AN ORDINANCE VACATING, ABANDONING AND CLOSING THE
PUBLIC EASEMENTS, STREETS, ALLEYS, PUBLIC THOROUGH-
FARES, AND RIGHTS-OF-WAY LYING WITHIN PARTS OF THE B.B.B.
AND C. RAILROAD COMPANY SURVEY, ABSTRACT NO. 126, AND THE
WILLIAM J. MORGAN SURVEY, ABSTRACT NO. 1092, SITUATED IN
THE SOUTHWEST PART OF FORT WORTH, IN TARRANT COUNTY,
TEXAS; PROVIDING FOR THE REVERSION OF THE FEE IN SAID
LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE
IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the public easements, streets, alleys, public thorough-
fares, and rights-of-way lying in, through, upon, across and with-
in the hereinafter described property:
Parts of the B.B.B. & C. Railroad Company Survey,
Abstract No. 216 and the William J. Morgan Survey,
Abstract No. 1092, situated in the southwest part
of Fort Worth in Tarrant County, Texas;
BEGINNING at a 3/4" iron for the northwest corner of
Lot 12 in Block 51 Of WESTCLIFF, as said lot appears
upon the map recorded on Vol. 388-Q, Page 475 of the
Tarrant County Deed Records and being in the east
line of Lot 7 in said Block 51 and being 46-5/10 feet
from its northeast corner.
THENCE along the east line of Lots 7, 6, 5, 4, 3, 2,
and 1 in said Block 51: north 9 degrees 36 minutes
west 223-7/10 feet to a 5/8" iron for the common east
corner of said Lots 6 and 5; north 11 degrees 13 minutes
west 505-9/10 feet to a stake at the common east corner
of said Lots 3 and 2; and north 10 degrees 01 minutes
west 296-6/10 feet to a stake for the northeast corner
of said Lot I in the south line of Altura Road_
THENCE north 69 degrees 20 minutes east, along said
south line of Altura Road, 17 feet to its southeast
corner.
THENCE north 20 degrees 40 minutes west, along the east
line of Altura Road, 50 feet to a stake for the southeast
corner of Lot 1 in Block 74 of WESTCLIFF.
THENCE along the east line of Lots 1 through 4 and
6, 7, 9 and 10 in said Block 74: north 3 degrees
26 minutes west 250-4/10 feet to a stake for the
common east corner of Lots 2 and 3; north 8 degrees
35 minutes east 137-7/10 feet to a stake for the
common east corner of Lots 3 and 4; north 7 degrees
34 minutes east 135-6/10 feet to a 5/8" iron for the
common east corner of Lots 4 and 6; north 21 degrees
30 minutes east 228-7/10 feet to a 1" iron for the
common east corner of Lots 6 and 7; north 49 degrees
37 minutes west 402-3/10 feet to a stake for the
southeast corner of Lot 10; and then north 7 degrees
48 minutes east 152-6/10 feet to a 3/4" iron for the
northeast corner of said Lot 10 and being the southeast
corner of Sarita Drive.
THENCE north no degrees 34 minutes west, along the east
line of Sarita Drive, 60 feet to a 3/4" iron for its
northeast corner.
THENCE north 9 degrees 32 minutes west 15-2/10 feet to
a 3/4" iron in a north line of said B.B.B. & C. Railroad
Company Survey and the south line of the J. Howard Survey,
Abstract No. 805.
THENCE north 89 degrees 26 minutes east, along said survey
line, 352-8/10 feet to a 3/4" iron for the northwest corner
of Overton Park East as said street appears upon the map
recorded in Vol. 388-17, Page 337 of said Deed Records_
THENCE along the westerly line of said Overton Park East:
south 45 degrees 44 minutes east 279-6/10 feet to a 3/4"
iron in asphalt at the beginning of a curve to the right
with a radius of 261-6/10 feet; and then along said curve
to the right a distance of 97-8/10 feet to a 3/4" iron at
its end; south 24 degrees 19 minutes east 325-3/10 feet
to a 5/8" iron at the beginning of a curve to the right
with a radius of 648-93/100 feet; and then along said
curve to the right a distance of 143-7/10 feet to a 3/4"
iron at its end; south 11 degrees 37 minutes east 106-4/10
feet to a 1" iron at the beginning of a curve to the right
with a radius of 1304-87/100 feet; and then along said
curve to the right a distance of 117-7/10 feet to a 1"

THENCE along the northerly lines of said Lot 14: north
57 degrees 32 minutes west 31-6/10 feet to a stake; north
74 degrees 05 minutes west 213 feet to stake for the
northerly corner of said Lot 14; and south 40 degrees
50 minutes west 100 feet to a 3/4" iron for the northwesterly
corner of said Lot 14.

THENCE south 23 degrees 36 minutes east along the
westerly line of said Lot 14, a distance of 383-5/10 feet
to a 3/4" iron for the southwesterly corner of said Lot
14 and the northwesterly corner of Lot 15 in said Block
44 for the northeasterly corner of the 1-436/1000 acres
tract described in the deed to Robert Emil Bunata recorded
in Vol. 5697, Page 122, of said Deed Records.
THENCE south 75 degrees 50 minutes west, along the northerly
line of said Bunata tract, 243-8/10 feet to a 3/4" iron for
the northwesterly corner of said tract„
THENCE along the west line of said Bunata tract: south 3
degrees east 41-9/10 feet to a 1" iron at the beginning of
a curve to the left with a radius of 1156-38/100 feet; and
then along said curve to the left a distance of 50 feet to
a 3/4" iron for the northerly southwest corner of said
Bunata tract_
THENCE along the southwesterly line of said Bunata tract:
south 83 degrees 39 minutes east 50'5/10 feet to a 3/4"
iron; south 51 degrees 28 minutes east 56-4/10 feet to a
3/4" iron; south 33 degrees 57 minutes east 124-7/10 feet
to a stake for the southerly corner of said Bunata tract
and the northwesterly corner of Lot 10 in Block 45 of
WESTCLIFF.
THENCE along the westerly line of Lots 10 through 16 and
part of Lot 17: south 19 degrees 50 minutes east 206 feet
to a stake; south 40 degrees 40 minutes east 206 feet to a
stake for the common west corner of Lots 13 and 14; south
no degrees 29 minutes west 112-5/10 feet to a stake for
the common west corner of Lots 15 and 16; south 2 degrees
04 minutes west 81-4/10 feet to a 3/4" iron for the common
west corner of Lots 16 and 17; and south 6 degrees 36 minutes
east along the west line of said Lot 17 a distance of 96-9/10

THENCE north 86 degrees 29 minutes west, along the north line
of said Lot 22-R, a distance of 139-4/10 feet to a 5/8" iron
for its northwest corner.
THENCE north 87 degrees 58 minutes west 50-1/10 feet to a
stake for the northeast corner of said Lot 12 in Block 51
of WESTCLIFF.
THENCE north 89 degrees 14 minutes west, along the north
line of said Lot 12, a distance of 212-9/10 feet to the
PLACE OF BEGINNING and containing 23-61/100 acres, of
which 15-51/100 acres are within said B.B.B. & C. Railroad
Company Survey and 8-1/10 acres are within said William J.
Morgan Survey.

be and the same are hereby closed, abandoned and permanently
vacated as easements, streets, alleys, public thoroughfares
and rights-of-way of any kind or character whatever.
SECTION 2.
That the fee to the land in the above described public
easements, streets, alleys, public thoroughfares and rights-
of-way located in the hereinabove described real property are
hereby released and will revert to the adjacent owners as
provided by law, save and except that easements are reserved
for any and all existing utilities.
SECTION 3.
All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

Clinton D. Wright Realtors Inc., acting by and through Clinton D. Wright,
its duly authorized President, the developer of Blocks 44, 44A, 45, 51 and
74, Westcliff Addition, has proposed a contract for the installation of
community facilities to serve the area shown on the attached maps.
The estimated cost of the community facilities is as follows:

Street paving with curb and gutter, storm drainage, street lighting, water
facilities and sanitary sewers will be installed in accordance with standard
policies for the installation of community facilities. The contract includes
City participation in the cost of water, sewer, streets and storm drains. In
order to provide for the City's share of the cost of these facilities, bond
fund transfers will be made in a future M&C.
Water and Sewer
The proposed City's share of the cost of water and sewer facilities is con-
siderably higher than the projected 20 percent which is normal. Two items
contributed to this higher City participation; (1) The City has planned for
some time to connect through this area a 20-inch water main which will boost
the water supply and pressure for the entire area; and (2) there is a bad
sewer condition which needs to be corrected by relocating and altering the
existing main. Both of these items should be accomplished whether or not
the land is developed. The financial participation proposed in this section
of the community facilities contract is felt to be equitable to both the
City and the developer.

Park Land
Proposed in this development is the dedication of 2.2 acres of land for park
purposes, located at the south end of the existing park system between Over-
ton Park East and Overton Park West and at the northwest end of Foster Park.
This proposed park links Overton Park with Foster Park. There is presently
a bicycle trail along Overton Park East on private property.
The proposed park and median improvement in the contract involves the devel-
oper (1) dedicating the park land, (2) building a bicycle trail between
Overton Park East and Inwood Road, (3) providing erosion control in the park
adjacent to Lots 1-3 Block 44A, (4) providing water taps in the median of
Inwood Road, (5) providing suitable top soil for the median, and (6) pro-
viding plant material, trees and shrubs for the median in Inwood Road. The
City's responsibility will be the provision of labor to plant the median in
Inwood Road as well as long-term maintenance of the median and park. Further
development of the park land will be at the City's discretion as needed to
properly tie Overton Park with Foster Park.
Vacation of Existing Roads and Easements
Totally within this proposed development are two paved east-west roads
(Altura Drive) and a-north-south road (Inwood Road) and drainage facilities
that were never dedicated, but are open and in use by the public.— With the
Planning Commission's approval of the preliminary plan and the arrangements
for community facilities, the non-dedicated roads and drainage easements
need to be officially vacated and an ordinance written to that effect. The
subject streets and easements to be vacated are shown on the attached map
(V-76-10).
Streets: Overton Park West Extension to Inwood Road
Included in this proposed contract is the construction of Inwood Road from
the existing Inwood Road near South Drive to Overton Park West. A distance
of 215 feet of said street and a culvert are north of and off the developer's
property. Right-of-way will have to be acquired and assessment paving pro-
ceedings initiated by the City. The developer has made contact with the
property owner to try to acquire this property, but has not been successful
in negotiating a purchase. The proposed street is directly adjacent to an
existing City park; therefore, the only assessment will be on the west side
of the street.
This development includes all of the remaining land in this part of Westcliff
and Overton Park Additions that has not been previously developed except for
the triangular piece of property to the north of Sarita Drive across which
Overton Park West (street) needs to be extended, to complete the street sys-
tem for this entire neighborhood.

Council Determination of Policy
Construction of an off-site culvert is proposed and is expected to cost
approximately $35,000. The developer has been asked to bear 50 percent of
the cost of the culvert, approximately $17,500. In the process of Planning
Commission and departmental review of this proposed development, a section
of street and the need for a second culvert was eliminated. In consideration
of the change in traffic flow that is likely to result from the elimination
of the street section, the developer was asked to participate in the cost of
construction of the off-site culvert.
Current policy is silent on the question of developer participation in the
cost of culvert facilities not in the site to be developed but which are
useful to that site. It is the opinion of staff that the construction of
this culvert is not absolutely necessary in order for this property to be
developed. However, without the culvert, optimum traffic circulation and
the most efficient subdivision design cannot be realized. Further, if this
culvert is not built, an alternate culvert will have to be constructed
(entirely at the developer's expense) in a different location to facilitate
a reasonable traffic flow pattern. Therefore, it seems advantageous to
both the developer and the entire area surrounding the proposed development
that the culvert be constructed as proposed with the cost being shared
equally by the City and the developer. The City Council's determination
regarding the amount of developer participation in the off-site culvert
costs is requested.
Recommendations
Based on the above decision, the following action is recommended;
1. It is recommended that an ordinance be adopted vacating subject
right-of-way of the existing non-dedicated streets known as Inwood
Road and Altura Drive and the drainage easements within the devel-
opment area; and
2. That the City Manager be authorized to reimburse the developer for
the cost of streets and storm drain facilities upon satisfactory
completion of said facilities; and
3. That the City Manager be authorized to execute the community facil-
ities contract with the developer, Clinton D. Wright, President of
Clinton D. Wright Realtors, Inc.
