FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 43229 WITH GREAT LAKES DREDGE & DOCK COMPANY, LLC THIS FIRST AMENDMENT is entered into by and between the City of Fort Worth ("City "), a home-rule municipality in the State of Texas, acting' through Fernando Costa, its duly authorized Assistant City Manager, and Great Lakes Dredge & Dock ,_�ompa�ny,_,� LLC ("Contractor"), by and through � �,� , its duly authorized��, �jt,vy;.(t,►:� �. WHEREAS, the City Secretary Contract No. sediment disposal; and and Contractor, entered into that certain agreement identified as City 43229 ("Con�ract") for Phase 1 of the dredging of Lake Worth and WHEREAS, Phase 1 has been completed and the City wishes to dredge the recreational use areas north and west of IH-820 that were not part of Phase 1 and the areas east of IH-820; and WHEREAS, on January 15, 2013, the City Council approved M&C C-26064 increasing the total Contract amount to $15,493,059.73, to allow for the dredging and sediment disposal for Phase 2; and WHEREAS, both parties agree to amend the Contract to allow for Phase 2 of the dredging of Lake Worth and sediment disposal as provided herein. NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the parties agree as follows: I. Section 2.A: Section 2.A of the Contract shall be amended to include the following: Contractor shall also perform in a good and professional manner the services listed in Attachment 2A for Phase 2 of Project No. 01166. Such services include the dredging of material in certain identified portions of Lake Worth and the testing and disposal of such material, in accordance with the Contract Documents, as amended. II. Section 9A: Section 9A shall be amended as follows: In consideration for the work performed by Contractor under this Contract, as amended, City shall pay Contractor a sum not to exceed fifteen million, four hundred ninety three thousand, fifty-nine dollars and seventy-three cents ($15,493,059.73.) The City is responsible for notifying Contractor of any questions concerning an invoice, and shall not be required to pay Contractor until such questions have been resolved. The work shall comply with these construction drawings and with the current technical specifications of City Secretary Contract Number 43229. 2. The work identified in this Scope of Services shall be performed at the unit prices identified in "Attachment 4A". 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Lake Worth Gas Lease Capital Improvement Fund in the amount of $2,996,155.73 from Gas Well Revenues; 2. Authorize the transfer in the amount of $2,996,155.73 from the Lake Worth Gas Lease Capital Improvement Fund to the Water Capital Projects Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $2,996,155.73; and 4. Authorize the execution of an amendment to City Secretary Contract No. 43229 with Great Lakes Dredge & Dock Company, LLC, in the amount of $2,996,155.73 for a total contract amount of $15,493,059.73 for dredging and disposal of sediment associated with the Lake Worth Dredging Project Phase 2. DISCUSSION: On January 10, 2012, (M&C C-25402) the City Council authorized the execution of City Secretary Contract No. 43229 with Great Lakes Dredge & Dock Company, LLC, in the amount of $12,496,904.00 for Phase 1 of the dredging of Lake Worth and sediment disposal. Phase 2 includes the general recreational use areas north and west of IH-820 that were not a part of Phase 1 and areas east of IH-820. Disposal of the sediment for Phase 2 will also be at the Silver Creek Materials site. Freese and Nichols, the Water Department's consultants on this project have reviewed and agreed with the proposed scope of work for the amendment. This project will be funded with Gas Lease Revenue Funds in the amount of $2,996,155.73. Great Lakes Dredge & Dock, LLC - L.W. Matteson Div. agrees to maintain its M/WBE commitment of two percent that it made on the original contract. Therefore, Great Lakes Dredge & Dock, LLC - L.W. Matteson Div. remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company.
