WHEREAS, the City of Fort Worth (CITY) and Gary P. Kutilek d/b/a The
Landscape Alliance, (ENGINEER) made and entered into City Secretary
Contract No. 4457£3, (the CONTRACT) which was City Council authorized on
the 4 day of June, 2013 in the amount of $ 77,800.00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Sandy Lane Park Improvements; and
WHEREAS, it has become necessary to execuLe Amendment No. 1 to the
CONTRACT to include an increased scope of work arld revi_sed fee.
NOW THEREFORE, CITY and ENGINEER, acting hereirl by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated January 20, 2014, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $138,759.50. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $216,559.50.
3.
All other_ provisions of the Contract, which are not expressly
amended herein, sYlall remain in full force and effect.

Dear Gary,
We have reviewed the project needs and offer the following:
Back�round
The reach of Cottonwoad Creek that passes through Sandy Lane Park is a small, ephemeral
channel that has been affected by upstream urbanization, storm water deliveries from the park
and construction of bank protection measures.
Available information for this portion of Cottonwood Creek incfudes topographic survey, site
photography, aerial photograph, and a report that was prepared for the Fort Worth
Transportation and Public Works Storm Water Department (Alan Plummer Associates, Inc.,
2010). A review of this information inclicates that the channel has incised vertically, widened,
and laterally migrated over at least the past several years. One significant cause of the erosion
is the concrete channel lining of the upstream and adjacent reach of Cottonwood Creek that has
resulted in reduced sediment supply. In an effort to address the lateral instabilities, gabion bank
protection has been installed along the north bank in the vicinity of the main parking lot for
Sandy Lane Park. The concrete sill located downstream from the Sandy Lane culverts was
recently reconstructed with grouted rock energy dissipaters to reduce velocities at the
downstream limit of the concrete lining. Some channel incision has occurred at the sill terminus
since its construction, as well as along the toe of the gabion bank protection. Geotechnical
failures indicate that the channel incision is a significant driver of the lateral instabilities.
Widespread bank erosion is occurring along both banks, and the most significant concern is in
the vicinity of the failed 60"storm drain line that drains the north bank tributary and has resulted in
collapse of Sandy Lane Park Drive.
CP&Y proposes to perform analyses that will be necessary to prepare a conceptual level design to mitigate the
erosion in the areas of the park. Following acceptance of the preliminary design, CP&Y will finalize the design and
prepare construction documents. This work will include the foilowing specific tasks:
Preliminary DesiRn
1. Obtain and review related documentation and information, and conduct interna) meetings
for project management purposes.
2. Perform a site reconnaissance of the project reach to identify channel stability concerns
and to assess opportunities and constraints that may affect the development of the
conceptual design.

3. Obtain and review the existing hydraulic (HEC-2) model of the project reach that was
developed to prepare the FEMA flood insurance rate mapping, The HEC-2 model will be
converted to a HEC-RAS model and will be updated using the most recent topographic
mapping and survey data.
4. Use the results from the hydraulic modeling and data collected during the field
reconnaissance (i.e., bed and bank material samp�es) to estimate rates of lateral and
vertical erosion and evaluate local scour conditions for purposes of designing the grade
control and bank protection measures.
5. Formulate a range of alternatives to address the erosion concerns, and analyze the
hydraulic and channel stability conditions associated with each aiternative.
6. Select the preferred alternative and prepare a conceptual level design.
7. Prepare a Technical Memorandum that summarizes the methods and results from the
analysis and presents the details of the conceptual design.
8. Prepare hydrologic and hydraulic analyses for the existing storm drain and recommend re-alignment.
9. Meet with city to review Technical Memorandum and preliminary design and discuss the recommended
alternative.
Permittin� Services
1. Perform cultural resources and environmental desktop and field surveys consisting of threatened and
endangered (7&E) species habitat assessment, Texas Rapid Assessment Method (TXRAM) for one site, and
wetlands and waters of the United States delineation/determination. It is assumed that wetlands and habitat for
federally-listed T&E species do not exist at the site.
2. Prepare and submit Pre-Construction Notification (PCN) for a Nationwide Permits 3(Maintenance), 13 (Bank
Stabilization), and 27 (Aquatic Habitat Restoration, Establishment, and Enhancement Activities). It is assumed that
the NWP 27 wil! be completed for one site only.
3. Coordinate with the USACE as needed and address USACE comments on the PCN submittals. It is assumed that a
USACE pre-application meeting wil) not be required since one was conducted on October 18, 2013.
Final Desi�n
1. Adjust and finalize HEC 2 and HEC RAS models with the selected alternative and submit to the City's Storm
Water Management.
2. Prepare drainage study to finalize storm drain pipe size and alignment.
3. Finalize roadway alignment and grading
4. Prepare construction documents.
5. Prepare construction drawings and details for roadway, storm drain, grade control, bank protection
improvements and erosion control plan and narrative.
6. Prepare opinion of prabable construction costs.
7, Submit plans to City for review.
8, Prepare flood plain development permit and submit to City's Storm Water Management.
Construction
1. Attend pre-bid meeting and respond to contractors questions.
2, Assist in the preparation of addendums if required.
3. Preparation of contract documents for execution.
4. Attend pre-construction meeting,
5, Attend monthly meetings (3) with contractor and make periodic site visits (3) to observe construction progress.

Additional Services
1. Prepare and submit an Individual permit if required by the USACE.
2. Preparation of a Mitigation or Restoration Monitoring and Reporting Plan for the NWP 27, if required by the
USACE.
3. Five years of monitoring, if required by the USACE.
4. Preparation of a detailed Alternatives Analysis, if required by the USACE.
5. Preparation of a LOMR application for submittal to FEMA for review.
Services to be provided by Citv
1. Topographical survey of Cot#onwood Creek.
2. 6eotechnical services as needed.
Cost of Services
CPY proposes to conduct the specified Scope of Services on a lump sum basis of $145,950.00. A breakdown of the
cost by phase and our hourly rates are shown on Exhibit'A'. CPY will prepare a detailed scope and fee estimate for

RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 1 to City Secretary
Contract No. 44578 in the amount of $138,759.50, an Engineering Agreement with Gary P. Kutilek d/b/a
The �andscape Alliance for additional engineering services for Sandy Lane Park, thereby revising the
total contract amount to $216,559.50.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of
Amendment No. 1 to City Secretary Contract No. 44578 in the amount of $138,759.50 to an Engineering
Agreement with Gary P. Kutilek d/b/a The Landscape Alliance for additional engineering services for
Sandy Lane Park, thereby revising the total contract amount to $216,559.50.
Gary P. Kutilek d/b/a The Landscape Alliance proposes to perform the additional design and engineering
services for this amendment for a lump-sum fee amount of $138,759.50. Staff considers it to be fair and
reasonable for the scope of services proposed.
On June 4, 2013, (M&C C-26303) the City Council authorized the execution of an Engineering Agreement
with Gary P. Kutilek d/b/a The Landscape Alliance in the amount of $77,800.00 to develop a park
improvement conceptual master plan and prepare construction documents for park improvements at the
site. Project funding includes the amount of $648,046.00 from gas bonus funds and the amount of
$90,000.00 received from a License Agreement between the City and T-Mobile West Corporation (M&C L-
14904) for the installation of a communication tower at the park, together totaling $738,046.00.
Ongoing creek bank erosion has occurred at the site causing further impact on the existing park drive,
storm drain and site utitilities.
M/WBE Office - Based on the cost savings of the original contract inclusive of this amendment No. 1, Gary
P. Kutilek d/b/a The Landscape Alliance is in compliance with the City's M/WBE Ordinance by committing
to an overall 74 percent M/WBE participation.
An additional amount of $8,000.00 allocation is required for design phase project administration, which
when added to the revised contract amount of $216,559.50 will result in a total design phase budget
amount of $224,559.50.

DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to provide authorization for the execution
of an engineering Agreement with Gary P. Kutilek d/b/a The Landscape Alliance in the amount of
$77,800.00 to develop a park master plan, design and prepare construction documents for Sandy Lane
Park.

It is anticipated that an additional $90,000.00 will be recommended for appropriation to the project upon
the award of the actual construction contract. These funds are available for use in Sandy Lane Park as
the result of the execution of a license Agreement between the City and T- Mobile on December 15, 2009,
(M&C L-14904) for the installation of a communication tower at the park. Upon this additional
appropriation, the total project funding will amount to $738,046.00.
Project elements to be provided in the conceptual master plan as site conditions allow include an
accessible loop trail, a new playground, new group shelter, multi-use slab and drinking fountain, a
pedestrian bridge, security lighting, the repaving of the existing asphalt park road and parking lot, and
drainage improvements along a portion of the creek area.
Staff considers this fee to be fair and reasonable for the scope of services proposed.

M/WBE Office: Gary P. Kutilek d/b/a The Landscape Alliance is in compliance with the City's BDE
Ordinance by committing to 20 percent MBE participation on this project. The City's MBE goal on this
project is 15 percent.
In addition to the contract amount, $5,000.00 is required for design phase project administration, for a total
design budget in the amount of $82,800.00.
Sandy Lane Park is located in COUNCIL DISTRICT 5.
