L1LL1(o -'J�� TO CITY SECRETARY CONTRACT No. 44676 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 44676, (the CONTRACT) which was authorized by M&C #C-26358 on the 23rd day of July, 2013 in the amount of $ 422,850.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $143,200.00 which was authorized by M&C #C-26963 on September 9, 2014. WHEREAS, the CONTRACT involves engineering services for the following project: Caylor 5 Million Gallon Ground Storage Tank; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated November 13, 2015, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $34,400.00. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $600,450.00. Project Manager City of Fort Worth Water Department 1000 Throckrnorton Fort Worth, TX 76012 RE: City of Fort Worth- Caylor 5!I/MG Ground Storage Tank Project No. P265-607180211130/City Secretary Contract #44676 Amendment #2-Additional Services —Off-Site Water Line Design KHA No. 061018119 Dear Farida: As part of the off -site improvements for this project, it was recommended by the City that the existing water lines in Caylor Road be looped to existing cross streets. This change from the original design intent of the project required additional services that were not included as part of our Original Contract. This included water line design and construction phase services associated with these off - site improvements totaling 2,300 linear feet of 8-inch water line. In addition, as part of the Construction Phase Services associated with the Ground Storage Tank (GST), the City requested that Kimley-Horn perform a few additional tasks that were not specifically identified in the Original Contract. These services are further described below. Off -Site Water Line - Design, Bidding, and Construction Phase Services The original contract did not include services associated with preparing Construction documents for off -site water improvements. During preliminary design for the GST, the City decided that due to the proximity of proposed off -site improvements to the existing dead-end water lines that approximately 2,300 linear feet of 8-inch water line design would be added to the project. These water line improvements are along Caylor Road from Martinsburg Drive to the second bend in Caylor Road west of the tank site. Contract documents consisted of 6 total plan sheets (1 existing water system, 2 plan, 2 detail, and 1 paving extents sheets) and specifications. These services were performed in accordance with Tasks 3 (Preliminary Design) and 4 (Final Design) of the Attachment "A" Scope for Engineering Design Related Services for Water and/or Sanitary Sewer Improvements as located on the City's Buzzsaw site. Additional Bid Phase services were be performed to incorporate bidding the water improvements together with the GST plans and specifications as one project. These services required development of additional Division 01 General Requirements, Division 33 Specifications, as well as a Unit Price Bid Form for the water portion of the project. These services were performed in accordance with the terms described in Task 5 of the Original Contract. 801 Cherry Street, Unit 11, Suite 950, Ft. Worth, TX 76102 817 335 6511 Kimley»>Horn Mrs. Farida Goderya, P.E., November 13, 2015, Page 2 Additional Construction Phase Services will be performed associated with the water construction related to Site Visits, Clarifications, Shop Drawings, Final Walk Through, and Record Drawings in accordance with Task 6 — Construction Phase Services of the Original Contract. These services will include review of up to three (3) shop drawings, responses for up to one (1) Requests For Information (RFI), and up to one (1) site visit during construction. The additional amount requested for these services is $25,000. (SBE Fee: $0) Construction Phase Services — Additional Tasks Tank Foundation Pour Public Notice Coordination The original contract included services associated with two (2) public meetings, one during design and one during construction. During construction of the tank foundation, hot weather conditions required the concrete foundation of the GST to be performed beginning at 1:30 a.m. in the morning. Since this might be a disruption to the surrounding area, the City requested that Kimley-Horn prepare public notices, and prior to release, to review the notice with multiple staff members within the Water Department and Council District Member's office. This required additional coordination with the tank contractor to include specific information related to the schedule and sequence of the proposed construction activities including approval of concrete truck routes coming to and from the site. Tank Mixer Design During preliminary design of the GST, the City decided that it was preferred not to install a mixer within the GST. However, as part of approval for construction by TCEQ, the addition of a mixing system was necessary to satisfy their findings associated with the GST's operational parameters within the North Side 11 pressure plane. Kimley-Horn coordinated with TCEQ and provided back-up information related to the water system's operation to satisfy their requests. In addition, Kimley-Horn prepared revised construction plans and specifications for installation of the mixing system to obtain approval for construction of the GST by TCEQ. The additional amount requested for these services is $9,400. With this Amendment, our revised contract amount will be $600,450. Our total SBE participation percentage for the project is 23.64%.
