VEHICLE LEASE AGREEMENT—RESERVES WHEREAS, since 1988,Bruce Lowrie Chevrolet has supported the Fort Worth Police Department with the donation of a leased vehicle to support the Mounted Patrol Unit at the annual cost of One Dollar; WHEREAS, Bruce Lowrie Chevrolet wants to expand their support to the Fort Worth Police Department Reserve Unit with the donation of a second leased vehicle at the annual cost of One Dollar; NOW THEREFORE, the parties agree as follows: 1. Bruce Lowrie Chevrolet shall provide a to the City of Fort Worth Police Depart . 2. In return,the City of Fort Worth Police Department shall pay an annual lease payment of One Dollar. 3. The lease term will commence upon the delivery of the lease vehicle to the City and will extend for 365 days thereafter. This agreement will renew automatically upon its expiration unless written notice of termination is given to the other party as provided herein. 4. The use of the above mentioned vehicle will be for the primary use of the Reserve Captain under the direction of the Chief of Police.The current Reserve Captain, Chip Jones, is also an employee of Bruce Lowrie Chevrolet and is authorized to use this vehicle for transportation between his home and his duty assignment as a reserve officer; any on-duty activities; and transportation for any fueling, maintenance, repair, or equipment installation. All other uses are strictly prohibited. 5. All equipment installed by Bruce Lowrie Chevrolet will remain property of the dealership. 6. All equipment installed by the City of Fort Worth or the Fort Worth Police Department will remain property of the City. 7. The City of Fort Worth will maintain the vehicle per the City of Fort Worth guidelines. 8. The City of Fort Worth will maintain full insurance coverage on the vehicle. Other than for manufacturers defects, the City releases Bruce Lowrie Chevrolet from any claim made in reference to any accident or liability in reference to this lease agreement. 9. Either party may terminate this agreement with 30-days written notice to the other party. 10. Any damage that is deemed not normal wear and tear will be the responsibility of the City of Fort Worth. 11.The City of Fort Worth and the Fort Worth Police Department bear no responsibility in final sale or disposition of this vehicle. 12. Any prior or contemporaneous oral or written agreement is hereby declared null and void to the extent in 2003CHIMPALA_120803_PageI oft conflict with any provision of this agreement. This agreement shall not be amended unless executed in writing by both parties. 14. This agreement shall be construed under and in accordance with Texas law. Further, any action arising hereunder shall be exclusively in Tarrant County,Texas. 15.
