HomeMy WebLinkAboutContract 44650-A1CITY S�ChETAR1� CdNTR�#CT �. � - � AMENDMENT No . 1 TO CITY SECRETARY CONTRACT No. 44650 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc., (ENGINEER) made and entered into City Secretary Contract No. 44650, (the CONTRACT) which was authorized by M&C C-26322 on the 9th day of �7uly, 2013 in the amount of $ 164,371; and WHEREAS, the CONTRACT involves engineering services for the following project: Evaluation of Stormwater Development Review Policies; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated January 15, 2014, a copy of which is attached hereto and incorporated herein. The cost to City for the additional engineering services to be performed by Engineer totals $48,341. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $212,712. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. Transportation and Public Works — Stormwater Division City of Fort Worth 1000 Throckmorton Fort Worth, TX 76102 RE: Evaluation of Stormwater Development Review Policies — Amendment No. 1 Dear Mr. Simmons: Through discussions with the City of Fort Worth, it was determined that additional effort would be required to modify the iSWM Criteria Manual forSite Development and Construction which is the drainage standard for the City of Fort Worth. We are requesting an amendment for the additional services included in revising and updating the stormwater criteria. The scope items are discussed briefly below. A fee summary is also included. Scope Addition: 1. iSWM Criteria Manual Updates and Revisions a. Update document to align with the following changes implemented during the Evaluation of Stormwater Development Review Policies. These changes include: i. Modify Chapter 1— Overview of iSWM Criteria Manual to represent the Stormwater Policy and Guidelines for the City of Fort Worth. This includes clarification of the purpose and goals of the City's drainage criteria and the applicability of the drainage standards as it applies to land disturbance and previously approved projects. ii. Modify Chapter 2— integrated Development Process specifically for the City of Fort Worth stormwater development reviews. This will incorporate the flowchart developed as part of the original project. The local provisions for requirements on the iSWM plans will be incorporated into the drainage manual, and no longer included in the separate local provision boxes. iii. Modify Chapter 3— integrated Design Criteria specifically for the City of Fort Worth stormwater design criteria. These revisions will consolidate the existing Chapter .3 design guidelines with the specific City of Fort Worth criteria provided in the current Chapter 5. The local provisions will be incorporated into the drainage manual, and no longer included in the separate local provision boxes. iv. Modify Chapter 4— integrated Construction Criteria will be modified to incorporate the local provisions into the drainage manual, and no longer included in the separate local provision boxes. v. Re-write Chapter 5— The existing Chapter 5, Additional Local Requirements, will be incorporated, where appropriate, in Chapters 2 and 3. Chapter 5 will then be modified to provide sample submittals for the iSWM plans, final construction drawings, and the final iSWM plan. vi. Project Management and Meetings — Additional meetings to discuss the iSWM criteria manual revisions and the final project summary document. 2. Summary Documentation of Findings — A summary report documenting data collected, final recommendations and implementation plan. 3. Training—One additional training meeting, as required by our original scope. The total fee requested for this contract amendment is $48,341. Attachment B includes the fee breakout. The Engineer shall be compensated a total project fee of $48,341.00, on a time and materials basis for hours actually worked on the project at the rates shown on the attached compensations schedule. Payment of the hourly fees shall be considered full compensation for the Basic Services described in Attachment "A" for all labor materials, supplies and equipment necessary to complete the project. B. The Engineer shall be paid in accordance with "Exhibit B-1 ", Supplement to Attachment B. Each invoice from the Engineer shall be verified as to its accuracy and compliance with the terms of this contract by an officer of the Engineer. C. Additional tasks assigned by the CITY not included in Attachment "A" Scope of Services will be billed on an hourly basis. These tasks will not be performed without written authorization from the CITY. A summary of current hourly billing rates is provided in Exhibit "B-2". Method of Payment � Partial payment shall be made to the Engineer monthly based on hours actually worked, upon City's approval of an invoice from the Engineer outlining the current labor and expenses of the total project. The aggregate of such monthly partial fee payments shall not exceed the following: Proiect Phase Project Management Summary Report iSWM Revisions Training Curriculum Estimated Proiect Percent Complete 10% 35% 95% 100% The balance of fees for the time and materials expended on the project, less previous payments, shall be payable after delivery of the FINAL report and electronic files. Progress Reports A. The Engineer shall submit to the designated representative of the Director of the Department of Transportation/Public Works monthly progress reports covering all phases of the analysis in the format required by the City.
