AMENDMENT No . 3
TO CITY SECRETARY CONTRACT No . 49500
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols,
Inc. , (ENGINEER) made and entered into City Secretary Contract: No. 49500 ,
(the CONTRACT) which was authorized by M&C C-28317 on the 1st day of
August, 2017 in the amount of $1 ,809,500 . 00; and
WHEREAS , the CONTRACT was subsequently revised by Amendment No. 1
in the amount of $738,000 . 00 authorized by M&C 20-0464 on June 23, 2017
and Amendment No.2 in the amount. of. $99,500 . 00 administratively
authorized on September 29, 2021 ; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Village Creek Water Reclamation Facility Thickening Improvements;
and
WHEREAS , it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE , CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:
1 .
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $99, 427. 00.
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $2, 7461,427. 00.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Amendment No. 3
The scope set forth herein defines the work to be performed by the ENGINEER. Both the
CITY and ENGINEER have attempted to clearly define the work to be performed to address
the needs of the CITY.
DESCRIPTION OF SERVICES
Additional design and construction related efforts were required during construction of the
Village Creek WRF Thickening Modifications project. This amendment outlines the
additional efforts for each task.
WORK TO BE PERFORMED
Task 1. RTU-19 Demolition Design
Task 2. Additional I&C Construction Services Effort
Task 3. Odor Control Bridge Foundation Redesign
Task 4. WAS Tank Blower Pad Redesign
Task 5. Blend Tank Rehabilitation
Task 6. Blend Tank Bypass Valve Vault Design
TASK 1. RTU-19 Demolition Design
1.1. RTU-19 Demolition. The Contractor mistakenly demolished RTU-19 inside the
Thickening Building. As a result, additional electrical and I&C design effort was
required to restore the lost signals. Contract modifications were issued in Field Order
No. 7 for restoration of the signals.
A proposal from Signature Automation is attached for their design efforts.
TASK 2. Additional I&C Construction Services Effort
2.1 Our subconsultant, Signature Automation has expended effort beyond their scope in
construction phase services for review of Submittals, RFIs, Field Orders, and CMRs
and is requesting additional fee as outlined in the attached proposal.
TASK 3. Odor Control Bridge Foundation Redesign
3.1 The Contractor encountered a conflict between existing underground electrical and
communication utilities at the designed location of the odor control duct bridge. A
redesign of the bridge spread footing was required to accommodate a beam
supported by piers to span across the utilities, along with relocation of a sludge line.
Proposed modifications were issued in PCM-009.
A proposal from CH2M HILL Engineers is attached for their support in the redesign
efforts.

TASK 4. WAS Tank Blower Pad Redesign
4.1 The Contractor encountered a conflict between an existing underground electrical
duct bank and the WAS Tank blower pad. A redesign of the pad was required to
provide grade beams spanning across the electrical duct bank. Proposed
modifications were issued in PCM-011.
A proposal from JQ Infrastructure is attached for their support in the redesign efforts.
TASK 5. Blend Tank Rehabilitation
5.1 The Contract required for replacement of the Blend Tank annular seal that was
leaking. Once the Blend Tank cover was removed from the tank, and the insulation
was removed from the top of the cover, severe corrosion was observed throughout
the underside of the cover and portions on top of the cover. To rehabilitate the cover,
removal and replacement of structural members throughout the cover is required.
Due to the severity of corrosion at the cover connections where sludge was being
introduced into the tank, the connections were moved from the cover to the sidewall
of the tank to minimize future corrosion of the cover. The concrete walls of the Blend
Tank that are exposed to gases are beginning to corrode and have visible exposed
aggregate. As a result, the sidewalls of the tank will receive a protective concrete
coating. Proposed rehabilitation modifications of the Blend Tank were issued in
PCM-012. Proposed modifications to the Blend Tank cover were issued in PCM-018.
TASK 6. Blend Tank Bypass Valve Vault Design
6.1 Plant staff requested a valve vault be installed at the Blend Tank bypass wet well for
ease of access and maintenance of the valves during future bypass operations of the
tank. Proposed modifications were issued in PCM-020.
A proposal from JQ Infrastructure is attached for their support in the design efforts.

Improvements and Adopt the Attached Appropriation Ordinance to Effect a Portion of Water's Contribution
to the Fiscal Years 2022-2026 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1.Authorize the execution of Amendment No. 3 to City Secretary Contract No. 49500, an Engineering
Agreement with Freese & Nichols, Inc., in the amount of$99,427.00 for the Village Creek Water
Reclamation Facility Sludge Thickening Improvements for a revised contract amount of
$2,746,427.00; and
2.Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the
Water& Sewer Bond 2017A Fund by decreasing estimated receipts and appropriations in the
Unspecified—All Funds project (City Project No. UNSPEC) in the amount of$119,427.00 and
increasing estimated receipts and appropriations in the Village Creek Water Reclamation
Facility Thickener Process Improvements project (City Project No. CO2647) by the same amount to
effect a portion of Water's contribution to the Fiscal Years 2022-2026 Capital Improvement
Program.
DISCUSSION:
On August 25, 2015, Mayor and Council Communication (M&C C-27433), the City Council authorized an
engineering agreement with Freese & Nichols, Inc. (City Secretary Contract No. 47018) , in the amount of
$295,113.00, for study, evaluation and conceptual design of thickening processes at Village Creek Water
Reclamation Facility (VCWRF). On August 1, 2017 (M&C C-28317), the City Council authorized an
engineering agreement with Freese & Nichols, Inc., (City Secretary Contract No. (CSC 49500), in the
amount of$1,809,500.00 for VCWRF Sludge Thickening Improvements.
The agreement for CSC 49500, was subsequently revised by Amendment No. 1, in the amount of
$738,000.00 (M&C 20-0464, June 23, 2020)that provided for construction administration services and
Amendment No. 2, in the amount of$99,500.00 administratively authorized on September 29, 2021, that
provided for excessive solids-related operational recommendations.
This Amendment No. 3 provides additional services that include Remote Terminal Unit-19 design,
instrument and controls construction services, odor control bridge foundation redesign, waste activated
sludge tank blower pad redesign, blend tank cover structural rehabilitation and bypass valve vault design.
In addition to the amendment amount, $20,000.00 is necessary for additional project management.

The Director of Finance certifies that funds are currently available in the Unspecified—All Funds project
within the Water& Sewer Bond 2017A Fund and upon approval of the above recommendations and
adoption of the attached appropriation ordinance, funds will be available in the Water& Sewer Bond
2017A Fund for the VCWRF Thickener Process Improv project to support the approval of the above
recommendations and execution of the amendment to agreement and contract. Prior to an expenditure
being incurred, the Water Department has the responsibility of verifying the availability of funds.
