AMENDMENT No . 2
TO CITY SECRETARY CONTRACT No. 44578
WHEREAS, the City of Fort Worth (CITY) and Gary P. Kutilek d/b/a The
Landscape Alliance, (ENGINEER) made and entered into City Secretary Contract No.
44578, (the CONTRACT) which was City Council authorized on the 4 day of June,
2013 in the amount of $ 77,800.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in
the amount of $138,759.50 which was authorized by M&C #C-26715 on March 18tn
2014 for the following project:
Sandy Lane Park Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
CONTRACT:

Article I of the CONTRACT is amended to include the additional engineering
services specified in a proposal dated September 29, 2014, a copy of which is
attached hereto and incorporated herein. The cost to City for the additional
design services to be performed by Engineer totals $20,370.00. (See Attached
Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in the
fee to be �aid to Engineer for all work and services performed under the
Contract, as amended, so that the total fee paid by the City for all work and
services shall be an amount of $236,929.50.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Re: Sandy Lane Park Additional Services
Dear Eric:
I appreciate the opportunity to submit The Landscape Alliance's (TLA) proposal to provide additional
services related to the design and development of improvements at Sandy Lane Parlc. These services are
based on additional requirements of the project as discussed in recent meetings with you, the current TLA
team, T&PW Storm Water personnel and Stephanie Coffinan of Freese and Nichols, who will be under
contract to Storm Water for Cottonwood Creek studies.
The project scope will include the following additional or expanded work elements:
Site Surve.y
It was requested that our surveyor, Spooner and Associates, accompany Ms. Coffinan to physicallly locate
and tie down features along the creek to the current survey base. It has been represented that this will
require one day of field time and one day of survey office time to prepare a base which will accurately
represent collected �ield data.
Geotechnical Investi�ations
Investigations will be expanded to conform with recent requests which will add two borings south of the
creek in recently cleared areas and one additional boring north of the creek. This service will be provided
by CMJ Engineering, our original geotechnical consultant. They will provide three borings to a depth of
30' below existing grade in the areas approved by you and Ms. Coffman. These services will be utilized to
guide design and engineering of proposed channel improvements.
HEC-RAS Modelin� and Desi�n Coordination
Based on added inputs to the expanded project, our civil consultants, CP&Y will:
• Review the FNI HEC-RAS Model (for the longer stream segment) and subsequent
coordination with FNI.
• Coordinate and discuss options with FNI for minimizing erosion in Sandy Lane Park and
the channel segment immediately downstream.
• Attend one additional meeting to present and discuss options with city staff and other
consultants. For this meeting, Dr. Michael Harvey and Stu Trabant, geomorphic experts,

will travel from Fort Collins, Colorado to participate in person. They were brought in during
our prior site visit with Storm Water and FNI to provide an initial review and assessment of
the project.

These fees includes all primary services described in the phase outline to be provided by TLA and its
consultants. Fees will be billed on an hourly basis, based on services actually rendered. The City of Fort
Worth will be advised in advance of any anticipated changes in services which will impact the fee. Included
in the proposed fee are costs associated with reproduction and travel related to the production of the contract
products. Items not specifically included in the estimated fee include:
1. Permit application and review fees other than TDLR.
2. Additional services or other items not referenced or inferred herein will be charged as an additional
service cost if required and approved by the City.

DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to provide authorization for the execution
of an engineering Agreement with Gary P. Kutilek d/b/a The Landscape Alliance in the amount of
$77,800.00 to develop a park master plan, design and prepare construction documents for Sandy Lane
Park.
Project funding currently available is as follows:

It is anticipated that an additional $90,000.00 will be recommended for appropriation to the project upon
the award of the actual construction contract. These funds are available for use in Sandy Lane Park as
the result of the execution of a license Agreement between the City and T- Mobile on December 15, 2009,
(M&C L-14904) for the installation of a communication tower at the park. Upon this additional
appropriation, the total project funding will amount to $738,046.00.
Project elements to be provided in the conceptual master plan as site conditions allow include an
accessible loop trail, a new playground, new group shelter, multi-use slab and drinking fountain, a
pedestrian bridge, security lighting, the repaving of the existing asphalt park road and parking lot, and
drainage improvements along a portion of the creek area.
Staff considers this fee to be fair and reasonable for the scope of services proposed.

M/WBE Office: Gary P. Kutilek d/b/a The Landscape Alliance is in compliance with the City's BDE
Ordinance by committing to 20 percent MBE participation on this project. The City's MBE goal on this
project is 15 percent.
In addition to the contract amount, $5,000.00 is required for design phase project administration, for a total
design budget in the amount of $82,800.00.
Sandy Lane Park is located in COUNCIL DISTRICT 5.

The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Park Gas Lease Project Fund.

Gary P. Kutilek d/b/a The Landscape Alliance proposes to perform the additional design and engineering
services for this amendment for a lump-sum fee amount of $138,759.50. Staff considers it to be fair and
reasonable for the scope of services proposed.
On June 4, 2013, (M&C C-26303) the City Council authorized the execution of an Engineering Agreement
with Gary P. Kutilek d/b/a The Landscape Alliance in the amount of $77,800.00 to develop a park
improvement conceptual master plan and prepare construction documents for park improvements at the
site. Project funding includes the amount of $648,046.00 from gas bonus funds and the amount of
$90,000.00 received from a License Agreement between the City and T-Mobile West Corporation (M&C L-
14904) for the installation of a communication tower at the park, together totaling $738,046.00.
Ongoing creek bank erosion has occurred at the site causing further impact on the existing park drive,
storm drain and site utitilities.
M/WBE Office - Based on the cost savings of the original contract inclusive of this amendment No. 1, Gary
P. Kutilek d/b/a The Landscape Alliance is in compliance with the City's M/WBE Ordinance by committing
to an overall 74 percent M/WBE participation.
An additional amount of $8,000.00 allocation is required for design phase project administration, which
when added to the revised contract amount of $216,559.50 will result in a total design phase budget
amount of $224,559.50.
