u41TRACT NO. , This instrument (Release), made by the United States 0f America, acting by and through the
Manager, Airports Division, Southwest Region, Federal Aviation Administration ("FAA"), Department
of Transportation, under and pursuant to the powers and authority contained in 49 U.S.C.§47107, to the
City of Fort Worth, a body politic under the laws of the State of Texas.
WHEREAS, the Federal government has provided funding for airport improvements at Fort
Worth Spinks Airport, which is identified on the FAA approved Airport Layout Plan (ALP) or Exhibit
"A" dated April 29, 2008.
WHEREAS, all Airport property identified on the FAA approved ALP is subject to the terms,
and conditions of the Airport Improvement Project (AIP) Grant Agreements.
WHEREAS, the City acquired without federal participation 0.024 acres of land on April, 1986,
for airport purposes and included it on the Airport Layout Plan ("ALP") as property obligated under AIP
Grant Agreements.
WHEREAS, the City seeks to release said 6.915 acres of Airport property from AIP grant
obligations in order to pay off airport revenue bond debts incurred as a result of airport improvements
marie by tha City at the Airport; and
WHEREAS, the said 6.915 acres of land requested to be released is located in Tarrant County,
Texas, and is more particularly described as follows:

BEGINNING at a 2-1/2 inch metal fence post found for the southwest corner of said 180.109 acre tract
of land, said 2-1/2 inch metal fence post being the southeast corner of a 10.31 acre tract of land (by deed)
deeded to Ron Sturgeon Real Estate, L.P. as recorded in Volume 3658, Page 614 of said Deed Records of
Johnson County, Texas, said 2-1/2 inch metal fence post being the northwest corner of a 13.542 acre tract
of land (by deed) deeded to Universal Forest Products Texas Limited Partnership as recorded in Volume
3849, Page 463 of said Deed Records of Johnson County, Texas, said 2-1/2 inch metal fence post also
being an exterior ell corner in the proposed west right-of-way line of Stone Road (a variable width right-

WHEREAS, the City has requested the FAA to release the said 6.915 acres from the conditions,
restrictions, and obligations set forth in existing AIP Grant Agreements; and
WHEREAS, the Manager of the FAA Airports Division, Southwest Region, has determined that

b) That the Grantee, expressly agrees for itself, its successors and assigns to restrict the
height of structures, objects of natural growth and other obstructions on the real property
described hereinabove to a height of not exceeding the elevation established by the
Airport zoning ordinance; and
c) That the Grantee expressly agrees for itself, its successors and assigns to prevent any use
of the real property described hereinabove which would interfere with landing or taking
off of aircraft at the Fort Worth Spinks Airport, or which would otherwise constitute
an airport hazard.
hereby releases the said 6.915 acres of land described hereinabove from the conditions, restrictions, and
obligations contained in any AIP grant agreements existing between the FAA and the City at the Airport.
By its acceptance of this Release, the City of Fort Worth, Texas covenants and agrees for itself, its
successors and assigns, to comply with and observe all of the conditions and limitations hereof.
