AN ORDINANCE PROVIDING FOR THE SUBMIS"SION TO
THE QUALIFIED ELECTORS WHO OWN TAXABLE PROP-
ERTY IN THE CITY OF FORT WORTH, TEXAS, AND
WHO HAVE DULY RENDERED THE SAME FOR TAXATION,
AND TO ALL OTHER RESIDENT QUALIFIED ELECTORS
OF' SAID CITY, OF PROPOSITIONS FOR THE ISSU-
ANCE OF NEGOTIABLE COUPON BONDS OF SAID CITY
IN THE AGGREGATE SUM OF THIRTY-EIGHT MILLION,
EIGHT HUNDRED THOUSAND DOLLARS ($38;800,000.00)
FOR THE PURPOSE; OF MAKING PERMANENT CITY IM-
PROVEMENTS BY CONSTRUCTING, IMPROVING AND EX-
TENDING THE STREETS; THOROUGHFARES AND STORM
DRAINS OF SAID CITY AND ACQUIRING THE NECESSARY
LANDS THEREFOR; FOR THE PURPOSE OF MAKING PERMA-
NT,NT CITY IMPROVEMENTS BY CONSTRUCTING, BUILDING
AND EQUIPPING CITY FIRE STATIONS AND TRAINING
FACILITIES, IMPROVING AND EXTENDING THE CITY
FIRE ALARM SYSTEM AND ACQUIRING THE NECESSARY
LANDS THEREFOR; FOR THE PURPOSE OF MAKING PERMA-
NENT CITY IMPROVEMENTS BY PURCHASING, ACQUIRING,
CONSTRUCTING, RECONSTRUCTING AND IMPROVING THE
PLAYGROUNDS, RECREATION PARKS AND RECREATION AND
PARK FACILITIES OF SAID CITY AND ACQUIRING THE
NECESSARY LANDS THEREFOR; FOR THE PURPOSE OF MAK-
ING PERMANENT CITY IMPROVEMENTS BY ESTABLISHING,
DEVELOPING„ CONSTRUCTING, ENLARGING,. IMPROVING
AND EQUIPPING ITS AIRPORTS AND AIR NAVIGATION
FACILITIES, INCLUDING BUILDINGS AND OTHER FACILI-
TIES INCIDENT TO THE OPERATION THEREOF AND THE
ACQUISITION OR ELIMINATION OF AIRPORT HAZARDS,
AND ACQUIRING THE NECESSARY LANDS THEREFOR; AND
FOR THE PURPOSE OF MAKING PERMANENT CITY IMPROVE-
MENTS BY IMPROVING, EXTENDING AND ENLARGING THE
SANITARY SEWER SYSTEM AND SEWAGE DISPOSAL PLANTS
OF SAID CITY AND ACQUIRING THE NECESSARY .LANDS
THEREFOR, SAID BONDS TO BE ISSUED AT ONE TIME OR
IN INSTALLMENTS FROM TIME TO TIME AS THE CITY
COUNCIL SHALL DETERMINE, THE BONDS OF EACH TN-
STALLMENI' BEING PAYABLE SERIALLY AS MAY BE DE-
TERMINED BY THE CITY COUNCIL, SO THAT THE LAST
MATURING BONDS SHALL BECOME PAYABLE WITHIN FORTY
(40) YEARS FROM THE DATE THEREOF, AND BEARING IN-
TEREST AT A RATE NOT TO EXCEED THE MAXIMUM PRE-
SCRIBED BY LAW AT THE TIME OF THE ISSUANCE THEREOF,
PAYABLE SEMT-ANNUALLY; PROVIDING THAT SAID ELEC-
TION BE FIELD IN CERTAIN PLACES AND APPOIN'T'ING
PP.ESIDING JUDGES FOR EACH PRECINCT; PROVIDING
FOR ABSENTEE VOTING; PROVIDING FOR THE USE OF
VOTING MACHINES AND PRESCRIBING OFFICIAL BALLOTS
THEREFOR; ORDERING AND DIRECTING THE CITY SECRE-
TARY TO PREPARE AND ISSUE OFFICIAL .BALLOTS FOR
ABSENTEE VOTING AND OFFICIAL 'BALLOTS FOR VOTING
MACHINES; AUTHORIZING THE CITY COUNCIL TO ISSUE
TAX-SUPPORTED BONDS IN SUCH DENOMINATIONS AS IT
MAY DETERMINE AND REQUIRING THAT SAME MATURE
WI'T'HIN FORTY (40) YEARS FROM THE DATE THEREOF
AT RATES NOT TO EXCEED THE MAXIMUM PRESCRIBED BY
LAW AT THE TIME OF THE ISSUANCE THEREOF, PAYABLE
SEMI-ANNUALLY, EXPRESSED IN COUPON NOTES ATTACHED
TO THE BONDS; LEVYING A SUFFICIENT TAX TO PAY THE
INTEREST THEREON AT THE MATURITY THEREOF; AND
CALLING A SPECIAL ELECTION TO BE HELD IN THE
CITY OF FORT WORTH, TEXAS, ON TUESDAY„ THE 8TH
DAY OF SEPTEMBER, A,, D. 1970.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That a special election be held in the City of Fort
Worth, Texas, on Tuesday, the 8th day of September, A. D.
1970, at the polling places hereinafter described, between
the hours of 7:00 A. M. and 7:00 P. M. , at which election
the following propositions for the issuance of bonds of the
City of Fort: Worth, Texas, each and all of which proposi-
tions contain a purpose clause which has been found and de-
termined by the City Council to be a permanent public improve-
ment and for a legitimate municipal purposes shall be sub-
mitted to the qualified electors who own taxable property
in said City and who have duly rendered the same for taxa-
tion, as well as to all other resident, qualified electors
of said City:
PROPOSITIONS
I
Shall the City of .Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Twenty-three Million One Hundred Thousand Dollars

($23, 100, 000.00) for the purpose of making permanent city
improvements by constructing, improving and extending the
streets, thoroughfares and storm drains of said City, in-
cluding in such permanent public improvements the straight-
ening, widening, paving, grade separation, lighting and
drainage of said streets and thoroughfares, and acquiring
the necessary lands therefor, said bonds bung payable
serially as may be determined by the City Council, so that
the last maturing bonds shall become payable within forty
(40) years from the date thereof, bearing interest at a
rate not to exceed the maximum prescribed by law at the
time of the issuance thereof, payable semi-annually, and
levy a sufficient tax to pay the interest on said bonds and
create a sinking fund sufficient to redeem said bonds at the
maturity thereof?
IIa
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Seven Hundred and Fifty Thousand Dollars ($750,000.00)
for the purpose of making permanent city improvements by
constructing, building and equipping city fire stations and
training facilities, improving and extending the city fire
alarm system and acquiring the necessary lands therefor,
said bonds being payable serially as may be determined by
the City Council, so that the last maturing bonds shall be-
come payable within forty (40) years from the date thereof,
bearing interest at a rate not to exceed the maximum prescribed
by law at the time of the issuance thereof, payable semi-

annually, and levy a sufficient tax to pay the interest on
said bonds and create a sinking fund sufficient to redeem
said bonds at the maturity thereof?
III
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Three Million, Four Hundred and Fifty Thousand Dollars
($3,450,000.00) for the purpose of making permanent city im-
provements by purchasing, acquiring, constructing, recon-
structing and improving the playgrounds, recreation parks
and recreation and park facilities of said City and acquiring
the necessary lands therefor, said bonds being payable
serially as may be determined by the City Council; so that
the last maturing bonds shall become payable within forty
(40) years from the date thereof, bearing interest at a rate
not to exceed the maximum prescribed by law at the time of
the issuance thereof, payable semi-annually, and levy a suf-
ficient tax to pay the interest on said bonds and create a
sinking fund sufficient to redeem said bonds at the maturity
thereof"?
Iv.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Two Million Dollars ($2,000,000.00) for the purpose
of making permanent city improvements by establishing, de-
veloping, constructing, enlarging, improving and equipping
its airports and air navigation facilities, including
buildings and other facilities incident to the operation

thereof and the acquisition or elimi:.ation of airport hazards,
and acquirinq the necessary lands therefor,, said bonds be-,
ing payable serially as may be date-L,,Aned by the City Coun-
cil, so that the last maturing bonds shall become payable
within forty (40") years from the date thereof. bearing in-
terest at a rate not to exceed the maximum prescribed by
law at the time of the :issuance thereof, payable semi-
annually, and 'levy a sufficient tax to pay the interest on
said bonds and create a sinking fund sufficient to redeem
said bonds at the maturity thereof?
V.
Shall the City of Fort Worth, Texas, through its City
Council, issue its negotiable coupon bonds in the principal
sum of Nine Million, Five Hundred Thousand Dollars ($9,-
500, 000.00) for the purpose of making permanent city im-
provements by improving, extending and enlarging the sani-
tary sewer system and sewage disposal plants of said City
and acquiring the necessary lands therefor, said bonds being
payable serially as may be determined by the City Council,
so that the last maturing bonds shall. 'become payable within
forty (40) years from the date thei:eof, bearing interest at
a rate not to exceed the maximum prescribed by law at the
time of the issuance thereof, payable semi--annually, and levy
a sufficient tax to pay the interest on said bonds and create
a sinking fund sufficient to redeem said bonds at the ma-
turity thereof?

SECTION 3.
That said election shall be held and conducted, in
effect, as two separate but simultan.u,z>cus elections, to wit:
One election at which only t1he resident, qualified electors
who own taxable property in the City and who have duly
rendered the same for taxation shall be entitled to vote
on said propositions, and another election at which all
other, resident:, qualified c:.ectors of the C:Lty shall be en-
titled to vote on said propositions, The votes cast at each
of said separate but simultaneous elections shall be recorded,
returned and canvassed separately, it is hereby declared
that the purpose of holding the election in such manner is
to ascertain arithmetically:
(a) The aggregate votes c-,st_ at the elec-
tion for and against said propositions by resi-
dent, qualified electors of the City, nd also
(b) The aggregate votes cast at the elec-
L:i.on for and against said propositions by resi-
dent, qualified electors who own Laxab!_e prop-
erty in the City and who have duly rendered the
same for taxation.
Each elector shall be entitled to vote once on each of the
propositions in accordance with the foregoing provisions
of this ordinance.
SECTION 4.
That absentee voting shall be on l.)aper ballots, and
such ballots shall conform to the requirements of Article
6.06 of the Election Code of the State of Texas, as amended,

which provides that a square shall be placed beside each
proposition, in which the voter is requested to place an
"X" or other clear mark to indicate the way he wishes to
vote, but which also provides that failure of a voter to
mark his ballot in strict conformity with the instructions
on the ballot shall not invalidate the ballot, and the bal-
lot shall be counted if the intention of the voter is clear-
ly ascertainable, except where the law expressly prohibits
the counting of the ballot. It is specifically provided
that the election officers shall not refuse to count a bal-
lot because of the voter's having marked his ballot by
scratching out the statement or proposition for which he
does not wish to vote.
The ballot shall be substantially as follows:

SECTION, 5.
That voting machines, by the Comrriissioriers '
Court of Tarrant County, Texas, shaLl be used at the bond
election on the 8th day of September, A. D. 1970, in strict
compliance with the applicable provlsic^.s of Article 7.14
of the Election Code of the State of Texas, as amended, and
other applicable provisions of such Election Code.
SECTION 6.
That the official balll_ts to be vied in voting ma-
chines shall be in compliance wi-th the applicable provisions
of Article 7.14 of the Election Code of the State of Texas
and shall have written or printed thereon the following.-

FOR Shall the City of Fort Worth, Texas, through
its City Council, issue its negotiable coupon
AGAINST bonds in the principal sum of Three Million
Four Hundred and Fifty Thousand Dollars ($3,-
450,000.00) for the purpose of making permanent
city improvements by purchasing, acquiring,
constructing, reconstructing and improving
the playgrounds, recreation parks and recrea-
tion and park facilities of said City and
acquiring the necessary lands therefor, said
bonds being payable serially as may be de-
termined by the City Council, so that the last
maturing bonds shall become payable within
forty (40) years from the date thereof, bear-
ing interest at a rate not to exceed the maxi-
mum prescribed by law at the time of the is-
suance thereof, payable semi-annually, and
levy a sufficient tax to pay the interest on
said bonds and create a sinking fund sufficient
to redeem said bonds at the maturity thereof?

permanent city improvements by establishing,
developing, constructing, enlarging, improving
and equipping its airports and air navigation
facilities, including buildings and other fa-
cilities incident to the operation thereof
and the acquisition or e-I 'mination of airport
hazards, and acquiring the necessary lands
therefor, said bonds being payable serially
as may be determined by the City Council, so
that the last maturing bonds shall become pay-
able within forty (40) years from the date
thereof, bearing interest at a rate not to ex-
ceed the maximum prescribed by law at the
time of the issuance thereof, payable semi-
annually, and levy a sufficient tax to pay
the interest on said bonds and create a sinking
fund sufficient to redeem said bonds at the
maturity thereof?
PROPOSITION NO. 5.
FOR Shall the City of Fort Worth, Texas, through
its City Council, issue its negotiable coupon
AGAINST bonds in the principal sum of Nine Million,
Five Hundred Thousand Dollars ($9,500, 000.00)
for the purpose of making permanent city im-
provements by improving, extending and en-
larging the sanitary sewer system and sewage
disposal plants of said City and acquiring
the necessary lands therefor, said bonds be-
ing payable serially as may be determined by
the City Council, so that the last maturing
bonds shall become payable within forty (40)
years from the date thereof, bearing interest
at a rate not to exceed the maximum prescribed
by law at the time of the issuance thereof,
payable semi-annually, and levy a sufficient
tax to pay the interest on said bonds and
create a sinking fund sufficient to redeem
said bonds at the maturity thereof?
SECTION 7.
That the City Secretary is hereby ordered and directed
to prepare and issue ballots for absentee voting and for
voting machines and to stamp same "Official Ballot, " on
which ballots shall be printed the proj,.)ositions hereinabove
set forth.

SECTION 8,
That in the event the tax-supported bonds are au-
thorized at the special election hereby ordered, the City
Council of the City of Fort Worth, Texas, may issue for sale
any part or portion of said amounts at such time and times
as in the judgment of the City Council it determines that a
lawful interest and sinking fund may be provided for to take
care of and discharge any part or portion of the bonds so
issued for sale, it being the purpose of this section to make
clear that the City Council of the City of Fort Worth, Texas,
may not be required to issue the full amount of the series
of the bonds as herein submitted but may issue for sale any
portion of the same at such time and times as it determines
advisable, under the authority hereby conferred after said
election.
SECTION 9.
That all of the bonds herein authorized to be issued
by the electorate shall be in such denominations as may
be determined by the City Council and shall mature serially
in the regular order in which they are numbered, making
the last bonds mature within forty (40) years from the date
thereof, unless the City Council, in the exercise of its dis-
cretion shall otherwise provide for such maturity, and said
bonds shall be sold at not less than par and shall bear in-
terest at rates per annum not to exceed the rates prescribed
by law at the time of their issuance, and shall be payable
semi-annually.

SECTION 10.
That the City Secretary shall. furnish election officials,
said ballots and voting machines, together with any other
forms, blanks or instructions in accordance with the Charter
of the City of Fort Worth, Texas, and the laws of the State
of Texas insofar as same are applicable, and the provisions
of this ordinance.
SECTION 11.
That the way and manner of holding this election, the
notice to be given therefor, the polling places, the per-
sonnel of the officers, precinct judges and substitutes
therefor who are to hold the same, and all details connected
with the holding of the election shall be determined and ar-
ranged by the City Council and administered under the direction
of and by the City Secretary.
SECTION 12.
That this ordinance shall constitute the election
order for such special. election, a substantial copy of
which shall serve as the notice of election under Article
704 of the Revised Civil Statutes of the State of Texas.
SECTION 13.
That the City Secretary is hereby authorized and
directed to cause notice of said election to be given by
posting a substantial copy of this election order in each
of the election precincts of said City and also at the City
Hall. That this notice of said election shall also be pub-
lished on the same day in each of two (2) successive weeks
in a newspaper of general circulation published within said

City, the date of the first publication to be not less than
fourteen (14) days prior to the date set for said election,
and the City Secretary shall see that proper publication
is made and proper notice of this election is given, in full
conformity with the Charter of the City of Fort Worth, Texas,
and the applicable statutes of the State of Texas.
SECTION 14.
That Lhis ordinance, election order and notice shall
take effect and be in full force and effect from and after
the date of its passage, and it is so ordained.
