OF THIS ORDINANCE WITH THE COUNTY CLERK OF TARRANT COUNTY, TEXAS; DECLAR-
ING THAT THIS ORDINANCE AND ALL SUBSEQUENT PROCEEDINGS RELATING TO SAID
STREET IMPROVEMENT ARE AND SHALL BE PURSUANT TO THE ACT OF THE FIRST CALLED
SESSION OF THE FORTIETH LEGISLATURE OF THE STATE OF TEXAS, CHAPTER 106;
COMMONLY KNOWN AS ARTICLE 1105b OF VERNON'S TEXAS CIVIL STATUTES AS AMENDED
BY ACTS 1967, 60TH LEGISLATURE, PAGE 365, CHAPTER 176, SECTION 1, EMERGENCY
EFFECTIVE MAY 12, 1967; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND EN-
ROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOKS OF
THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE
ORDINANCE RECORDS OF THIS CITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Public Works Director for the City of Fort Worth, Texas, has prepared
Plans and Specifications for the improvements of the hereinafter described portions
of streets, avenues and public places in the City of Fort Worth, Texas, and same
having been examined by the City Council of the City of Fort Worth, Texas, and found
to be in all matters and things proper, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:

the Acts of the First Called Session o�f the Fortieth Legislature of the State of
Texas, now known as Article 11051) of Vernon's Texas Civil Statutes, as amended,

said Act having been passed in the 'year 1930, and now known as Article 1270a of

ASSESSMENT PAVING ON WEST PETER SMITH STREET, PROJECT NO. '104-35000-361
On Monday, December 30, 1974, a Neighborhood Meeting was conducted by
Engineering Division of the Public Works Department for the', Asa&sam,"',nt Pa%v-
ing on Peter Smith Street.
Mr. Albert J. Hopkins, owner of Lot B, Block 30, Edward Heirs Additl,ni, ,;',as
the only property owner present.
Mr. Schmidt explained to him the procedures concerning proposed improveizten.tri'
owner participation in costs, and methods of payment.
Mr. Schmidt also explained the guidelines of State Statute 11055 as
to assessments and enhancement of abutting properties and that in this, case
an Independent Land Appraiser would be retained to appraise the adj�icant
properties in order to determine the enhancement of propertIes as a result
of the street improvement.
Mr. Hopkins said that he was not objecting to the improvements but that c1le
cost was too high. He said he felt that Holiday Lincoln Mercury would. -,
benefited far more than he.
After a short general discussion the meeting was adjourned.

Initiation of Proj'ect
In August, 1969, the City Wa�.e'r DepartfllkwnL requested West Peter Smith Street
be opened across the LeW,7ee and Frisco tracks to give access from 15th Avenue
to Forest Park Bouievard. Prelisininary, plans were prepared and presented to
farrant County Water ContruL taud LDprovement District No. 1, the U. S. Army
Corps of Engineers, and the RaiLroad Company. Strong opposition was encountered
from each of the above and Tio agreemerit was reached as to grades across the
levee.
By letter addressed to the M8yor and Council oo, 0(,',tober 6, 1972, Holiday
Lincoln Mercury, Inc. , reque,s,�ted West Pet ez STnf-Lh Street be extended across
tine levee to Forest Park Ba.)Lllevr,n.'d to facAlitate access to their property east
of the levee. The Ho.liday Lirico.ln Mercury property east of the levee consists
of an entire block bouaided by West Peter Su aith, 15th Avenue, West Broadway
and the levee, which has receotly 1veeo developed.
As a result of the above refer'enced request , renewed efforts were initiated
by the Public Works Department, with the Water Control Board, Corps of Engineers
and the Frisco Railroad Company to rearzh an ag,reei'oent as to the street crossing
over the levee and raLiroad ttacks. Plans have been approved and agreements
reached 'with the above agencies a,ind other City Japartments.

This section of West i?et.er Mn-Lth Tgiil be impruved with industrial grade concrete
pavement with superimposed ciirbc:; and concretle driveway approaches. Also
included are required storm drain facilitier, to serve the immediate areas east
and west of the levee of the Clear Fork of Che Trinity River.
Railroad Agreement.
It will be necessary for the (A.ty to enter in.to an agreement with the St. Louis
Saari. Francisco Railway Company for improvements to the railroad crossing. It is
proposed that:

track and spur line.

the crossing location. Estimated City cost is $20,000.
ca) The Railroad Company agree to adjust the grade of its spur track
to meet the grade of West Peter Smith Street, the cost of which

$4,000.

and use of properties is mixed, plus the grade differential of the proposed
street relativ°ee to the adjacent," proper,°ty. Consequently, an independent land
appraiser has been retained to appraise the adjacent properties as to enhance-
ment resultini from the proposed strect improvement. Results of the appraisal
will be presented at the Benefa.,t Hearing.
Project Cost and Finanw,in&
:Based on. the low bid and standard policy, approximately $11,807.71 will be
assessed against abutting property, owniea:°s, whiff°:'h will be provided for by a
Bond Fund Transfer from the iZunrilving Fund Unspecified. Cost to the City for
construction, engineering, admini,.iL -ion and miscellaneous costs is approxi-
mately $96,394. Estimated right--of-way cost is $9,900. The estimated cost to
the City for installing k,.he ,raai..lroad crossing protection devices is $20,000,
plus $4,000 for adjusting the spur track, making the total project cost to the
City $130,294, to be provided, for by a hood fund transfer from the appropriate
unspecified account.

2) The City Manager be authorized to execute the proposed agreement
with the St. Louis-San Francisco Railway Company;

a) Declaring the necessity for and ordering the improvements;
b) Making provisions for levying of assessments;
c) Directing the Public Works Director to prepare estimates of
costs and amounts to be assessed,,
d) Awarding the contract to Texas Bitulithic Company, in the
amount of $91,372.85; and
e) Making appropriations to cover indebtedness thereby incurred
for improvements of the project named above.
4) An ordinance be adopted:
a) Approving the estimates of costs and amounts proposed to be
assessed; and
