HomeMy WebLinkAboutOrdinance 7913 AN ORDINANCE VACATING, ABANDONING AND CLOSING A 10 FOOT BY 36 FOOT UTILITY EASEMENT LOCATED IN BLOCK 1, HIGHLAND PARK TOWNHOMES SUBDIVISION, RECORDED IN VOLUME 388-118, PAGE 84, PLAT RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 10 foot by 36 foot utility easement located in Block 1, Highland Park Townhomes Subdivision, recorded in Volume 388-118, Page 84, of the Plat Records of Tarrant County, Texas, and being more particularly described as follows : BEGINNING at the southwest corner of said easement, said point being in the north line of a 10 foot wide utility easement running along the north line of Byers Avenue, and said point being 202.9 feet South 89 degrees, 25 minutes, 08 seconds East and 10,0 feet north from the southwest corner of said Block 1; THENCE North 36.0 feet to the northwest corner of said easement; THENCE South 89 degrees , 25 minutes, 08 seconds East and parallel with the north line of said Byers Avenue, 10. 0 feet to the northeast corner of said easement; THENCE South 36.0 feet to the southeast corner of said easement in said north line of 10 foot wide easement along the north line of Byers Avenue; THENCE North 89 degrees , 25 minutes, 08 seconds West with the south line of said 10 foot by 36 foot easement and the north line of said 10 foot wide easement along Byers Avenue, 10. 0 feet to the PLACE OF BEGINNING be and the same is hereby vacated, abandoned and permanently closed as utility easement. SECTION 2. That the fee to the land in said utility easement is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained.
