MEMORANDUM OF OIL AND GAS LEASE
STATE OF TEXAS
§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT
BE IT REMEMBERED that on the day of ,(_ ( , 2013, a Paid Up
Oil and Gas Lease was made and entered into by and between CITY OF FORT WORTH, a
home rule municipal corporation of the State of Texas, 000 Throckmorton Street, Fort
Worth, Texas 76102, hereinafter called "(LESSOR)"; and Burnett Oil Company, 801 Cherry
Street, Unit No. 9, Fort Worth Texas 76102, hereinafter called ("LESSEE"), where LESSOR
hereby grants, leases and lets exclusively to LESSEE for the purpose of exploring for,
developing, producing and marketing oil and gas, together with any liquid or gaseous substances
produced in association therewith, from the following described land situated in Tarrant County,
Texas, to -wit:
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF
Subject to the other provisions therein contained, said lease provides for a primary term
of two (2) years, from the date thereof, and as long thereafter as oil or gas or other substances
covered therein are produced in paying quantities from the leased premises or from lands pooled
therewith, or this lease is otherwise maintained in effect pursuant to the provisions therein.
An Executed copy of said Oil and Gas Lease is in the possession of LESSEE at its
address indicated above.

4.6539* acres of land, more or less, better described in the following seven (7) tracts:
Tract 1:
3.005 acres of land, more or less, a part of the Mary Johnson Survey, A-858, Tarrant County,
Texas, being all that certain 3.452 acre tract of land, more or less, a portion of Long Avenue,
containing 150,672 square feet of land and being more particularly described as Parcel No. 1, in
that certain Deed, dated April 24, 1968, from W. S. Dubose and Andrew N. Heinrichs to the City
of Fort Worth, a municipal corporation of Tarrant County, Texas, as recorded in Volume 4563
Page 337 of the Deed Records of Tarrant County, Texas; LESS AND EXCEPT 0.447 acres of
land, more or less, a part of the Mary Johnson Survey, A-858, Tarrant County, Texas, being all
that portion of Long Avenue and being more particularly described in Parcel No. 1, of 42,158
square feet more or less, in that certain deed dated April 24, 1968, from W. S. Dubose and
Andrew N. Heinrichs to the City of Fort Worth, as recorded in Volume 4563, Page 337 of the
Deed Records of Tarrant County, Texas, lying south of and adjacent to Lot 1 Block 2 of the
Long Industrial Addition as described in that certain Warranty Deed dated May 12, 1976, from
A. N. Heinrichs to Jesse P. Taylor and James C. Taylor, recorded in Volume 6015, Page 272 of
the Deed Records Tarrant County, Texas and being all that part of Long Avenue lying east of an
extension of the westerly boundary line of Lot 1 Block 2 as extended from the southwest corner
thereof across Long Avenue to Lot 1 Block 1 Long Industrial Addition as described in Volume
388-79, Page 27, Plat Records of Tarrant County, Texas.
Tract 2:
0.53670 acres of land, more or less, a part of the north J. C. McComas Survey, A-1047, Tarrant
County, Texas, being a portion of Sylvania Avenue, containing 23,378.99 square feet of land and
being more particularly described in that certain Deed, dated August 30, 1967, from Mobil Oil
Corporation to the City of Fort Worth, a municipal corporation of Tarrant County, Texas, as
recorded in Volume 4473 Page 236 of the Deed Records of Tarrant County, Texas.
Tract 3:
0.0062 acres of land, more or less, a part of the S. Gilmore Survey, A-590, Tarrant County,
Texas, being a portion of Sylvania Avenue, containing 269.5 square feet of land and being more
particularly described in that certain Quit -Claim Deed, dated January 18, 1967, from United
States Gypsum Company, a Delaware Corporation, to the City of Fort Worth, Texas, a municipal
corporation of Tarrant County, Texas, as recorded in Volume 4366 Page 13 of the Deed Records
of Tarrant County, Texas.
Tract 4:
0.0069 acres of land, more or less, a part of the S. Gilmore Survey, A-590, Tarrant County,
Texas, being a portion of Sylvania Avenue, containing 300.0 square feet of land and being more
particularly described in that certain Deed, dated November 1, 1966, from Richard T. Porter to
the City of Fort Worth, a municipal corporation of Tarrant County, Texas, as recorded in Volume
4327 Page 297 of the Deed Records of Tarrant County, Texas.
Tract 5:
0.0046 acres of land, more or less, a part of the S. Gilmore Survey, A-590, Tarrant County,
Texas, being a portion of Sylvania Avenue, containing 200.0 square feet of land and being more
particularly described in that certain Deed, dated December 1, 1966, from Neport Corporation, a
Texas corporation, acting herein by and through James H. Neece, its duly authorized Vice -
President, to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 4361 Page
23 of the Deed Records of Tarrant County, Texas.
Tract 6:
0.0095 acres of land, more or less, a part of the S. Gilmore Survey, A-590, Tarrant County,
Texas, being a portion of Sylvania Avenue, containing 408.0 square feet of land and being more
particularly described in that certain Deed, dated November 8, 1966, from Republic
Manufacturing Company, a Texas corporation, acting herein by and through James T. Young, its
duly authorized President, to the City of Fort Worth, a municipal corporation of Tarrant County,
Texas, as recorded in Volume 4327 Page 299 of the Deed Records of Tarrant County, Texas.
Tract 7:
0.010 acres of land, more or less, a part of the S. Gilmore Survey, A-590, Tarrant County, Texas,
being a portion of Sylvania Avenue, and being more particularly described in that certain Deed,
dated November 21, 1966, from Gilmer & Randle, a Texas corporation, acting herein by and
through Charles C. Gilmer, its duly authorized Vice -President, to the City of Fort Worth, a
municipal corporation of Tarrant County, Texas, as recorded in Volume 4327 Page 288 of the
Deed Records of Tarrant County, Texas.
*It is understood and agreed by the parties hereto that this lease covers 1.075 acres, more or less
and being any and all mineral interest owned by the Lessor under that part of Sylvania Avenue
out of the J. C. McComas Survey, A-1047 and the S. Gilmore Survey, A-590, Tarrant County,
Texas, between 33'd and 35th streets lying adjacent to Tract 2 of 0.53670 acres, more or less,
Tract 3 of 0.0062 acres, more or less, Tract 4 of 0.0069, more or less, Tract 5 of 0.0046 acres,
more or less, Tract 6 of 0.0095 acres, more or less and Tract 7 of 0.010 acres, more or less as
described herein this lease.
