BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $142,343.00, from available funds, for the purpose of pavement reconstruction and water main replacement on Penland Street, Wade Avenue to Noble Avenue and Wade Avenue,Airport Expressway to Penland Street. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the rernaindi-ig portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 204 1 1-09-20 1 2 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer in the amount of$142,343.00 from the Water and Sewer Fund to the Water Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$142,343.00; and 3. Authorize the execution of a contract with McClendon Construction Co., Inc., in the amount of $371,060.17 for pavement reconstruction and water main replacement for the streets listed below. DISCUSSION: As part of the 2008 Capital Improvements Program, the following neighborhood streets will be reconstructed. Contract 8D, Council District 8 ;STREETS.._ !LIMITS� (Penland Street Wade Avenue to Noble Avenue Wade Avenue Airport Expressway � .. _.. p to Penland Street In addition to pavement reconstruction, deteriorated water lines are to be replaced as specified by the Water Department. The contract was advertised for bids on February 7, 2013 and February 14, 2013 in the Fort Worth Star— Telegram. On April 4, 2013 the following bids were received. BIDDERS AMOUNT . .. .. In addition $74,561.86 will be utilized for contingencies and construction services including surveying, material testing and construction inspection. M/WBE Office: McClendon Construction Co., Inc., is in compliance with the City's BDE Ordinance by committing to six percent MBE participation and documenting good faith effort on this combined project. The City's MBE goal on this project is 15 percent. Funds from the Street Improvements 2008 Fund have previously been appropriated. This project is located in COUNCIL DISTRICT 8, Mapsco 63V.
