WHEREAS, the City of Fort Worth (CITY) and Wade Trim, Inc.,
(ENGINEER) made and entered into City Secretary Contract No. 44649, (the
CONTRACT) which was authorized by M&C C-26320 on the 9th day of July,
2013 in the amount of $ 524,244.00; and
WHEREAS, the CONTR.ACT was subsequently revised by Amendment Number 1
in the amount of $47,710.00 which was administratively authorized on May
12, 2016; and -
WHEREAS, the CONTR.ACT involves engineering services for the
following project:
Westcliff Drainage Improvements Project; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTR.ACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Re: Westcliff Drainage Improvements Design - Amendment No. 2
Dear Ms. Wilhelm:
As a follow up to discussions at our March 1, 2017 project coordination meeting, we are submitting
this request for Amendment No. 2 to the Westcliff Drainage Improvements design project to provide
engineering services for the next project phase to be implemented by the City as described below. A
location map for the revised project phasing areas is provided on the attached Figure 3.
Our original design contract as amended through Amendment 1 authorized design and construction
services for the Phase 2A Surrey Relief in advance of the Phase 1 relief sewer (to meet the schedule
for the Surrey Street roadway improvements), and deferred design completion of the Phase 1 sewer
for a future phase. The Phase 2A sewer was constructed, but has not been placed into service
pending construction of additional phases to provide an acceptable outlet. The Phase 1 Relief Sewer
was progressed to a 30% design level, but requires further design evaluations and analysis to verify
sizing and invert elevations to serve as a potential outlet for the Phase 2A relief sewer.
Based on our discussions, the City would like to proceed, at this time, with final design and
construction of the Phase 26 project components along Seminary, Cherokee, and Suffolk, including
completion of the Phase 2A Surrey Relief Sewer inlet connections. The Phase 2B project is to also
include the outlet sewer crossing Granbury Road/ Ft. Worth Western Railroad as part of the Phase
2B Improvements. The intent is to size the relief sewers for the full master plan flow capacity
required, but initially construct an interim restricted outlet connection to the existing 54-inch sewer on
the north side of Granbury. The level of service provided by the interim connection will be evaluated
as part of our design analysis. To accomplish this, the Phase 1 30% design shall be updated and
include profiles to verify design requirements for compatibility with both the interim and future outlet
connections.
Amendment No. 2 covers the additional design services to update the Phase 1 30% plans to include
sewer profiles, and additional design and construction services for the Phase 2B sewers on Suffolk,
Cherokee, and West Seminary, with development of the design concept for the interim connection of
the Phase 2A and 2B sewers to the existing outlet sewer in advance of the future Phase 1 project,
and hydraulic evaluation for level of service provided. A separate authorization will be required at a
future date to complete the Phase 1 design plans.

Amendment 2 Scope of Services
The scope of services is to follow tasks as outlined and described in Attachment "A" for
design and construction services. Specific items for the Phase 1 30% Desiqn Plus Profile, and
Phase 2B Desiqn and Construction services are described as follows:
Phase 1 30% Design Plus Profile
The Phase 1 30% design plans will be updated and revised to provide sewer profiles and verify the
preferred horizontal and vertical alignment for the current proposed design configuration. The intent is
to update the design to verify compatibility with the upstream Phase 2A and 2B improvements, and,
also update the anticipated Phase 1 project requirements and construction costs for programming by
the City as a future CIP project.
Specific Phase 1 design tasks are to include the following items:
- Update hydraulic design calculations to evaluate the use of box culverts rather than circular
pipes, and incorporate into the design as a potential cost-saving option.
- Verify relief sewer sizes, location, and proposed sewer invert elevations for vertical alignment.
- Conduct hydraulic analysis to confirm design compatibility of the Phase 2B sewer crossing
under Granbury Road/Ft. Worth Western Railroad with the Phase 1 master plan
requirements.
- Coordinate design with Water and Sewer Department for any planned improvements by
others along the Phase 1 alignment.
- Evaluate Trail Creek road crossing requirements and outlet to the existing open drain west of
Trail Creek.
- Prepare updated 30% Design with profile plans for City review.
- Update cost estimates based on revised plans.
- Identify any easements or right-of-way anticipated.
Phase 2B Design and Construction Services
- Complete design, bidding, and construction services for the Phase 2B project areas shown on
Figure 3 along Suffolk, Cherokee, and Seminary.
- Identify conflicts with existing utilities that will require utility relocations by others.
- Develop design details for Granbury Road/Ft. Worth and Western Railroad Crossing sized for
both Phase 1 100-Year design storm conditions and restricted interim condition outlet to
existing downstream trunk sewer
- Coordinate with Ft. Worth and Western Railroad for permitting requirements and permit
application, including soil bores and Geotech Report.
- Complete the following tasks as described in Attachment "A" Phase 2B project areas:
• Task 1 Project Management
• Task 2 Concept Design (30%)
• Task 3 Preliminary Design (60%)
• Task 4 Final Design plans and specifications
• Task 5 Bid Phase services
• Task 6 Construction Phase Services

Budqet Amendment Request
To complete the Addendum No. 2 scope of work items, we request a design authorization in the
amount of $574,992.
A cost and man-hour breakdown by task for Amendment 2 is attached. The budget amount includes
services by our subconsultants in the amount of $121,500, with $80,500 MBE/SBE [for Pacheco
Koch (PK), Rios, and Alliance Geotechnical Group (AGG)] and $41,000 non-MBE/SBE [Lachel &
Associates]. The MBE/SBE amount represents 14% of the Amendment 2 budget amount.
Schedule
The City is programming bidding and construction of the Phase B project for Fiscal Year 2018-2019
with construction to begin in September 2018. This requires the project design be completed and
ready for bidding in March 2018. A preliminary design schedule is attached assuming Notice to
Proceed to be issued by June 1, 2017. We will provide an updated schedule for review at the project
kick-off meeting.

Scope for Enqineerinq Desiqn Related Services for Storm Water Improvements Projects
The scope set forth herein defines the work to be perFormed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to cleariy define the
work to be perFormed and address the needs of the Project. Under this scope, "ENGINEER"
is expanded to include any sub-consultant, including surveyor, employed or contracted by
the ENGINEER.
OBJECTIVE
The objective of this project is to relieve fiooding in the Westcliff South Drainage Basin.
Scope includes design and construction of PH 2B drainage improvements along portions of
Seminary, Cherokee, and Suffolk; installation of inlets previously designed under the PH 2A
Surrey Street Project; and providing 30% conceptual design and profiles for PH 1. Refer to
Figure 3 — Location Map.

TASK 1. DESIGN MANAGEMENT.
ENGINEER will manage the work outlined in this scope to ensure efficient and effective use
of ENGINEER's and CITY's time and resources. ENGINEER will manage change,
communicate effectively, coordinate internally and externally as needed, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress
on the work.

• Attend a pre-design project kickoff/chartering meeting with CITY staff to confirm and
clarify scope, understand CITY objectives, and ensure economical and functional
designs that meet CITY requirements.
� Conduct and document monthly project update meetings with CITY Project Manager.
• Conduct review meetings with the CITY at the end of each design phase.
• Prepare invoices, in accordance with Attachment B and submit monthly in the format
requested by the CITY.
� Prepare and submit monthly progress reports in the format provided by the respective
CITY Department.
• Prepare and submit baseline Project Schedule initially, and Project Schedule updates
according to the City of Fort Worth's Schedule Guidance Document.
• Complete Monthly M/WBE Report Form and Final Summary Payment Report Form at
the end of the project.
• Coordinate with other agencies and entities as necessary for the design of the
proposed infrastructure, and provide and obtain information needed to prepare the
design.
• With respect to coordination with permitting authorities, ENGINEER shall
communicate with permitting authorities such that their regulatory requirements are
appropriately reflected in the designs. ENGINEER shall work with regulatory
authorities to obtain approval of the designs, and make changes necessary to meet
their requirements, as part of the design scope.
• Personnel and Vehicle Identification: When conducting site visits to the project
location, the ENGINEER or any of its sub-consultants shall carry readily visible
information identifying the name of the company and the company representative.
ASSUMPTIONS
• The current schedule assumes the design project will have 10 month duration.

TASK 2. CONCEPTUAL DESIGN (30 PERCENT).
The Conceptual Design shall be submitted to CITY per the approved Project Schedule.

The purpose of the conceptual design is for the ENGINEER to identify, develop,
communicate through the defined deliverables, and recommend the design concept that
successfully addresses the design problem, and to obtain the CITY's endorsement of this
concept. ENGINEER will utilize concepts and criteria contained in the current CITY — iSWM
Criteria Manual for Site Development and Construction for conceptual planning and design.
ENGINEER will develop the conceptual design of the infrastructure for Phase 1 and Phase
2B as foilows.
2.1. Data Collection
Task already perFormed under original contract CS-44649.
2.2. Drainage Computations
ENGINEER will delineate the watershed based on contour data and field
verification and document existing street, right-of-way and storm drain capacities
for the subject site. A drainage area map will be drawn at maximum 1" = 200'
scale from available 2-foot contour data with the contours labeled. Data source
and year will be provided by the CITY. Calculations regarding street and right-of-
way capacities and design discharges (5-year and 100-year frequencies) at
selected critical locations will be provided. Other frequencies as required by
iSWM criteria may be appropriate for outfalls and sensitive locations. Capacities
of existing storm drain will be calculated and shown. All calculations shall
conform to CITY criteria delineated in the current CITY iSWM Criteria Manual for
Site Development and Construction. All locations in the project area where 100-
year runoff exceeds available storm drain and right-of-way capacities shall be
clearly identified. The ENGINEER's responsibility includes recommendations for
improvements of the existing system as deemed reasonable and consistent with
CITY standards.
2.3. SubsurFace Utility Engineering
Provide SubsurFace Utility Engineering (SUE) to Quality Level B, and Quality Level A at
select locations as described below. The SUE shall be perFormed in accordance with
Cl/ASCE 38-02.
Qualitv Level D
• Conduct appropriate investigations (e.g., owner records, County/CITY records,
personal interviews, visual inspections, etc.), to help identify utility owners that
may have facilities within the project limits or that may be affected by the project.
• Collect applicable records (e.g., utility owner base maps, "as built" or record
drawings, permit records, field notes, geographic information system data, oral
histories, etc.) on the existence and approximate location of existing involved
utilities.
• Review records for: evidence or indication of additional available records;
duplicate or conflicting information; need for clarification.
• Develop SUE plan sheets and transfer information on all involved utilities to
appropriate design plan sheets, electronic files, and/or other documents as
required. Exercise professional judgment to resolve conflicting information. For
information depicted, indicate: utility type and ownership; date of depiction;

quality level(s); end points of any utility data; line status (e.g., active, abandoned,
out of service); line size and condition; number of jointly buried cables; and
encasement.
Qualitv Level C(includes tasks as described for Qualitv Level D)
• Identify surFace features, from project topographic data and from field
observations that are surface appurtenances of subsurFace utilities.
• Include survey and correlation of aerial or ground-mounted utility facilities in
Quality Level C tasks.
• Survey surFace features of subsurFace utility facilities or systems.
• The survey shall also include (in addition to subsurFace utility features visible at
the ground surface): determination of invert elevations of any manholes and
vaults; sketches showing interior dimensions and line connections of such
manholes and vaults; any surFace markings denoting subsurFace utilities,
furnished by utility owners for design purposes.
• Exercise professional judgment to correlate data from different sources, and to
resolve conflicting information.
• Update (or prepare) plan sheets, electronic files, and/or other documents to
reflect the integration of Quality �evel D and Quality Level C information.
• Recommend follow-up investigations (e.g., additional surveys, consultation with
utility owners, etc.) as may be needed to further resolve discrepancies.
• Provide Quality Level C to identify overhead utilities on the project and provide
the overhead utility information on the SUE plan sheets.
Level B(includes tasks as described for Qualitv Level C)
• Select and apply appropriate surFace geophysical method(s) to search for and
detect subsurFace utilities within the project limits, and/or to trace a particular
utility line or system.
• Based on an interpretation of data, mark the indications of utilities on the ground
surFace for subsequent survey. Utilize paint or other method acceptable for
marking of lines.
• Unless otherwise directed, mark centerline of single-conduit lines, and outside
edges of multi-conduit systems.
• Resolve differences between designated utilities and utility records and surveyed
appurtenances.
• Recommend additional measures to resolve differences if they still exist.
Recommendations may include additional or different surface geophysical
methods, exploratory excavation, or upgrade to Quality Level A data.
• As an alternative to the physical marking of lines, the ENGINEER may, with
CITY's approval, utilize other means of data collection, storage, retrieval, and
reduction that enables the correlation of surface geophysical data to the project's
survey control.
Level A
• Expose and locate utilities at specific locations.
• Tie horizontal and vertical location of utility to survey control.
• Provide utility size and configuration.
• Provide paving thickness and type, where applicable.

• Provide general soil type and site conditions and such other pertinent information
as is reasonably ascertainable from each test hole site.
Prior to entering private property (if necessary), the ENGINEER shall prepare,
mail and obtain Temporary Right of Entries from landowners.
2.4. The Conceptual Design Package shall include the following:
• Written summary of alternative design concepts considered, strengths and
weaknesses of each, and the rationale for selecting the recommended design
concept.
• Cover sheet
• Drainage area map with supporting drainage computations in the CITY's
standard tabular format.
• Conceptual iSWM Checklist in accordance with the current iSWM Criteria Manual
for Site Development and Construction. Include documentation that the
proposed storm water project will not impact upstream and downstream
properties.
• SUE Plan sheets sealed by a licensed professional engineer registered in the
State of Texas.
• Horizontal alignment (excluding profiles) of proposed storm water improvements,
including existing lot layout, streets, street right-of-way, proposed easements,
and existing utilities gathered during the SUE within the project limits.
• Proposed phasing of water, sanitary sewer, street and drainage work
documented in both the project schedule and narrative form.
• Documentation of key design decisions (Project Decision Log).
• Estimates of probable construction cost.
ASSUMPTIONS
• All storm water calculations and design shall conform to the current CITY iSWM
Criteria Manual for Site Development and Construction.
• The SUE and SUE plan sheets shall be in accordance with Cl/ASCE 38-02.
Level A SUE shall be performed at the following locations:
o Sanitary sewer service locations and FL elevations at service cleanout (or at
ROW line) where sanitary service crosses proposed storm sewer.
• Water meter numbers, size and coordinates.
• Existing telecommunication duct bank in south bound lane on west side of
Granbury, and other locations as necessary based on Level B through D
SUE.
• 2 full size (22" X 34") sets of conceptual plans.
8 half size (11" X 17") sets of conceptual plans.

10 copies of the written summary, conceptual iSWM checklist, project decision
log, and estimate of probable construction cost.
• DWF files created from design CAD drawings will be uploaded to the designated
project folder in Buzzsaw
• All submitted documents and checklists will also be uploaded t the designated
project folder in Buzzsaw
• ENGINEER shall not proceed with Preliminary Design activities without written
approval by the CITY of the Conceptual Design Package.

TASK 3. PRELIMINARY DESIGN (60 PERCENT).
Preliminary plans shall be submitted to CITY per the approved Project Schedule.
ENGINEER will develop the preliminary design of the infrastructure for Phase 2B as follows.
3.1. Development of Preliminary Design Drawings shall include the following:
• Cover Sheet
• Drainage area maps showing proposed improvements with drainage calculations
and hydraulic computations in accordance with the current iSWM Criteria Manual
for Site Development and Construction.
A Project Control Sheet, showing all Control Points, used or set while gathering
data. Generally on a scale of not less than 1:400. The following information shall
be indicated for each Control Point: Identified (existing City Monument #8901, PK
Nail, 5/8" Iron Rod); X, Y and Z Coordinates, in an identified coordinate system,
and a referred bearing base. Z coordinates on City Datum only; descriptive
location (i.e. set in the centerline of the inlet in the South curb line of North Side
Drive at the East end of radius at the Southeast corner of North Side Drive and
North Main Street).
• Overall project easement layout sheet (if applicable).
• SUE plan drawings.
• Preliminary iSWM Checklist in accordance with the current iSWM Criteria Manual
for Site Development and Construction
• Plan and profile drawings of proposed storm water improvements, including
existing lot layout with property ownership, streets, curb lines, driveways,
medians (if applicable), sidewalks, existing and proposed water and sanitary
sewer mains, existing utilities gathered during the SUE and existing utility
easements within the project limits.
• No less than two bench marks per plan/profile sheet.

• The ENGINEER will prepare standard and special detail sheets that are not
already included in the City's standard details. These may include connection
details between various parts of the project, tunneling details, boring and jacking
details, waterline relocations, details unique to the construction of the project,
trenchless detaiis, and special service lateral reconnections.
3.2. Geotechnical Investigation/Pavement Design
• Prior to entering private property (if necessary), the ENGINEER shall prepare,
mail and obtain Temporary Right of Entries from landowners.
Soil investigations, including fieid and laboratory tests, borings, related
engineering analysis and recommendations for determining soil conditions will be
made. In addition to the above investigations, borings and appropriate field and
laboratory analysis wili be made at reasonable interva�s along the project
alignment for the Contractor's use in determining soil conditions for preparing
bids and a Trench Safety Plan.
• The ENGINEER shall prepare a detailed geotechnical engineering study and
pavement design in conformance with the City of Fort Worth Pavement Design
Standards Manual, 2005. The study shall include recommendations regarding
utility trenching and identifying existing groundwater elevation at each boring.
• The ENGINEER shall prepare a detailed geotechnical engineering study for the
installation of pipe by "other than open cut" design for the improvements crossing
the railroad.
3.3 Constructability Review
• Prior to the 60 percent review meeting with the CITY, the ENGINEER shall
schedule and attend a project site visit with the CITY Project Manager and
Construction personnel to walk the project. The ENGINEER shall summarize the
CITY's comments from the field visit and submit this information to the CITY in
writing.
3.4 Public Meeting
After the preliminary plans have been reviewed and approved by the CITY, the
ENGINEER shall prepare project exhibits, and attend public meeting to help
explain the proposed project to residents. The CITY shall select a suitable
location and mail the invitation letters to the affected customers. The ENGINEER
shall coordinate with CITY GIS staff to identify affected property owners/residents
and develop a spreadsheet listing addresses of those to invite to the public
meeting.
3.5 Utility Clearance
The ENGINEER will consult with the CITY's Transportation and Public Works
Department, Water Department, and other CITY departments, public utilities,
private utilities, and government agencies to determine the approximate location
of above and underground utilities, and other facilities (current and future) that
have an impact or influence on the project. ENGINEER will design CITY facilities
to avoid or minimize conflicts with existing utilities, and where known and
possible consider potential future utilities in designs.

• The ENGINEER shall upload individual DWF files for each plan sheet of the
approved preliminary plan set to the designated project folder in Buzzsaw for
forwarding to all utility companies which have facilities within the limits of the
project. The DWF files should be created directly from the CAD files as opposed
to PDF files.
ASSUMPTIONS
• All storm water calculations and design shall conform to the current CITY iSWM
Criteria Manual for Site Development and Construction.
• 20 borings at an average bore depth of 30 feet each will be provided. Soil bores
will be obtained for both the Phase 1 and Phase 2B sewer routes.
• Two copies of each geotechnical report will be delivered to the CITY.
• 2 full size (22" X 34") sets of preliminary plans.
13 half size (11" X 17") sets of preliminary plans.
15 copies of the preliminary iSWM checklist, project decision log, and estimate of

submit Final Plans (100%) to the CITY per the approved Project Schedule. Each plan
sheet shall be stamped, dated, and signed by the ENGINEER registered in State of

• Unit Price Proposal documents are to be created utilizing CFW Bidtools only
and combined in a specified spreadsheet workbook, Bid Proposal Worksheet
Template, and will be populated and configured so that all pages are
complete and the Summary Worksheet(s) in the workbook detail and
automatically summarize the totals from the inserted Unit Price Proposal
document worksheets.
� Plan Sets are to be uploaded to Buzzsaw in two formats, .pdf and .dwf files.
The .pdf will consist of one file of the entire plan set. The .dwf will consist of
individual files, one for each plan sheet, and will be numbered and named in
a manner similar to that of the plan set index.
• The ENGINEER shall sell contract documents and maintain a plan holders list on
Buzzsaw from documents sold and from Contractor's uploaded Plan Holder
Registrations in Buzzsaw.
The ENGINEER will develop and implement procedures for receiving and
answering bidders' questions and requests for additional information. The
procedures shall include a log of all significant bidders questions and requests
and the response thereto. The log shall be housed and maintained in the
project's Buzzsaw folder titled Request for Information. The ENGINEER will
provide technical interpretation of the contract bid documents and will prepare
proposed responses to all bidders' questions and requests, in the form of
addenda. The ENGINEER shall upload all approved addenda onto Buzzsaw and
mail addenda to all plan holders.
• Attend the prebid conference in support of the CITY.
• Assist the CITY in determining the qualifications and acceptability of prospective
contractors, subcontractors, and suppliers.
• When substitution prior to award of contracts is allowed in the contract
documents, the ENGINEER will advise the CITY as to the acceptability of
alternate materials and equipment proposed by bidders.
• Attend the bid opening in support of the CITY.
• Tabulate and review all bids received for the construction project, assist the CITY
in evaluating bids, and recommend award of the contract. A copy of the Bid
Tabulation and the CFW Data Spreadsheet created utilizing CFW Bidtools only
are to be uploaded into the project's Bid Results folder on Buzzsaw.
• Assist the CITY with assembling and awarding contracts for construction,
materials, equipment, and services.
• Incorporate all addenda into the contract documents and issue conformed sets.
5.2 Final Design Drawings
• Final Design Drawings shall be submitted as an Adobe Acrobat PDF format
(version 6.0 or higher) file and DWF format. There shall be one (1) PDF file
and one (1) DWF file (created from CAD application of drawing) for the TPW plan
set and a separate PDF and DWF file for the Water plan set. Each PDF and
DWF file shall be created from the original CAD drawing files and shall contain all

TASK 6. CONSTRUCTION PHASE SERVICES.
ENGINEER will support the construction of Phase 2B as follows.
6.1 Construction Support
• The ENGINEER shall attend the preconstruction conference.
• After the pre-construction conference, the ENGINEER shall provide project
exhibits and attend public meeting to help explain the proposed project to
residents. The CITY shall select a suitable location and mail the invitation letters
to the affected customers.
• The ENGINEER shall visit the project site at requested intervals as construction
proceeds to observe and report on progress.
• The ENGINEER shall review shop drawings, samples and other submittals
submitted by the contractor for general conformance with the design concepts and
general compliance with the requirements of the contract for construction. Such
review shall not relieve the Contractor from its responsibility for performance in
accordance with the contract for construction, nor is such review a guarantee that
the work covered by the shop drawings, samples and submittals is free of errors,
inconsistencies or omissions. The ENGINEER shall log and track all shop
drawings, sampies and other submittals in Buzzsaw.
• As requested by the CITY, the ENGINEER shall provide necessary interpretations
and clarifications of contract documents, review change orders, and make
recommendations as to the acceptability of the work.
• The ENGINEER shall attend the "Final" project walk through and assist with
preparation of finai punch list.
6.2 Record Drawings

• The ENGINEER shall prepare record drawings from information provided by the
CITY depicting any changes made to the Final Drawings during construction.
The following information shall be provided by the CITY:
o As-Built Survey
o Red-Line Markups from the Contractor
o Red-Line Markups from City Inspector
o Copies of Approved Change Orders
o Approved Substitutions
The ENGINEER shall modify the Final Drawings electronically and shall place a
stamp on the plans indicating that they represent Record Drawings of the project
as constructed. The stamp shall be signed and dated by the ENGINEER and
shall be placed on each plan sheet, whether there are any revisions on the sheet
or not. Each sheet shall clearly indicate all changes which apply to that sheet by
clouding and numbering, or other suitable means.
• The following disclaimer shall be included with the Record Drawing stamp:
o These Record Drawings were prepared using information provided by
others and represent the as constructed conditions to the extent that
documented changes were provided for recording. The ENGINEER
assumes no liability for undocumented changes and certifies only that the
documented changes are accurately depicted on these drawings.
• The ENGINEER shall submit a full size set of sealed Final Drawings, modified
and stamped as Record Drawings for record storage. The ENGINEER may keep
copies of the information provided by the CITY for their files, but all original red-
lined drawings shall be returned to the CITY.
Record Drawings shall also be submitted as an Adobe Acrobat PDF format

• The ENGINEER shall determine rights-of-way and easement needs for Phase I
and Phase 2B projects. Required temporary and permanent easements will be
identified based on available information and recommendations will be made for
approval by the CITY.
7.2 Right-of-Way/Easement Preparation and Submittal.
• The ENGINEER shall prepare documents to be used to obtain right-of-way and
permanent and/or temporary easements required to construct the improvements.

7.3 Temporary Right of Entry Preparation and Submittal
� Prior to construction, the ENGINEER shall prepare, mail and obtain Temporary
Right of Entries from landowners. It is assumed that letters will only be required
for land owners adjacent to temporary construction easements or who are
directly affected by the project and no easement is required to enter their
property.
• The documentation shall be provided in conformance with the checklists and
templates available on the CITY's Buzzsaw site.
ASSUMPTIONS
Right-of-Way research includes review of property/right-of-way records based on
current internet based Tarrant Appraisal District (TAD) information available at
the start of the project and available on-ground property information (i.e. iron
rods, fences, stakes, etc.). It does not include effort for chain of title research,
parent track research, additional research for easements not included in the
TAD, right-of-way takings, easement vacations and abandonments, right-of-way
vacations, and street closures.
DELIVERABLES
• Right-of-Way and existing or proposed easements shown in the plans.
• Right-of-Way, easement exhibits and metes and bounds provided on CITY forms
(if necessary).
• Temporary right of entries (if necessary).
TASK 8. SURVEY.
ENGINEER will provide survey support as follows.
8.1 Design Survey
ENGINEER will perForm field surveys to collect horizontal and vertical elevations
and other information needed by ENGINEER in design and preparation of plans
for the project. Information gathered during the survey shall include topographic
data, utilities as required by the SUE, structures, trees (measure caliper, identify
overall canopy, and have qualified arborist identify species of trees), and other
features relevant to the final plan sheets. Existing drainage at intersections will
be verified by field surveys. Spot elevations will be shown on intersection layouts
with cross slope to fit intersecting grade lines.
• The minimum survey information to be provided on the plans shall include the
following:
— A Project Control Sheet, showing ALL Control Points, used or set while
gathering data. Generally on a scale of not less than 1:400:

8.3. Construction Survey
The construction survey/staking and as-built survey will be provided by the CITY or
Contractor.
• ENGINEER shall be available to the CITY on matters concerning the layout of the
project during its construction

9.1. Storm Water Pollution Prevention Plan
• For projects that disturb an area greater than one (1) acre, the contractor will be
responsible for preparing and submitting the Storm Water Pollution Prevention
Plan (SWPPP) with appropriate regulatory agencies. The ENGINEER will
prepare the iSWM Construction Plan according to the current CITY iSWM
Criteria Manual for Site Development and Construction with will be incorporated
into the SWPPP by the contractor.

Additional Services not included in the existinq Scope of Services — CITY and
ENGINEER agree that the following services are beyond the Scope of Services
described in the tasks above. However, ENGINEER can provide these services, if
needed, upon the CITY's written request. Any additional amounts paid to the
ENGINEER as a result of any material change to the Scope of the Project shall be
agreed upon in writing by both parties before the services are performed. These
additional services include the following:
• Negotiation of easements or property acquisition.
• Services related to development of the CITY's project financing and/or budget.
• Services related to disputes over pre-qualification, bid protests, bid rejection
and re-bidding of the contract for construction.
• Construction management and inspection services
• Performance of materials testing or specialty testing services.
• Services necessary due to the default of the Contractor.
• Services related to damages caused by fire, flood, earthquake or other acts of
God.
• Services related to warranty claims, enforcement and inspection after final
completion.
• Services to support, prepare, document, bring, defend, or assist in litigation
undertaken or defended by the CITY.
• Performance of miscellaneous and supplemental services related to the project
as requested by the CITY.

Compensation
A. The ENGINEER shall be compensated a total lump sum fee of $574,992.00.
The total lump sum fee shall be considered full compensation for the services
described in Attachment A, including all labor materials, supplies, and equipment

B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.

RECOMMENDATION:
It is recommended that the City authorize the execution of Amendment No, 2 to City Secretary
Contract No. 44649, an Engineering Agreement with Wade Trim, (nc., in the amount of $574,992.00
for additional engineering services for the Westcliff Drainage Improvements project; thereby revising
the total contract amount to $1,146,946.00.
DISCUSSION:
On July 9, 2013, (M&C C-26320) the City Council authorized an Engineering Agreement with Wade
Trim, Inc., in the amounf of $524,244.00 for engineering services for analysis and cost-benefit
evaluation of phased capital improvement projects to address flooding in the Westcliff North and
Westcliff 5outh drainage basins and the design of Phase 2A Drainage Improvements. The contract
was subsequently amended to include construction phase services for Phase 2A Drainage
Improvements by Amendment No. 1 in the amount of $47,710.00, which was administratively
authorized on May 12, 2016.
The Amendment recommended by this Mayor and Council Communication (M&C) is for engineering
� services for design and construction-phase for Phase 2B which is anticipated to be constructed in FY
^ 2Q18 and conceptual design of Phase 1 which is anticipated to be constructed in FY 2021.

M/WBE Office — Wade Trim, Inc,, is in compliance with the City's BDE Ordinance by committing to an
additional 14 percent SBE participation for this Amendment No. 2.
Funding for this amendment is being provided from Stormwater Capital Projects Bond Fund.
