FIRST AMENDMENT TO
FORT WORTH CITY SECRETARY CONTRACT NO. 44614
INTERLOCAL AGREEMENT FOR FORENSIC LABORATORY SERVICES WITH
TARRANT COUNTY
This Amendment is made and entered into by and between the City of Fort Worth ("City"), a
municipal corporation, located in Tarrant, Denton, and Wise Counties, Texas, hereinafter called
"City," acting herein by and through Charles W. Daniels, its duly authorized Assistant City
Manager and TARRANT COLTNTY, acting on behalf of the TARRANT COLTNTY MEDICAL
EXAMINER' S OFFICER, hereinafter called "County," acting herein by and through B. Glen
Whitley, its duly authorized County Judge.
WHEREAS, City and County entered into an Interlocal Agreement for Forensic
Laboratory Services identified as Fort Worth City Secretary Contract No. 44614 for a period of
one year beginning October 1, 2012, which automatically renews from year to year subject to
appropriations of City funds for this Agreement; and
WHEREAS, it is the collective desire of both City and County to amend the Interlocal
Agreement for Forensic Laboratory Services increase the overall contracted amount that may be
paid by City to County for services under this Agreement.
NOW THEREFORE, KNOWN ALL BY THESE PRESENT:
Fort Worth City Secretary Contract No. 44614 is hereby amended by:
Deleting the current text of Section 3"Payment for Services" and replacing it with

Upon completion of the worlc by County, City will pay County in accordance with the
approved agreed upon fee schedule for the Services. The agreed upon fee schedule is attached
and incorporated within as Exhibit A. Payment will be made by City to County within thirty
(30) days of receipt of County's invoices. Each invoice shall be accompanied by sufficient
documentation as required by City. However, total payments by City during the term of this
Agreement shall not exceed $150,000 (one hundred fifty thousand dollars). City shall be solely
responsible for monitoring payments under this Agreement, and the not-to exceed amount shall
not relieve City of its obligation to pay County for Services rendered at City's request. County
shall provide at least thirty (30) days advance written notice of any changes in the fee schedule
for any of the Services performed under this Agreement. Any change to the fee schedule, if
approved by City, will be incorporated within this Agreement as a replacement to the original
Exhibit A. Any changes in the fee schedule that require an increase in the not-to-exceed amoun

of funding for this Agreement shall be approved by written amendment to this Agreement by
both the City and County.
All other terms, provisions, conditions, covenants and recitals of said Interlocal Agreement for
Forensic Laboratory Services not expressly amended herein shall remain in full force and effect.

County for Forensic Laboratory Services to Increase the Contract Authority in the Amount
of $100,000.00 for a Total Contract Amount of $150,000.00, Adopt Supplemental
Appropriation Ordinance Increasing Appropriations in the General Fund in the Amount of
$100,000.00 and Decreasing the Unassigned General Fund Balance by the Same
Amount (ALL COUNCIL DISTRICTS)

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of amendment to City Secretary Contract No. 44614 with Tarrant County
for Forensic Laboratory Services to increase the contract authority in the amount of $100,000.00 for a
total contract amount of $150,000.00; and
2. Adopt the attached supplemental appropriation ordinance increasing appropriations in the General
Fund in the amount of $100,000.00 and decreasing the unassigned general fund balance by the
same amount.
DISCUSSION:
On April 2, 2013, (M&C C-26186) the City Council authorized a one year contract with Tarrant County
for forensic laboratory services for the City in the amount of $50,000.00. The contract includes
options to renew for subsequent years of service. Tarrant County recently began working on a five
year back log of processing for pending cases and additional funds are necessary to pay for these
services. Furthermore, since 2010, the Police Department has experienced an increase in the need
for forensic laboratory services on gunshot residue and toxicology.
Staff recommends amending City Secretary Contract No. 44614 with Tarrant County to increase the
contract authority under the Agreement in the amount of $100,000.00 for a total contract amount of
$150,000.00 annually to compensate Tarrant County for processing the backlog and to meet the
increased need for forensic laboratory services.
M/WBE OFFICE - A waiver of the goal for MBE/SBE subcontracting requirements was requested by
the Police Department and approved by the M/WBE Office, in accordance with the BDE Ordinance,
because the purchase of goods and services is from sources where subcontracting or supplier
opportunities are negligible.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above
recommendations and adoption of the attached supplemental appropriation ordinance, funds will be
available in the current operating budgets, as appropriated, in the General Fund. Upon approval, the
unassigned fund balance of the General Fund will exceed the minimum reserve as outlined in the
Financial Management Policy Statements.
