Washington, its duly authorize Assistant City Manager, and Tarrant County, acting on behalf of the Tarrant County Medical Examinet•'s Office (hereinafter "County"). WHEREAS, City and County entered into an Interlocal Agreement for Forensic Laboratory Services identified as Fort Worth City Contract No. 44614 ("Agreement") for a period of one year beginning October 1, 2012 and unlimited, automatic options to renew from year to year subject to appropriations of City funds for this Agreement; and WHEREAS, City and County entered into the First Amendment to the Agreement, which increased the overall contracted amount payable to County by City for services provided under the Agreement; WHEREAS, City and County entered into the Second Amendment to the Agreement, which renewed the term of the Agreement and incorporated an agreed upon fee schedule; WHEREAS, City and County entered into the Third Amendment to the Agreement, which renewed the term of the Agreement and increased the overall contracted amount payable to County by City for services provided under the Agreement; WHEREAS, it is the collective desire of both City and County to renew the term of the Agreement far one year for a term that shall end on September 30, 2017, and amend the Agreement for Forensic Laboratory Services to incorporate an agreed upon fee scale; and NOW, THEREFORE, City and County, acting herein by the through their duly authorized representatives, hereby amend the Agreement: 1. Deleting the current text of Section 3"Payment for Services" as amended by the Third Amendment to the Agreement and replacing it with the following: Upon completion of the work by County, City will pay County in accordance with the approved agreed upon fee schedule for the Services. Payment will be made by City to County within thirty (30) days of receipt of County's invoices. Each invoice shall be accompanied by sufficient documentation as required by City. However, total payments by City during each term under Agreement, including this amendment and each future renewal, sha11 not exceed $350,000.00 (three hundred and fifty thousand dollars) per term. City shall be solely responsible for monitoring payments under this Agreement, and the not-to exceed amount shall not relieve City of its obligation to pay County for Services rendered at City's t�equest. County shall provide at least thirty (30) days advance written notice of any changes in the fee schedule for any of the Services performed under this Agreement. Any change to the fee schedule, if approved by the City, wi11 be incorporated within this Agreement as a replacement to Exhibit A and shall be signed by both City and County. Any changes in the fee schedule that require an increase in the total amount of funding per term for this Agreement shall be approved by written amendment to this Agreement by both the City and County and shall be effective on the date of execution of the written amendment. 2. Section 4, Term. The term of the Agreement is hereby renewed and shall end on September 30, 2017. The current term will expire on September 30, 2016, unless terminated earlier in accordance with the Agreement. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. TYPE: CONSENT PUBLIC HEARING: 35TARRANT COUNTY FORENSIC LABORATORY SERVICES m SUBJECT: Authorize Renewals of City Secretary Contract No. 44614 with Tarrant County for Professional Forensic Laboratory Services for the Police Department in an Amount of $350,000.00 for the Current Fiscal Year (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council authorize the renewals of City Secretary Contract No. 44614 with Tarrant County for professional forensic laboratory services for the Fort Worth Police Department in an amount of $350,000.00 for the current fiscal year. DISCUSSION: For more than a decade the Fort Worth Police Department Crime Laboratory has engaged the services of the Tarrant County Medical Examiner's Office to conduct professional forensic analysis to aid the lab in efficiently managing its caseload. The current Interlocal Agreement (Agreement) (City Secretary Contract No. 44614) was initially authorized in April 2013, with a one-year initial term in an amount of $50,000.00 (M&C C-26186). The Agreement includes options to renew for subsequent years of service. In November 2013, the City Council authorized the first amendment to the agreement to increase the annual contract amount to $150,000.00 to reflect additional costs associated with working through a backlog of cases requiring forensic analysis and meeting an increasing need for forensic laboratory services on gunshot residue and toxicology. In 2015, the City Council authorized amending the agreement again to increase the annual contract amount to $350,000.00 to address costs associated with continuing to work through the backlog and to reflect an increase in volume of work going to the County after the City's former private forensic laboratory vendor relocated out of state. Staff recommends continuing the agreement with the County. Approval of this M&C would authorize renewal of the agreement, as amended, for the current fiscal year, with an annual contract amount of $350,000.00 and would also authorize renewal of the agreement in future years, provided that funds have been appropriated for that purpose in the then-current budget. Although this renewal contemplates Tarrant County performing all forensic laboratory services, due to the increasing number of cases requiring forensic laboratory services and increases in processing times, staff may determine that entering into contracts with other qualified vendors to supplement services performed by Tarrant County is necessary. If such other contracts are necessary and require approval from the City Council, staff will bring forward a separate M&C; if such other contracts are necessary and do not require approval from the City Council, staff will seek administrative approval. ADMINISTRATIVE INCREASE - An administrative increase or change order for this agreement may be made by the City Manager in accordance with the City Code and does not require specific City Council approval as long as sufficient funds have been appropriated. RENEWAL OPTIONS - This Agreement may be renewed annually at the City's option.
