ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF I",)R= 1,',OAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY UP FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH TE,',r"; BITULIT7111C FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FffLT"­CMLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED A(;AiNs,ir SOME or SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APFRO- PRIATE ORDINANCE RECORDS OF SAID CIII; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. (,)0()'( a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues -and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6007' , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the'true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The Cite Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the, appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description Name: Assessment Paving on Isbell Road and Ohio Garden Road from White Settlement Road to Jacksboro Highway Contractor: Texas Bitulithic Company Contract Awarded: September 4, 1968 (M&C C-1297) Work Order Issued: November 5, 1968 (Partial Work Order for Culverts & Storm Drains Only) February 11, 1969 (Full Work Order) Work Order Effective: November 15, 1968 Final Inspection and Approval: April 17, 1970 Time Bid: 180 Working Days Time Used: 207 Working Days Supplemental Information During the period November 5, 1968 to February 11, 1969, when the full work order was issued, the contractor had been charged for 46 working days and had completed about $60,000 in construction. The contractor was limited as to the amount of work accomplished during this period because the partial work order authorized such work as pertained to culverts and drainage only. In consideration of this limitation, a re-evaluation of contract time charges resulted in the assessment of liquidated damages for 9 days instead of the 27 days originally charged. Recommendation It is recommended that the pro,ect described above be accepted as complete by the adoption of an ordinance and that final payment of $47 ,353.84 be authorized to Texas Bitulithic Company.
