UNIT 1-B: NORTHEAST 38TH STREET From 628' east of North Main Street to North Grove Street, known and designated as Project No. I04- 24000-2:x'8, Unit 1B. kHEREAS,-by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 7112 _, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, 4fflEREAS, the City Council of the City of Fort 'qorth, Texas, has, upon review, found and determined that., in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 7112 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. Ii. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates,, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract pr1ce. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and aft,--�r the date of its passage. Project Description Name: Assessment Paving at Two Locations North Side, Reconstruction of Two Existing Streets and Monterrey Drive Storm Drains Contractor: Austin Road Company Contract Awarded: December 16, 1974 (M&C C-2973) Work Order Issued: December 26, 1974 Work Order Effective: January 13, 1975 Work Began: January 13, 1975 Date of Final Inspection and Approval: August 18, 1975 Working Time Bid: 180 Working Days Working Time Used: 1.15 Working Days Project Cost and Financing Original Bid Price: $205,521.03 Change Order, No. 1: $1,334A0 (A.R. 1-15, 2.3.1) Change Order No. 2: $10,803.97 "MC C-3117) Revised Bid Price: $31.7,659A0 Final Contract Cost: $316,728,18 Partial Payments Previously Made: 7, Amount: $286,206.38 Final Payment Due: $30,521.80 VATE REFERENCE SUBJECT: i i,rvil Payment-Assessment Paving at PAGE NUMBER Two Locations North Side, Reconstruction 2 2 10/20/75 FP-11i0 Two Exist Streets and Monterrey Drive Storm Drains Final payment to be made from Project Numbers 104-24000-238 (Assessment Paving at 2 Locations') , 104-27000-165 (Reconstruction of Two Existing Streets) and 104-28000-739 (Monterrey Drive Storm Drain') ,, Deviation from bid price: The final total contract cost of the three projects is $930.92 under the revised bid price, Vhich resulted due to deviation between quantities estimated in the contract documents and quantities measured and used in the field. However, due to a considerable overrun in the ReconstVction of Stadium Drive and Monterrey Drive, Project No. 104-27000-165, which fe"sulted from the removal and replacement of more than estimated curb, gutter and driveways in order to provide adequate drainage, a deficit of $6,900.00 exists. A bond fund transfer is required to balance the account. Compliance with Specifications Tests made during construction show materials used and required thicknesses are in compliance with contract specifications., Recommendations It is recommended that 1) A bond fund transfer be approved in the amount of $6,900.00 from Reconstruction Unspecified, 104-27000-901 to Reconstruction of Stadium Drive and Monterrey Drive, 104-27000-165 and 2) The project described be accepted by adoption of an ordinance and final payment of $30,521.80 be made to Austin Road Company.
