CONTRACT NO. 44635
This Second Addendum to City Secretary Contract Number 44635 ("Second Addendum") is by
and between the City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas,
acting by and through its duly authorized Assistant City Manager, and John R. Dennis ("Consei•vator"),
an individual. The City has designated the Arts Council of Fort Worth & Tarrant County, Inc., to manage
this Agreement on its behalf.
WHEREAS, on June 26, 2013, the City and Conservator entered into a professional services
agreement whereby Conservator will provide general inaintenance, conservation, and consultation to the
City for the City's art Collection, said contract being City Secretaiy Contract ("CSC") No. 44635
("Contract");
VVI-IEREAS, the Contract sets forth that the Services to be provided shall be based on the annual
Fort Worth Public Art work plan and on an as-needed basis in accordance with fully executed addenda;
WHEREAS, the City owns a piece of artwork titled, Runnels, which is located at the Fort Worth
Botanic Garden;
WHEREAS, pursuant to CSC 44546-AD1, McKay Lodge Fine Arts Conservation Laboratory,
Inc. prepared a written condition assessinent report with photographic documentation, which included
recommendations far repairs and iinprovements to Runnels, which is attached hereto as Exhibit D and
incorporated herein for all purposes ("Condition AssessmenY');
WHEREAS, as part of its services contract with the Conservator, the City desires to have the
Conservator perform the recominended repairs and improvements to Runnels as outlined in the Condition
Assessment and this Second Addendum;
WHEREAS, the City and Conservatar wish to set out the Services to be provided per the
Contract that will be speciiic to this Second Addendum with the intent that further Services may be
requested by the City through future addenda; and
NOW, THEREFORE, in consideration of the mutual covenants herein expressed, the parties
agree as follows:
1. Conservator shall perform maintenance and conservation treatment on the following artwork
� in the Collection pursuant to the tenns of the Contract and any terms contained within this

� entrance to the Botanic Garden Center and contiguous runnels that support the
? fountain. The Condition Assessment identifies failure issues and makes
� recommendations for repairs and cleaning. Conservator shall perform all Services in
,�. in accordance with the Conservator's Cost Proposal (which is attached hereto as
� Exhibit E and incorporated herein for all purposes), in substantial confonnity with the

Disassembling the moveable plumbing and puinps located in each
fountain pool and storing them on site in the maintenance area for the
duration of the cleaning and repair project.
Cleaning all fountain surfaces and ceramic tile of all mineral deposits
with dilute solutions of acids, commercial acidic cleaners and water (e.g.
Sure Klean 1261 Hard Water Deposit Remover; ProSoCo, Inc.; and
diluter inuriatic acid).
Cutting out all failed sealant caulk located between the ceramic runnel
elements and clean all surfaces to accept new sealant.
Fill open joint with closed cell backer rod and caulk with a silicone
sealant (Dow Corning 795 or comparable other product). Caulk color
shall match as closely as possible to the cerainic color.
Remove all loose grout between tile elements, where applicable. Cut out
joint shall be cleaned by washing and wet vacuuming.
Regrout all open joints with color matched grout including a polymer
component for better bonding (Mapei, Karacolor S, or a comparable
product).
Coat tile and grout with a protective sealant product for tile and grout
(Mapei, Ultracare Penetratign Plus SB or a comparable other product).
Reinstall plumbing and pumps following cleaning and sealing process.
2. Payment for all Services under this Second Addendum shall be in accardance with Article 3 of the
Contract and shall not exceed that which is set forth in the attached Conservator's Cost Proposal unless
both parties agree in writing to amend this Second Addendum to that effect.
3. All terms and conditions of the Contract not specifically addressed herein remain in full force and
effect and are binding upon the pai�ties.

Description
The Riurnels fountain is comprised of two separ:►te fountain installations, each located on
opposite sides of the enuance walkway adjacent to the front enhy doors (Image 1). The
fountains are consttucted of glazed, fired, stoneware h•ough elements mounted onto concrete
supports in such a mamier as to create a trough or "iumiel" waterway (Image 2). Each founiain
has an integ,�•al pool for tbe runnel water to fall into (Image 3}. Each fountain consists of four (4)
ivnnel channels canying water to four (4) evenly space�i outlets which direct thz water flows to
cascade into the pool. The fountains nvrror each other in overall layout but they are detailed
differently as the runnel configurations for e�3ch fountain take different paths and the color of one
fountain is brown (Image 4) while the other is black (Im�ge 5).
Condition
General
The fountains are currently operable and they run year-round. They have been mvntvned
regularly by the maintenance staff and that has kept th� mechlnical aspects of the fount��ins in
good condition as far as the plumbing and lighting but the wzter chenusuy has not been
maintained in a manner to keep mineral deposits from building up on the ceramic s►u•faces.
Mineral Deposits
1he surfaces of the ceranuc eleme.nts, r�nnels, pool coping edges and tiles lining the pools are
soiled and have a heavy build-up of �vhite colored mineral deposits where the fountain water has
splashed and dried (Image 6) or at the interface between water and air (Image 7). The nuner�i
deposits should be removed and the surfaces of the iunnels and coping coated with a sealant
which allows for easier removal of future deposits. Water chemistry should be maintained in a
way that keeps nunerals from buildiug up.
Mechanical
Both fountains pumps are situated in a location that is hu•d to access unless the fountain is
di.vned (Image 8- typical). The integral scrzen surrounding the pump keeps leaves and debris
out of the pump but the screen clogs up with the volume of debris (Image 8). Piping in the
bottom of the pool has been replaced with white colored PVC which is visually unapp�aling
(Image 8). As of this writing, the Maintenance Dep<�rtment is consideiiug making a larger screen
cover for the pumps, moving the pumps to a side wall of each pool, and changing the PVC pipe
to copper pipe.

The makeup water fill valves are simple toilet tank tloat valves. These work �vell, are easy to
replace and are fairly unobtrusive. They can be spray painted black or bro�vn to match the pool
wall.
Pool
The pools :u•e lined with ceranuc tile set with 1/4 inch widz grout joints. The tiled pool bottom is
almost entir�ly coated with opaque white colored nuueral deposits. The grout joints look to be in
sound coudition. The mineral deposits should be reuioved from the tile siu•faces.
Runnel Leaks
The runnels are made up of glazeci ceramic elements, each about 2 feet long. The ceranvc
elements making up the runnels are mounted on concrete supporting wails which show signs of
leaking occurring between runnel elements by tbe formation of white colored deposits on the
surface of the c;oncrzte (Image 9). The joints between elemeuts are caulked with adhesive
sealant to make them watertight (Image 10). All of the sealant is in a failed condition (Image 11,
Image 12) some of the backer rod within the joint is exposed. All of the szalant must be rzplaced
to elinunate leaking. A few locations hlve been replaced �iy the Maintenance Staff.
Esthetic Concerns
The runnels are overgrown with plant material (Image 13, Image 14).
Reco�mnenclations
(i ) Clean the fountains sur�aces and ceranvc tile of al] of the nuneral deposits.
(2) Remove atl failed sealant caulk and re-caulk all caulked joints with backer rod and primer
wherz necessary. Utilize a caulk such as Dow Corning 795 in a color matched as closely
as possible to the ceranuc color.
(3) Re-grout joints wherz �eeded. Cut out old loose grout, clean all edges, wash aud tvet
vacuum. Rz-grout tivith a color matched grout with a polymer component (Mapei,
K�racolor S).
(4) Coat the tile and grout �vith a protective sealant product for tile and grout (Mapei,
Ultracare Penetrating Plus SB).
(5) Change PVC plumbing to copper. While making the change to copper, move the pumps
to the side wall of each pool for access when the pool is full. Make a larger stainless
st�el screen cover for each pump that has a handle on rop and is easily removed for
cleaning without having to drain the pool. These actions may be performed by the
maintenance staff

A discussion with Devin Hayes of Aquarium Works of "I'e,cas aUout the �vater chemistry
far the fountain brought some dstails to light. The city water as it comes from the tap for
filling and then mtintvning the water levzl in the paal is highly alkaline. It will cause
mineral deposits to fonu quickiy just as it comes from the tap.
Devin is fanuliar with the water in Fort Worth because of his great experiznce with
aquarium sysizms in the area. We discussed and defined what the fountains nzed to keep
them looking good and attempt to elinunatz tl�e nuneral deposits and lessen the
occunznce of �lgae. Once the fountain is cleaned a water treaUnent program can Ue
initiated.
I have. requested a cost proposal from Devin (attached) for a one year mtintenance
contract to test and monitor the water quality of the fountains in order to establish a base
line for the water quality and to zccurately determine the maintenance steps and time
ancUor cost reguired to achieve the goal of chenucally maintaining thz water quality
by the addition of simple chenucal additives for adjusting the pH of the �vater and by
drai�ung and refilling the fountains with fresh water more often.
Devin 4un•ently cares for the aquarium within the Botanical Garden building. He has
proposed a budget for one year of oversight and mvntenance ta ihe fomit�lin. We have
discussed what this would entail.
Devin �vould begin to fill, drain and tnaintaiu the water quality in an effort to
establish a base line for the fountain water chenustry. The maintenance staff at the
Garden may begin to work along with Devin after a few months to sze what he is �oing.
One of the things we w�nt to deternune is cvhether the Garden mtintenance staff can
reasonably perform the maintenance or if it shouid be left to a contracted specialist like
Devin.
His proposal is attached to this report.

RECOMMENDATION:
it is recommended that the City Council authorize the execution of a non-exclusive Professional
Services Agreement with John R. Dennis in the amount not to exceed $90,000.00 for maintenance
and conservation treatment of various artworks in the Fort Worth Public Art Collection.
DISCUSSION:
This non-exclusive Professional Services Agreement (Agreement) will enable the City to implement
its Public Art Collection Management/Conservation program in order to care for and maintain the
City's Public Art collection as set forth in the Long Range Public Art Plan for the Water Fund adopted
by the City Council on May 9, 2006 (M&C G-15185). The initial term of Agreement will be three years
with the option to renew for three additional one-year terms for a total amount not to exceed
$90,000.00, using funds from the annual Public Art Conservation Fund — Operating Budget.
The Fiscal Year 2013-201,4 Fort Worth Public Art (FWPA) Annual Work Plan adopted by City Council
on October 16, 2012 (M&C C-25920) outlines the Collection Management Plan for the first year of
this Agreement. Subsequent annual Conservation Work Plans, recommended by the Fort Worth Art
Commission and approved by the City Council as part of the Annual Work Plan, will be issued to the
conservator and added as addenda to his Agreement.
BACKGROUND:
The City currently owns 68 artworks accessioned into the Fort Worth Public Art Collection. During
the term of this Agreement, the collection is expected to increase to approximately 90 artworks sited
in all Council Districts. The collection is comprised of works including stand-alone sculptures, painted
and tile murals, architecturally integrated enhancements, and artist-created historic monuments.
On January 7, 2013, FWPA issued a Request for Qualifications (RFQ) for conservation services for
the purposes of creating a pre-qualified pool of qualified conservators with various media
specialties. The RFQ was sent to individuals and firms, posted on the FWPA and City of Fort Worth
websites, and posted on the National Public Art Network Listserv. Services to be performed under
this Agreement include (but are not limited to): condition assessments, general cleaning,
conservation treatment and repair, treatment documentation (written and photographic), maintenance
planning, and design review and consultation.
Respondents were asked to provide materials that demonstrate ability to accomplish the work (firm
history, team credentials and related experience), philosophical treatment approach, evidence of
insurability and schedule of fees. Applicants were evaluated based on ability to perform with various
medias and materials, including metals, organic materials, stone, tile, glass and technological media.
Seven candidate submitted material for review. Each submission was reviewed by a panel
consisting of the following individuals:

A scoring matrix considering 13 factors was created to rank professional qualifications, experience,
ability, and specialization and to quantify rate structure. The panel selected four candidates to
provide various services to the City, with each being chosen to fulfill specific needs. John R. Dennis
was selected as a qualified conservator to provide the above-listed services and has broad-based
experience with the Fort Worth Public Art Collection, having satisfactorily provided services to the
collection since 2005. Over the course of the term of this Agreement, artworks located in all Council
Districts throughout the city will benefit.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, of the General Fund.
