount of$86,872,545.00,was received on May 19,2021 and appropriated on June 22,2021 by M&C 21-0445. The second tranche of the ARPA SLFRF was received on June 6,2022 from the U.S Treasury and is being appropriated to the Grants Operating Federal Fund in order to provide allocations for projects approved by City Council(Council)under the framework initially defined in M&C 21-0445. ARPA specifies certain allowable(and unallowable)uses for these funds,and City Management has determined priorities for ARPA funding to assist in the on-going recovery effort to strengthen the physical and economic health of the community. Specific projects under the ARPA framework are required to be approved by Council on separate M&Cs. To date,$120,366,580.00 has been allocated in the areas of Public Health, Negative Economic Impacts, Revenue Recovery and Administration. All funds must be fully obligated by December 31,2024,and fully expended by December 31,2026. The figures referenced in this M&C are limited to funds received under Section 9901 of ARPA. Other federal awards related to the Act will be addressed in other M&Cs. ALL COUNCIL DISTRICTS are affected and included. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and the attached appropriation ordinance,funds will be available in the operating budget,as appropriated, of the Grants Operating Federal Fund. All participating City departments will be responsible for ensuring that only expenditures allowable under the American Recovery Plan Act,with appropriate documentation,are charged to this funding source.
