HomeMy WebLinkAboutResolution 4205-05-2013 A Resolution NO. 4205-05-2013 CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE GENERAL ELECTION HELD ON MAY 11, 2013, FOR THE PURPOSE OF ELECTING COUNCIL MEMBERS FOR THE CITY OF FORT WORTH. WHEREAS, on February 5, 2013, the City Council of the City of Fort Worth adopted Ordinance No. 20603-02-2013, calling for and ordering a general election to be held on Saturday, May 11, 2013, at which election all qualified voters of the City of Fort Worth would have the opportunity to vote for the purpose of electing a Mayor at large and eight(8) Council Members from their respective districts; and WHEREAS, after all deadlines had expired for candidates to be placed on the ballot for the election, the City Secretary delivered to the City Council a "Certification of Unopposed Candidacy", informing the City Council that only one (1) person had filed as a candidate for the office of Mayor and only one (1) person had filed as a candidate for election in each of City Council District Nos. 3, 6, 7 and 9; and WHEREAS, upon receipt of said "Certification of Unopposed Candidacy" on March 19, 2013, the City Council, as authorized by Section 2.053 of the Texas Election Code, adopted City Council Ordinance No. 20657-03-2013, declaring elected to office the unopposed candidates for the office of Mayor and for City Council Members for City Council District Nos. 3 6, 7, and 9 and canceling the election for those uncontested offices; and WHEREAS, on May 11, 2013, the general election was held at which the qualified voters of the City had the opportunity to vote for the purpose of electing the remaining four (4) City Council Members from their respective districts; and WHEREAS, pursuant to Chapter 67, of the Texas Election Code, the City Council of the City of Fort Worth is required to canvass the returns and declare the results of the election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH THAT: SECTION 1. The declarations and findings contained in the preamble of this Resolution are hereby found to be true and correct and shall be made a part hereof. SECTION 2. The City Council hereby finds and declares that the said City Council election for District Nos. 2, 4, 5 and 8 was held on May 11, 2013, at which election qualified voters were given the opportunity to vote for the purpose of electing City Council Members from their respective districts. The City Council further finds and declares tfiat Such returns are correct, arid adopts them as the retums of the election held on May 11 2013, together with the tabulation of the total number of votes received in each precinct. Attached hereto as Exhibit "A" and incorporated herein are the Council Member election results ofTarrant County. SECTION 5. The following persons be declared elected to the office of City Council, respectively: Council —District 2 Salvador"Sal" Espino Council —I)Istrict 4 Danny Scarth Council—]DIstrict 8 Kelly Allen Gray SECTION 6. The City Council further declares and resolves that pursuant to Section 2.053 of the Texas Election Code and City Ordinance No. 20657-03-2013, Betsy Price is declared elected to the office of Mayor; W.B. "Zirn" Zimmerman is declared elected to the office of City Council Member for District No. 3; Jungus Jordan is declared elected to the office of City Council Member for District No. 6; .Dennis Shingleton is declared elected to the office of City Council Member for District No. 7; and Joel Burns is declared elected to the office of City Council Member for District No. 9. Certificates of �Wo Resonation.No.4205-05-2013 Election shall be issued to Betsy Price, W.B. "Zim" Zimmerman, Jungus Jordan, Dennis Shingleton, and Joel Burns in the same manner as provided for the candidates elected at the May 11, 2013, City Council election. SECTION 7. The City Council further finds no candidate received a majority of the total number of votes received by all candidates for the office of City Council District 5 and that no candidate be declared elected to City Council District 5. Therefore, in accordance with Chapter IV, Section 2, of the City of.Fort. Worth Home Rule Charter, a run-off election is hereby declared necessary to fill this place on the Council and a run-off election will be ordered by separate action of the Council. SECTION 8. It is hereby officially found and determined that the meeting of the :Fort. Worth City Council at which this Resolution was adopted was open to the public, and that public notice of the time, place and purpose of said meeting was given, as required by Chapter 551 of the Texas Government Code. p p " y May,�2S11..3.,..
