AMENDMENT No . 4
to CITY SECRETARY CONTRACT No. 44578
WHEREAS, the City of Fort Worth (CITY) and Gary P. Kutilek d/b/a The
Landscape Alliance (ENGINEER), made and entered into City Secretary Contract No.
44578 (the CONTRACT), which was authorized by City Council on the 4 day of June,
2013, in the amount of $ 77,800.00; and
WHEREAS the CONTRACT involves engineering services for the following
project:
Sandy Lane Park Improvements; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in
the amount of $138,759.50, which was authorized by M&C #C-26715 on March 18
2014, for the following project:
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 2 in
the amount of $20,370.00, which was executed administratively on October 20,
2014, for the following project:
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 3 in
the amount of $2,250.00, which was executed administratively on March 2, 2016,
for the following project:
WHEREAS, it has now become necessary to execute administratively Amendment
No. 4 to the CONTRACT to increase the scope of work and revise the fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
CONTRACT:

Article I of the CONTRACT is amended to include the additional engineering
services specified in a proposal dated June 13, 2016, a copy of which is
attached hereto and incorporated herein. The cost to CITY for the additional
design services to be performed by ENGINEER totals $11,420.00. (See Attached
Funding Breakdown Sheet, Page -3- )

Article II of the CONTRACT is amended to provide for an increase in the fee
to be paid to ENGINEER for all work and services performed under the CONTRACT,
as amended, so that the total fee paid by CITY for all work and services shall
be an amount of $250,599.50.

All other provisions of the Contract, which are not expressly amenc�
herein, shall remain in full force and effect. �

Re: Sandy Lane Park Additional Services
Dear Bryan:
I appreciate the opportunity to submit The Landscape Alliance's (TLA) proposal to provide additional
services related to the development of improvements at Sarzdy Lane Parlc. These services are based on
additional requirements of the project as requested by the City and subsequent design and permitting
modiiications required by the USACOE. The former project scope was designed and permitted. The
desired additional construction scope, whzch will close a gap in channel protection will require
modifications to civil and landscape plans along with a new modified permit which incorporates these
additions. We should be able to secure the revised permit before construction activities are scheduled in
this axea.

The proposed additional fees for the services defined above is outlined below.

These fees includes all primary services described in the phase outline to be provided by TLA and its
consultants. Fees will be billed on an hourly basis, based on services actually rendered. The City of Fort
Worth will be advised in advance of any anticipated changes in services which will impact the fee. Included
in the proposed fee are costs associated with reproduction and travel related to the production of the contract
products. Items not specifically included in the estimated fee include: �
