DISCUSSION: The North Texas High Impact Drug Trafficking Area (HIDTA) aims to reduce the availability of illicit drugs and drug related violence by attacking, disrupting, dismantling, and destroying drug trafficking organizations. They do this by arresting and convicting principals, seizing their contraband and assets, and reducing the demand for drugs in the region. The assets encompass the seizure and forfeiture of assets that are proceeds of or used to facilitate crimes. By removing the proceeds of crime and other assets relied upon by criminals and their associates to perpetuate their criminal activity, asset forfeiture has the power to disrupt or dismantle criminal organizations that would continue to function if only specific individuals are convicted and incarcerated. The investigating agency, usually a branch of the Department of Justice, determines the allocation of funds forfeited through the criminal proceedings. After disbursing the amounts out to the federal agency, the remaining funds are given to HIDTA to be disbursed to the participating local municipalities as agreed upon in the Anticipated Equitable Sharing Agreement and the Application for Transfer of Federally Forfeited Property. These documents specify how each law enforcement agency was involved in the operation and the allocation is based on that participation. Funds in the HIDTA Asset Forfeiture Fund can only be used by the Fort Worth Police Department(FWPD) to purchase items which are permissible under the U.S. Department of Justice Guide to Equitable Sharing for State and Local Law Enforcement Agencies (April 2009). For Fiscal Year 2013, the Police Department estimates using $1.7M of these funds to cover permissible law enforcement expenditures, which include but are not limited to: Fitness testing equipment for the FWPD Training Academy facility; Matching funds for various FWPD grants; Tasers and other weapons; Classified services/petty cash funds (informant/buy money); Electronic surveillance equipment; On-Officer video cameras; Law enforcement-related software; and Officer safety equipment.
