INTERLOCAL COOPERATION AGREEMENT
This Amendment is entered into by and beiween t12e City of Fort Worth (hereafter
"City"), a home rule municipal corporation organized under the laws of the State of Texas, wi.th
its principal place of business at 1000 Throckmorton Street, �'ort Worth, Texas, and Tarrant
County, acting on behalf of the Tarrant County- Medical Examiner's O�fice, hereinafter
"County„
W�IEREAS, City and County entered into an Interlocal Agreement for Forensic
Laboratory Services identified as Fort Vi��orth City Contract No. 44614 ("Agreement") for a
period of one year beginning October 1, 2012, vvhich automaticallq renews frozxi year to }�ear
subject to appropriations of City funds for this Agreement; and
WI�REAS, City- and CountS° entered ixzto the F'rrst Amendment to the Agreement,
which increased the overall contracted an:�.ount payable to County b5� City for ser�-ices pro�ided
under the Agreement;
WHEREAS, City and County entered into the Second Amendment to the Agreement,
which renewed t1�e term of the Agreement and incorporated an agreed upon fee schedule;
WHEREAS, it is the collective desire of both City arzd County to renevv the tezxn of the
Agreenaent and amend the Agreement for Forensic Laboratory Serc�ices bs• increasing the overall
contracted amount tl�at ma}- be paid b� City to County for services under this Agreement; and
NOW, THEREFORE, Cit�• and County, acting herezxz by the through theix duly
autho�zzed representatives, hereby amend the Agreement:
1.
Deleting the current text of Section 3"Pa}nnent fox Sezwices" as amended by t1�.e Fu•st
Amendment to the Agreement and replacing it wxth the follo�vving:
Upon completion of the work by County, City will pay Couniy ua accordance with the
appro�e•ed agreed upon fee schedule fox t.�e Services. The agreed upon fee schedule (Effective
October 1, 2014 through September 30, 2016) is attached and incorporated within as Exhibit A.
Payment will be made by City to County within thirty (30) days of receipt of County's invoices.
Each invoice shall be accompanied by suf�czen.t documentatio� as z�equired by City. Howe�c-er,

total payments by City during the tertn oi this Agreement shall not exceed $350,000.00 (tl�ree
hundred and �ifty thousand dollars). Cit}• shall be solely- responsible for rnonitoring payments
under this Agreenaent, and the not-to exceed amount shall not relie��e City of its obligation to pa�•
County %r Sezvices rendered at City's request. County s1aa11 provide at least thirty (30) days
advance written notice of a.ny changes in the fee schedule for any of the Services performed
unde�r this Agreeznent. Any change to the fee schedule, if approved by the Cit3-, will be
incorpprated within this Agxeement as a replacement to Exhibit A, Any changes in t�.e fee
schedule that require arz increase in the not-to exceed axx�ount of funding for this Agreement shall
be approyed by wxitten amendment to this Agreement bS both the Ciry and County.
2.
Section 4, Term. The te�-m of the Agreement is hereby renewed. The current term will
expixe on September 30, 2016, unless terniinated earlier in accordamce with the Agreement.
3.
.A11 other provisions of the Agreement which are not express�y� amended hereax� shall
rez�ain in full foxce and effect.

RECOMMENDATION;
It is recamrriended that the City Council authorize th� execution of Amendment No. 3 ta City Secretary
Contract No. 446�4 with Terrant County for farertsic laboratory services to increase the contract
au#hority in the arnount of $150,000.00 for a total contract amount of $350,�OQ.QO.
DISCUSSION:
On April 2, 20'i3, the City Counci( au#horized (M&C C-26186} the execution of a one year Interlocal
Agreement (Agreement) with Tarrant County for forensic laboraiory services in the amount of
$5Q,000.40. The Agreement inciudes options ta renew for subsequent years of service.
On November 19, 2013, the City Council authorized (M&C C-26566) the execuiion of Amendmen# No,
1 to Cify Secretary Contract No. 446��, which increased the tdtal contract amount to $150,000.00.
Amendment No. 2 to Ciiy Secretary Contract No. 446'f4, which was administratively authorized,
renewad the term of the Agreement and incorporated a new fee schedule.
Staff recammends amending City Secretary Contract No. 44614 #o increase the contract authority
under the Agreemeni in the amount of $�50,000.00 for a tota! coniract amount of $350,000.00. The
increase in confract authority will fulfill two important objectives. First, the increased authority will
compensate Tarrant County for processing the backlog of cases needing forensic analysis. Second,
the increased authority wil( address the City's growing need far additional forensic laboratory
services. Historica[ly, the City utilized Celimark Forensics for DNA analysis. Cellmark Forensics
recentiy relocated to Virginia. The Gity's continued use of Cellmark Fprensics wouid likely result in
additiona) court and trave) relafed costs.
Staff recommends using 7arrant Caunty to perform the qNA analysis previously performed by Cellmark
Forensics and al[owing Cellmark Forensics ta contir►ue working on specialized cald cases. If the
contract authority is increased, funds currently allocated to Cellmark Forensics for DNA analysis will be
used #o compensate Tarrant Counfy for #he additianal services.
Pursuant to Article 49.25 of the Texas Code of Criminal Procedure, a medical examiner may charge
reasonable fees for its services,
M/WBE OFFICE - A waiver of the goal for MgE/SBE subcon#racfiing requirements was requested by
the Police Departm�nt and approved by the M/WBE Office, in accardance with the BDE Qrdinance,
because the purchase of goods and services is from sources where subcontracting or supplier
opportunities are negligible.

ADMINISTRATIVE CHANG� ORDER - An Administrative Change Order or increase may be made by
the Ci#y Manager in th� amount of up to $50,000.00 and does not require specific City Council approval
as fong as sufficient funds have been appropriated.
FISCAI� 1NFORMATION/C��LTIF'fCATION:
The Financia) Management Services Director certifies that furtds are available in the current operating
budget of the i'olice Department in the General Fund and that prior to an expenditure being made, the
Police Department is responsible for verifying the availability of funds.
