AN ORDINANCE AMENDING SECTION 415, SECTION
1002 (b) (1) , SEC°PION 1507, AND SECTION 1509 OF EX-
HIBIT "A" OF THE MECHANICAL CODE OF THE CITY OF FORT
WORTH, BY ADDING A DEFINITION FOR A MACHINERY ROOM
TO SECTION 415, BY REQUIRIN(.3 'ITIAT AN APPROVED REIN-
FORCED VAPOR BARRIER HAVE A PERM RATING OF NOT
GREATER THAN 0.3 PERMS, AS DETERMINED BY ASTM E96,
PROCEDURE A IN SECTIOp."7 1002(b) (1) , BY ADDING A RE-
QUIREMENT FOR A FIRE RESISTIVE SEPARATION IN ANY
ROOM OR SPACE CONTAINING A FUEL-FIRED APPLIANCE TO
SECTION 1507, AND BY OMITTING THE WORD "ELECTRICAL"
AT THE BEGINNING OF' THE SECOND PARAGRAPH OF SECTION
1509; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULA-
TIVE OF ALL OTHER ORDINANCES OR PROVISIONS OF THE
MECHANICAL CODE OF THE CITY OF FORT WORTH;REPEALING
ALL ORDINANCES OR PROVISIONS OT.,' THE MECHANICAL CODE
OF THE CITY OF FORT WORT11 IN CONFLICT HEREWITH; PRO-
VIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENAL CLAUSE; DIRECTING PUBLICA-
TION; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Section 415 - "Machinery Room" - of Chapter 4 - "Defini-
tions and Abbreviations" - of Exhibit "A", attached to and incor-
porated by reference in the Mechanical Code of the City of Fort
Worth (Ordinance No. 7634 duly adopted by the Fort Worth City
Council on April 12, 1977) , be and the same is hereby amended to
read as follows:
"Section 415
"MACHINERY ROOM, Is a room or space housing
Group 1 Refrigeration equipment totaling 100 horse-
power or more and all Group 2 Refrigeration equip-
ment regardless of capacity. This room or space
shall have a minimuit of one hour fire-resistive con-
struction with all interior openings protected and
all doors self closing."
SECTION 2.
That Subparagraph (b) - "Noni�'tetallic" - of Section 1002 -
"Material" - of Chapter 10 - "D�.tcts" - of Exhibit "A", attached to
and incorporated by reference in the Mechanical Code of the City of
Fort worth (Ordinance No. 7634 duly adopted by the Fort Worth City
Council on April 12, 1977) , be and the same is hereby amended to
read as follows:
"Section 1002. (b)
,,Nonmetallic. iqonmetallic dr,,ict systems shall
be approved Tar the use intelided or shall conform to
the requirements (-.)f the U.M.C. Standard No. 10-1.
Each portion of a Non me tall.i c duct system shall be
identified by a label or other suitable identifica-
tion.
"Nonmetallic fiberglass d u(:,:t systems shall
conform to the followia,jq:
"l. Shall be a Class 1 Air Duct in accordance
with U.L. 181 Test, as required by NFPA-90A. Facing
material for round fiberglass ducts and duct board
shall have a perm rating of not greater than 0.05
perms. Insu.,Lation material for insulated flexible
duct shall be sheathed with an approved reinforced
vapor barrier having a perm rating of not greater
than 0.3 perms, as determined by ASTM-E96, Procedure
A.
"Shall have a thermal conductivity (C) at 75 0 F
of not greater than .24. C=Btu/hr, sq. ft. deg. F.
(ASTM C 177-71 test) .
"Shall not be installed where they will be ex-
posed to the weather. "
SEC',TION 3.
That the following subparagraphs of Section 1507 - "Machinery
Rooms" - and Section 1509 "Equipment In a Machinery Room" — of
Chapter 15 - "Mechanical Refrigeration Equipment" - of Exhibit "A",
attached to and incorporated by reference in the Mechanical Code of
the City of Fort Worth (Ordinance No. 7634 duly adopted by the Fort
Worth City Council on April 12, 1977) be and they are hereby amended
to read as follows:
"MACHINERY ROOMS
SECTION 1507. Every nrachinery room containing
any Group 1 refrigeration equipment shall have a one
hour fire-resistive separation from any room or
space containing ii fuel-fired appliance. This
machinery room shall have at least one means of
exit. Such exit opening shall be not less than 3
feet by 6 feet 8 inches.
"EQUIPMENT IN A MACHINERY ROOM
SECTION 1509. Equipment or electrical control
or control panel other than listed below shall not
be located in any machinery room:
1. Lights and receptacles.
2. machinery room exhaust fans and f:)lowers.
3. Any refrigerating condensing unit or portion
thereof.
4. Circulating pumps for condensers, cooling
towers, or cooling coils.
S. Air compressors servirig only automatic con-
trols within the refrigerating or cooling sys-
tem.
6. Electrically operated valves for the control of
a refrigerant (,,)r for the control of the circu-
lation of a cooling fluid.
7. Blowers an(J fans for cooling towers or for con-
densers.
8. Any electric control or control j-ranel for any
of the above items.
9. Equij.,�megt operating with a heating surface be-
low 800°F„”
SECTION 4.
That this ordinance shall be cumulative of the provisions of
the mechanical Code of the City of Fort Worth, except where the
provisions of this ordinance are in direct 000fI±^ t with the pro-
visions of such Code, in which event conflicting provisions of such
Code are hereby repealed.
SECTION x'
That all zigbt�s or remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of the provisions
of the Mechanical Code of the City of Fort xmztb, which have accrued
at the time of the effective dote of this ordinance; and as to such
accrued violations and all pending litigation, both civil and crim-
inal, whether pending in court or not, under such chapter or other
ordinances, same shall not be affected by this ordinance but may be
gzoneootcd until final disposition by the courts.

That it is hereby declared to be the intention of the City
Council of the City of Fort Worth, Texas, that the sections, para-
graphs, sentences, clauses and phrases of this ordinance are sever-
able and if any section, paragraph, sentence, clause or phrase of
this ordinance ahoII be declared void, ineffective or unconstitu-
tional by the valid judgment or final decree of a court of compe-
tent jurisdiction, such voidness, ineffectiveness or unconstitu-
tionality obulI not affect any of the remaining sections, para-
graphs, sentences, clauses or phrases of this ordinance since the
same would have been enacted by the City Council without the incor-
poration herein of any such void, ineffective or unconstitutional
section, paragraph, sentence, clause or pbz:ae.
SECTION 7,
That any person violating any of the provisions of this or-
dinance shall be deemed guilty of o misdemeanor and each such per-
son shall be deemed guilty of u separate offense for each day or
portion thereof during which any violation of any of the provisions
of this ordinance is committed, continued wr permitted and each
violation shall be punishable by a fine not to exceed Two Hundred
Dollars <$300.00> .
SECTION W.
That the city Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption, penalty clause and effec-
tive date of this ordinance for five (5) days in the official news-
paper of the city of Fort Worth, Texas.
SECTION 9.
That this ordinance shall be in full force and effect from and
after the date of its passage avid publication as required by law and
it is so ordained.

The current Mechanical Code, Ordinance No. 7634, which became effective
January 1, 1978, has a requirement for a vapor barrier on alt ASLIaLion for
cooling and heating ducL systems. 'rho three' major manufacturers of insulated
flexible duct, after a retest of char products, have found it to be in
violation of our Code requirement of 0.1 perm on the vapor barrier. These three
manufacturers, through TIMA (Thermal Insulation Manufacturers Association), madc-,
a request to the Mechanical Board of Appeals for a Code change. This would be to
change the vapor barrier perm rating from 0.1 perm to 0.3 perm for insulated
flexible duct. The Board was assured that all three of the manufacturers
represented could meet this requirement. The amendment will read as follows:
First paragraph of Section 1002(b)(1):
"Shall be a Class I air duct in accordance With UL181 Lost, as required by
NFTA-90A. Facing material for round fiberglass ducts and duct board shall
have a perm rating of not greater than 0.05 perms. Facing material for
insulated flexible duct shall be sheathed with a glass net reinforced vapor
barrier having a perm rating of not greater than 0.3 perms, as determined
by ASTM E96, Procedure A."
The current. Mechanical Code is vague on the description of a Machinery Room and
the equipment allowed inside such room. To accomplish the intent of the Code and
for clarification to those needing this information, an amendment is proposed to
Chapter Four defining a Machinery Room, and "viAiq SecKon K07 by adding
Fire-resistive Sepayarion between a MwAincry Poom and any room or space
containing a fuel-fired appliance.
The Mechanical Board of Appeals recommends a Code change to agre-c with the
request. This will be more compatible with GSA, HUD, and FHA requirements and
remove an existing obstacle to Fort Worth building dcvelnpmcnt.
A public hearing on the proposed Amendment was held on August 23, 1978. Notice
of the hearing was published in the local newspaper and notices also were sent
to fifteen interested local organizationn, No one appeared in opposition to the
amendment,
Recommendation
It is recommen4gdohat the Mechanical Code be amended:
1. To change vapor barrier per rating of 0.1 perm. to 0.3 perm as noted above;
2. To include a definition of Machinery Room in Chapter Four; and
