ORDINANCE NO. 25618-08-2022 AN ORDINANCE VACATING, ABANDONING AND EXTINGUISHING PORTIONS OF REVELLE ROAD AND WIND STAR WAY, SITUATED RESPECTIVELY IN THE B.B.B. & C. RR. CO. SURVEY, ABSTRACT NO. 219 AND THE ABRAHAM STALLIONS SURVEY, ABTRACT NO. 1396 AMBER TRAILS ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN CABINET A, SLIDES 9606 AND 9143, PLAT RECORDS, TARRANT COUNTY, TEXAS, AND COLLECTIVELY CONTAINING APPROXIMATELY 1,454 SQUARE FEET OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. 1. That a portion of Wind Star Way, a fifty-foot-wide public right-of-way situated in the B.B.B. & C. RR. Survey, Abstract No.219, located in the Amber Trails Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Cabinet A, Page 9146, Plat Records, Tarrant County, Texas, and containing approximately 779 square feet or 0.018 acres of land, and as more specifically described in Exhibits "A", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. 2. That a portion of Wind Star Way situated in the B.B.B. & C. RR. Co. Survey, Abstract No. 219, located in the Amber Trails Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Cabinet A, Slide 9606, Plat Records, Tarrant County, Texas, and containing approximately 225 square feet or 0.005 acres of land, and as more specifically described in VA-21-019 Wind Star Way&Revelle Road Ordinance No.25618-08-2022 Page 1 of 3 Exhibits "B", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. 3. That a portion of Wind Star Way, a fifty foot right-of-way, situated in the Abraham Stallion Survey, Abstract No. 1396, located in the Amber Trails Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Cabinet A, Slide 9146, Plat Records, Tarrant County, Texas, and containing approximately 225 square feet or 0.005 acres of land, and as more specifically described in Exhibits "C", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. 4. That a portion of Revelle Road, a fifty foot wide right-of-way, situated in the Abraham Stallions Survey, Abstract No. 1396, located in the Amber Trails Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Cabinet A, Slide 9606, Plat Records, Tarrant County, Texas, and containing approximately 225 square feet or 0.005 acres of land, and as more specifically described in Exhibits "D", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. SECTION 2. That the easements to the land in the above-described vacated public alley rights of way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. DISCUSSION: Baird, Hampton and Brown on behalf of Covenant Classical School,has requested vacation of these remnant rights-of-way to be replatted with the adjoining property for cleanup of the existing private school campus.The City Plan Commission recommended approval of this request at its meeting on January 12,2022.An acceptable final plat(FS-22-151)has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007, Mayor and Council Communication (M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of- way easement for the streets. This project is located in COUNCIL DISTRICT 3. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
