CONTRACT NO. 44546
This First Addendum to City Secretary Contract Number 44546 ("First Addendum") is by and
between the City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas, acting
by and through its duly authorized Assistant City Manager, and McKay Lodge Fine Arts Conservation
Laboratoiy, Inc. ("Conservatoc"), an Ohio Corporation, acting by and through Robert G. Lodge, its
President. The City has designated the Arts Council of Fort Worth & Tarrant County, Inc., to manage
this Agreement on its behalf.
WHEREAS, on June 19, 2013, the City and Conservator entered into a professional services
agreement whereby Conseivator will provide general maintenance, conservation, and consultation to the
City for the City's ai�t Collection, said cocrtcact being City Secretaiy Contract No. 44546 ("Contcact");
WHEREAS, the Contract sets forth that the Services to be provided shall be based on the annual
Fort Worth Public Art work plan and on an as-needed basis in accordance with fully executed addenda;
WHEREAS, this addendum is intended to serve as such and sets forth the Services to be
provided per the Contract in accordance with the terms therein; and
WHEREAS, the City and Conservator wish to set out the Services to be provided per the
Contract that will be specific to this addendum with the intent that further Services may be requested by
the City through future addenda.
NOW, THEREFORE, in consideration of the mutual covenants herein expressed, the parties
agree as follows:
1. Conservator shall perform regular maintenance and conservation treatment Services
annually and on an as-needed basis on the following artworks in the Collection pursuant
to the terms of the Contract and any terms contained within this First Addendum:
a. Ruiinels, Gene Owens, 3220 Botanic Garden Way, 76103
Condition Assessment and Treatment Plan
Rtrnnels is comprised of two independent glazed tile fountain pools flanking the
entrance to the Botanic Garden at the Garden Center and contiguous runnels that
support the fountain. The Conservator will perform all Seivices for this artwork in
accordance with the Conservator's Proposal Number 13075, which is attached hereto
as Exhibit 1 and incorporated herein for all purposes, which shall include, but not be
limited to, all labor, travel, services, and any other items required to complete the
Services for this artwork. Payment for all Services shall be in accordance with
Article 3 of the Contract. The parties may amend this First Addendum to allow for
additional payments if additional services are required.
b. Will Rogers Memorial Center Historic Barn Murals, 3400 Burnett-Tandy Drive,

Conservator completed a comprehensive condition assessment of the six Will Rogers
Memorial Center Historic Exhibition Barn Tile Murals ("Murals") on October 5,
2011. The report includes an overview of the infrastructure sus�p�te� be associated

and roofing system, with the conservation treatment of the Cattle Barn #2 tiles. The
Conservator will perform the following Services:
i) Conduct a site visit of Cattle Barn #2 and coordinate with the City of Fort Worth
Public Events staff and its contractors (at a mutually agreeable time) concerning
the any planned conservation treatments; and
ii) Prepare a written condition assessment for Cattle Barn #2 with photographic
documentation and include recommendations for repairs and improvements that
preserve the artistic intent and sculptural integrity of the artwork. The report
should be based on the Conservatoc's previous proposal (10/5/2011) and the
above-referenced site meeting with City staff, including, but not limited to, any
repairs to infrastructure supporting the tile murals.

Any and all Services to be performed under this First Addendum shall be reviewed and
approved by the Collection Manager, including all costs associated with performing the
Services, prior to Conservator commencing such Services.
All terms and conditions of the Contract not specifically addressed herein remain in full force and
effect and are binding upon the parties.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of a non-exclusive Professional
Services Agreement with McKay Lodge Fine Arts Conservation Laboratory, Inc., for conservation
treatment of various artworks in the Fort Worth Public Art Collection in the amount not to exceed
$200,000.00.
DISCUSSION:
This non-exclusive Professional Services Agreement (Agreement) will enable the City to implement
its Public Art Collection Management/Conservation program in order to care for and maintain the
City's Public Art collection as set forth in the Long Range Public Art Plan for the Water Fund adopted
by City Council on May 9, 2006 (M&C G-15185). The initial term of Agreement will be three years
with the option to renew for three additional one-year terms for a total amount not to exceed
$200,000.00, using funds from the annual Public Art Conservation Fund — Capital Budget.
The Fiscal Year 201 �-2014 Fort Worth Public Art (FWPA) Annual Work Plan adopted by City Council
on October 16, 2012 (M&C C-25920) outlines the Collection Management Plan for the first year of
this Agreement. Subsequent annual Conservation Work Plans, recommended by the Fort Worth Art
Commission and approved by the City Council as part of the Annual Work Plan, will be issued to the
conservator and added as addenda to his Agreement.
BACKGROUND:
The City currently owns 68 artworks accessioned into the Fort Worth Public Art Collection. During
the term of this Agreement, the collection is expected to increase to approximately 90 artworks sited
in all Council Districts. The collection is comprised of works including stand-alone sculptures, painted
and tile murals, architecturally integrated enhancements, artist-created historic monuments and
enhancements.
On January 7, 2013, FWPA issued a Request for Qualifications (RFQ) for conservation services for
the purposes of creating a pre-qualified pool of qualified conservators with various media
specialties. The RFQ was sent to individuals and firms, posted on the FWPA and City of Fort Worth
websites, and posted on the National Public Art Network Listserv. Services to be performed under
this Agreement include (but are not limited to): condition assessments, general cleaning,
conservation treatment and repair, treatment documentation (written and photographic), maintenance
planning, and design review and consultation.
Respondents were asked to provide materials that demonstrate ability to accomplish the work (firm
history, team credentials and related experience), philosophical treatment approach, evidence of
insurability and schedule of fees. Applicants were evaluated based on ability to perform with various
medias and materials, including metals, organic materials, stone, tile, glass and technological

media.
Seven candidates submitted materials for review. Each submission was reviewed by a panel
consisting of the following individuals:
1. Arthur Weinman, Fort Worth Art Commissioner
2. Jodie Utter, Fine Art Conservator with the Amon Carter Museum
3. Jenny Conn, Public Art Collection Manager with the Arts Council of Fort Worth and Tarrant
County.
A scoring matrix considering 13 factors was created to rank professional qualifications, experience,
ability and specialization and to quantify rate structure. The panel selected four candidates to provide
various services to the City, with each being chosen to fulfill specific needs. McKay Lodge Fine Arts
Conservation Laboratory, Inc., was selected as a qualified conservation firm to provide the above-
listed services, particularly services that require expertise for major restoration of historic assets,
including the historic tile barn murals at the Will Rogers Memorial Complex. Over the course of the
term of this Agreement, artworks located in All Council Districts throughout the city will benefit.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, from the Specially Funded Capital Projects Fund.
