WHEREAS, by sundry proceedings heretofore passed by the City Council of the city of Fort Wouh, Texas, including Crdinance No. ".59/42 1., a portion of the cost of said improvements was leyied and assessed against Q-T-spective properties abutting an each of the above described portions of streets, avenues and public places and against the zeal and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, It is desirahle and neLessary to grant and issue certain credits against"., saue one or more of the assessments levied by Ordinance Mo. 59 fl and, WHEREAS, the Street improvements hereinabove mentioned have been completed upon each of the portions of stroats, avenues and public places hereinabove described, and have been USPOCLed and found to be In complete accordance with the contract therefor; NCU, TREREFORE, HE 11 ORDAINSD BY THE CITY COUNCIL OF THE CT7Y OF FORT WORTH, TEXAS, The improvements on each of the portLons of streets, avenues and public places bereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. III, The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed La attest same and impress thereon the corporate seal of n e the City, all in accordac with the proceedings relating to such improvements and assessments. The certificates shill be numbered, shall describe the property against whicb the assessment has been levied, shall, where known, sCate the name or names of the true owners of the respective parcels of pro- perty assessed and shah be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The atmbers of the certificates, with the property descriptions to be shown on the respective Artificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any, which are hereby authorized, granted and allowed against the principal amaunt of some one or more of the assessments heretofore levied, and the pxincipal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows-. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the, appropriate Ordinance Records of said City. V. Project RescEi2t ion Name: Assessment Paving at 11 Locations on the North Side, Project No. 104-24000-177 Contractor: Texas Bitulithic Company Contract Awarded- March 18, 1968 (M&C C-1191). Units 3, 4, 5 and 11 were deleted following the public hearing on April 22, 1968 (M&C C-1224 and Ordinance No. 5942). Work Order Issued: April 5, 1968 - Storm Drain only. May 15, 1968 - Units 6, 7, 8 and 9 (these units complete prior to Work Order for Units 1 and 10). July 25, 1968 - Units 1 and 10 August 22, 1968 - Unit 2 Work Order Effective: April 15, 1968 (Storm Drain only). May 25, 1968 - Units 6, 7, 8 and 9 August 4, 1968 - Units I and 10 September 1, 1968 - Unit 2 Date of Final Inspection and Approval: February 26, 1969 Working Time Bid: 130 Working Days Working Time Charged: 163 Working Days Supplemental Information on Contract Time After completion of the project a review of the time charges was made by the Public Works staff. Four units of the project were deleted but this did not reduce the contract Lime. The work orders on the remaining seven (7) units were issued as individual units with the exception of one work order for four units. As prescribed in the contract and specifications documents, when a work order is issued for a group of less than three (3) units, the working days for each unit are doubled. On July 25, 1968, the Contractor was issued a work order for Northwest 16th Street and Gilmore Street. After starting excavation on these two units gas and water facilities were encountered which required further utility adjustment. The adjustment of the utilities was not completed until September 6, 1968. From July 26 to September 6, 1968, 29 days were shown on the time statements as working days when they should have been shown as "Delays due to utility adjustment." Again on September 23 and 30 and October 2 and 21, the Contractor experienced a delay due to utility adjustments on Northwest 16th and Gilmore Streets. Since the Contractor experienced undue delay beyond his control which resulted in several move-in and move-out operations, the Public Works Department recommends that no liquidated damages be charged on this project. Deviations from Bid Price: An under-run of $3,334.92 occurred due to minor variations between quantities estimated in the contract specifications and quanitities actually measured and used at the job site. Compliance with Specifications During testing on this project 29 corings were made with the following results: Exceeds Even with Under Specs but Below Specs Specs within Tolerance Tolerance Paving 23 6 0 0 Sub-grade 18 11 0 0 On the entire project, the average thickness of the pavement is 6.33 inches as compared to the 6 inches specified, and the average thickness of the sub- grade is 4.05 inches as compared to the 4 inches specified. Tests made during the construction of subgrade and pavement show that materials used were in compliance with contract specifications. Recommendations It is recommended that the above project be accepted by the adoption of an ordinance and that final payment of $9,497.97 be authorized to Texas Bitulithic Company.
