Home My WebLink AboutOrdinance 6476 ORDINANCE NO. 6 f 74 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE -CITY OF FORT WORTH, TEXAS, AND-THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 0.107 SQUARE MILE OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA.PART OF TAXES; PROVIDING THAT THE INHABI- TANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CON- FLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an op- portunity to be heard on the proposed annexation of the territory herein- after described, was held in the City Council Chamber in the City Hall of Fort Worth, Texas, on the 19th day of April, 1971, which date -is not more than twenty_(20) nor less than ten (10). days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in.the hereinafter described territory on the 7th day of April, 1971, which date was not more than twenty (20) and not less than ten (10) days prior to the date of the opening of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 393,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 212.916 square miles on the lst day of January, 1971; and WHEREAS, the hereinafter described territory lies within the ex- clusive extraterritorial jurisdiction of the.City of Fort Worth,.Texas; and WHEREAS, the hereinafter described territory contains approximately 0.107 square mile of land; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION I THAT the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is.hereby added to and annexed to the City of Fort Worth,.Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the. City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended s.o as to include said area within the corporate limits of the City of Fort Worth,.Texas, to wit: BEING a tract of land about eight miles south from the courthouse of Tarrant County, Texas, and including a portion of the S.A. & M.G. R.R. Co. Survey (Abstract No. 1463), and.being described as follows: - BEGINNING at a steel rod for corner in the north line of the S.A. & M.G. R.R. Co. Survey, said point being in the west right-of-way line of the G.C. & S.F. R.R. Co., and being in the present city limit line of the City of Fort Worth; THENCE, South 1 degree 52 minutes West a distance of 1782.00 feet along and with the west right-of-way line of the`G.C. & S.F. R.R. Co., to a steel rod for corner; THENCE, North 89 degrees 53 minutes West a distance of 1641.50 feet to a steel rod for corner; THENCE, North 0 degrees 08 minutes West a distance of 1782.70 feet to a steel rod for corner in the north line of the S.A. & M.G. R.R. Co., Survey (Abstract No. 1463) and the south line of J.M.B. Smith Survey (Abstract No. 1412), said corner being in the present city limit line of the City of Fort Worth; THENCE, along and with the north line of the S.A. & M.G. R.R. Co., Survey (Abstract No. 1463) the.same being the present city limit line of the City of Fort Worth, South 89 degrees 50 minutes East a distance of 1703.70 feet to the point of beginning and containing 0.107 square mile. SECTION II THAT the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the-property so added hereby - 2 shall bear its pro rata part of the:taxes levied by the City of Fort Worth, Texas, and the.inhabitants thereof shall be entitled to all of the.rights and privileges of all the-citizens and shall be bound by the acts, ordi- nances, resolutions and regulations of the City of Fort Worth, Texas. SECTION III THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith.,-but as to all other ordinances or sections of ordinances not in conflict herewith this ordinance shall be and is hereby made cumulative. SECTION IV THAT it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance'are severable; and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent.jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs.and sections hereof, since the same would have been enacted by the City Council with- out the incorporation herein of any such void, ineffective or unconstitu- tional phrase, clause, sentence, paragraph or section. SECTION V THAT this ordinance shall be in-full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth. and it is so ordained. R.R. Co. Survey i of 1 On January 18, 1971, the City Council referred a petition for annexation of a portion of the S.A. & M.G. R.R. Co. Survey, Abstract No. 1463, to the staff for review and recommendation. The subject area contains 68 acres, located west of Laurel Land Cemetery, as shown on the attached map. City Plan Commission Recommendation On August 26, 1970, the City Plan Commission at its regular meeting approved a preliminary plat of Altamesa Heights Addition subject to certain editions. This plat includes the area petitioned for annexation. The developer of this addition desires to have this subdivision, in its entirety located within the city limits of Fort Worth. On February 24, 1971, the City Plan Commission recommended that the subject area be annexed to the City of Fort Worth. Municipal Services The City of Fort Worth can provide all municipal services to this property under the terms of the standard development policies. Recommendation It is recommended that the City Council authorize the City staff to initiate annexation proceedings on the subject area in accordance with the attached timetable.
