UNIT 3: VACI.K STREET' Froni Cullen Street to Shamrock Aveniic­-�, known and designated as Project No. 104- 24000-185, Unit- 3. WHEREAS, by sundry proceedings heretofore passed by the City Council of the 47'ity of Fort Worth, Texas, including Ordinance No. L31�L,_, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council, of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial Justice and equality, it is desirable an(l necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. .. 6314 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in ccniiplete accordance with the contract therefor; NOW, THEREFORE, BE I T ORDAINED BY THEE CITY COUNCIL OF THE GITY OF FORT WORTH, TEXAS, THAT- The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance- with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall. describe the property againat which the assessment has been levied, shall, where known, state the n'ame or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount: equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with tt�e property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any,, are ho�reby enumerated and itemized as follows. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City, V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. After issuance of the first partial work order, as utilities were cleared, additional partial work orders were issued to allow the contractor to continue work. Deviation from Bid Price: The final cost of this project is $1,832.63 less than the adjusted bid price. This cost difference is attributed to minor variations between quantities estimated in the contract documents and quantities actually measured and used at the job site. DATE REFERENCE SUSJECT Kift4l Payment - Assessment PAGE NUMBER Paving at Various Locations in 2 f 3/8/71 FP-792 Bailey's Industrial Addition Compliance with _Sp�eL ications During testing on this project 65 corings were made with the following results: Exceeds Even with Under Specs But Below Specs Specs Within Tolerance Tolerance Paving 45 13 5 2 Sub-grade 29 36 0 0 On the entire project the average thickness of the reinforced concrete paving is 6.24 inches as compared to the 6.00 inches specified, and the average thickness of the lime stabilized sub-grade is 6.09 inches as compared to the 6.00 inches specified. Tests made during construction show that materials used were in compliance with contract specifications. As noted under, "Project Cost and Financing" the contractor has paid a $56.95 penalty for the deficient paving thickness shown by these two corings. Recommendations It is recommended that the project 'described above be accepted by the adoption of an ordinance and that final payment of $18,215.95 be authorized to J. L.
