AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF ESSEX STREET IN THE 400 BLOCK, A WIDTH OF 50' AND A LENGTH OF 140' FROM THE SOUTH LINE OF TRACT 4, WM. MANN SURVEY, SOUTHWARD TO THE NORTH LINE OF LOT 4, BLOCK "K", WM. JAMES ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND, SAVE AND EXCEPT EASEMENTS ARE RESERVED FOR ANY AND ALL EXISTING UTILITIES INCLUDING EXISTING WATER, ELECTRIC AND GAS FACILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Essex Street in the 400 Block, a width of 50' and a length of 140' from the South line of Tract 4, Wm. Mann Survey, Southward to the North line of Lot 4, Block "K", Wm. James Addition to the City of Fort Worth be and the same is hereby vacated, abandoned and permanently closed as a right-of-way for street purposes. SECTION 2. That the fee to the land in the above described street right-of-way is hereby released and will revert to the ad- jacent owners as provided by law, SAVE AND EXCEPT that ease- ments are reserved therein for any and all existing utilities including existing water, electric and gas facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Mann Survey, southward to the north line of Lot 4, Block "K", Wm, James Addition, as shown on the attached map. Subject street right-of-way, acquired by dedication, is open and paved, and contains water, electric and gas facilities. The agencies responsible for these public facilities request easements of sufficient size be re- tained to protect their existing facilities. The Fire Department notes a fire lane must be provided. Current City Tolicy calls for a Cul-de-sac or acceptable turnaround to be established at the terminus of any dead end street, when abutting property is replatted. However, the City Plan Commission did not require a cul-de-sac at the end of Essex Street, as the adjoining land is a parking lot area which can be used for a turnaround. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject right-of-way as requested pro- vided that: 1. The vacated right-of-way is replatted with abutting properties; 2. Utility easements are provided as requested; 3. Satisfactory fire protection arrangements are made with the Fire Department. A satisfactory replat has been submitted to City Staff and arrangements have been made with the Fire Department to provide a fire lane. Recommendation: It is recommended that an ordinance be adopted vacating subject right- of-way as recommended by the City Plan Commission.
