WHEREAS, the City of Fort Worth, Te aa„ has heretofore ordered that each of the hereinafter described
portions of streets, avenues and public places in the City of Fort Wofth, "Texas, be improved by raising, grading,
or filling same and by constructing thereon to-vrit
UNIT 1: WEST CLEBURNE ROAD From llulen Street to Sycamore School Road, known
and designated as Project No. 104-36408-00, Unit 1,
a seven-inch thick hot-mix asphaltic concrete pave-
ment on a six-inch thick lime stabilized subgrade
with seven-inch high concrete curb and eighteen-
inch wide concrete gutter on a forty-foot roadway.
UNIT 2: WEST CLEBURNE ROAD From Hulen Street to 2,589' west, known and de-
signated as Project No. 104-36474-00, Unit 2, a
seven-inch thick hot-mix asphaltic concrete pavement
on a six-inch thick lime stabilized subgrade with
seven-inch high concrete curb and eighteen-inch
wide concrete gutter on a forty-foot roadway. Six-
inch thick concrete driveways will be constructed
where specified.

WHEREAS, estimates of the cost of the improvements of each such portion of streets, avenues and public
places were prepared and d]od and approved and adopted by the City Council of the City, and a time and place
was fixed for m hearing and the proper notice nY the time, place and purpoao of said hearing was given and said
hearing was had and 6m\d at the time and place fix ed therefor, to-wit, on the-14th

all desiring to be heard were given full and fair opportunity to be heard, and the City Council of the City having
fully considered all proper matter, is of the opinion that the said hearing should be closed and assessments
should be made and levied as herein ordered:

TEXAS, THAT:
1.

protests and o1 jections, whether herein enumerated or of not, be and the same are hereby, overruled.
II.
The City Council, from the evidence, finds that the assessments herein levied should he made and levied
against the resp(,�(-live parcels of property abutting upon the said portions of streets, avenues and public places
and against the owners of such property,•, and that such assessments and charges are right and proper and are
substantially in proportio" to the benefits to the respective parcels of property by means of the improvements
in the unit for which such assessments are levied, and establish aubsbWal ,justice and equality and uniformity
between the respective owners of he re "alive payerties, and between all Imrties eoncei-ned, considering the
benefits received and burdens imposed, and further finds that in each case the abutting property assessed is
specially benetited in enhanced valuer to the said Iwoperty by means of the said improvements in the unit upon
which the particular property abuts and for which aassessment is levied and charge made, in a sum in excess of
the said assessment and charge made agaainst the same by this ordinance, and further finds that the alpportion-
nwnt of the cost of the improvements is in accordance with the lakv in force in this Cite, and the proceedings of
the ('ity heretofore had with rermvnce to said improv_rnenk, and is in all respects valid and regular.
III.
'There shall be, and is her0q% levied and assessed against the parcels of proem, herein below mentioned,
and against the real wind true owners thereof (whether such owners be correctly- named herein or not) the sums of
money itemized below opposite the description of the mspective pa mels of property and the several amounts
assessed against the same, and the owners thereof, as fain as such owners are known, being as follows:
Where more than one pernon, fivn,j or corpointion owns an interest in Any property above described, each
said WWI firm or corporation shall be personally liable only for its, her or his pro iota of the total assessment
against such property in proportion as As, his or her respective interest bears to the total ownership of such
property, and its, his or respective interest in such property may be released from the assessment lien upon pay-
ment of such proportionate sum,

"Die several sums above mentioned and assessed against the said parcels of property, and the owners
thereof, and interest thereon at the rate of six per cent (60 ) per annum, together with reasonable attorney's
fees and costs of collection, if incur ved, are henly decinred to be and are made a lien upon the respective parcels
of property against which the same are assessed, and a personal liability and charge against the real and true
owners of such property, whether such owners be correctly named herein or not, and the said Hens shall be and
constitute the first enforceable lien and claim against the property on which such assessments are levied, and
shall be a first and paramount hen thereon, superior to all other Hens and claims, except State, County, School
District and City ad valorem taxes.
The sums so assessed against the abutting property and the owners thereof shall be and become due and
payable as follows, to-wit: in five (5) equal installments, due respectively on or before thirty (30) days, one (1),
two (Q, three (3), and four (1) yeam from the date of completion and Acceptance of the improvements K the
respective unit, and the assessments against the property abutting upon the remaining units shall be and become
due and payable in such installments after the date of the completion and acceptance of such respective units, and
shall bear interest from said date at the rate of Ax per cent (60 ) per annum, payable annualo with each Wall-
men, except to to the first installment, which shall be due and payable at the makway thereof, so that upon the
completion and acceptance of the hiprovernents in a particular unit, assessments against the propmty abutting
upon such completed and accepted unit shall be and become due anal payable in such installments, and with
interest from the date of such completion And acceptance. Provided, however, that any owner shall have the
right to pay the entire assessmeW, or any installment thereof, before maturity by payment of principal and
accrued interest, and provided further that if default shall be made in the payment of principal or interest
promptly- as the same matures, then the entire Amount of the assessment upon which such default is made shall,
at the option of said City of Fort Woilkm or As assigns, be and hemme immediately due And payable, And shall be
collectable, together with reasonable attorney's fees and cost of collection, if incurred, PROVIDED, however,
that acting through As duo authorized Director of Public Works the City of Fort With retains the right to
authorize payment of the sums assysed against Abutting property upon such completed And accepted unit in not
more than forty-eight (48) equal VegUlar Monthly installments of not less than $9.00 each, the first of such
hshHments to become due and pynble not more than thirty (30) days after the completion and acceptance by
the City of the particular unit. PROVIDED FURTHER, that the City Attorney is hereby empowered to authorize
payments of said sums of knev installments mid/or over a longer period of time in cases in which the Director
of Public AWN has previously detei• lined that an extreme financial hardship upon the property owner will
otherwise result; and PROVIDED FURTHER, that such method of payments shall he authorized only in instances
where the owner or ownerg of props ly abutbng upon such (=Meted and accepted unit shall have executed and
delivered to the City of Fort Worth a lawful, vald and Wndkg note and mechanic's and materialman's contract
upon forms supplied pay the City granting A mechanic's lien upon and conveying the said abutting property in
bust to semi, the payment by mid owner or owners according to the terms thereof of the sums assessed against
such property.
If default shall be made in tho paynwnt of any assessment, colYlion thereof shall be enforced either by
the sale of the property by the Assessor and Collector of Tax, of said City as near as possible in the same man-
ner provided for the sale of property- for the non-payment if ad valorem taxes, or at the option of the City of
Fort Worth, or its assigns, payment of said sums shall Ine enforced by suit in any court of competent jurisdic-
tion, or as provided in any median&'s or matwialmaWs contract as afoinN01 and said City shall exercise all of
its lawful powers to mid in the enfmTement and collection of said assessments.
VII.
The total amount assessed against the respective parcels of ahutting property, and the o"imus thereof, is
in acco Aunce with the proceedings of the City relating to said imprmTmcnts and assessments thei"d, and is
less than the proportion of the cost allowed and permitted by the law in force in the City.
VIII.
Although the aforementioned charges have been fixed, levied, and assessed in the respective amounts
hereinahove stated, the City Count•il does hereby reserve unto itself the right to reduce the aforementioned
assessments by allowing credits to certain property owners where deemed appropriate, Notwithstanding the City
Council has herein reserved the Holt to issue credits, it shall not he required to issue credits, and will not do so,
if same would result in any equity avid/or unjust discrimination.
The principal amount of each of the several assessment certificates to be issued the City of Fort North,
Texas, as hereinafter provided, shall he fixed and determined by deducting from the amount of any assessment
hereinahove levied such amount or amounts, if any as may hereafter be allowed by the City Council as a credit
against the respective assessments.

For the purpose of evidencing the sevantsums assessed against the respective parcels of abutting prop-
erty and the owners thereofZnrid the time and terms of payment, and to aid in the enforcement and collection
thereof, asAgnaile certificates in the: principal ;amount of the respective assessments less the amount of any re-
spective cretddt allowed thereon, shall be issued by the Cite of Fort Worth, Texas, upon completion and accept-
ance by the City of the improvenients in each unit of improvement as the wort~ in such unit is completed and
accepted, which cortificates shall be executed by the mayor in the name of the City and attested by the City
Secretary, with the corporate seal of the City imiiressed thereon, wind skill lw, Irtyarble to the City of Fort \Vorth,

Said certificates shall further recite that the City of Fort Worth, Texas shall exercise all of its lawful
powers, when requested so to do, to aid in the enforcement and collection thereof, and may contain recitals sub-
stantially in accordance with the above and other additional recitals pertinent or appropriate thereof, and it
shall not be necessary that the recitals be in the exact form above set forth, but the substance thereof shall be
sufficient. The fact that such improvements may be omitted on any portion of any of said units adjacent to any
premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of
such assessments upon other premises.
X.
Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities,
either in the assessments or in the certificates issued in evidence thereof, is, in accordance with the law in force
in this City, vested in the City.
X1.
All assessments levied are a personal liability and charge against the real and true owners of the premises
described, notwithstanding such owners may not be named, or may be incorrectly named.
X11.
The assessments so levied are for the improvements in the particular unit upon which the property
described abuts, and the assessments for the improvements in any unit are in nowise affected by the improve-
ments or assessments in any other unit, and in making assessments and in holding said hearing, the amounts
assessed for improvements in any one unit have been in nowise connected with the improvements or the assess-
ments therefor in any other unit.
XIII.
The assessments levied are made and levied under and by virtue of the terms, powers and provisions of an
Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106
of the Acts of said Session and now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been
adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas.
XIV.
The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same
in the Minute Book of the City Council of Fort Worth,Texas, and by filing the complete Ordinance in the appro-
priate Ordinance Records of said City,
Xv.
This ordinance shall take effect and be in full force and effect from and after the date of its passage and
it is so ordained.

On October 17, 1978, the City Council declared the necessity for and ordered
the improvements of Project No, 013-036-408, Unit I and Project No, 013-036-474,
Unit II, as described below, A construction contract was awarded to South-
western Construction Company in the amount of $591,645.85, and November 15,
1978, was set as the date for the Benefit Hearing (M&C C-4387) . All adjacent-
property owners were notified of thehearingby certified mail on October 27,
1978,

Origin of P-roiect.
This Project was initiated in conjunction with Cammunity Facilities Contracts
No, 8957, CandleRidge Addition, Phase VI, approved October 4, 1976 (M&C C-3539),
and No. 9795, The Meadows Addition, Phase I, approved April 18, 1978 (M&C
C-4157) , West Cleburne Road is a border, street to both developments. In addi-
tion, a Community Facilities Contract is imminent for the development of
Parkwood East. Addition on the east side of West Cleburne Road,
Improvements
Thie p,>ttion of West Cleburne. Road is a county-type roadway with penetration
pavement and borrow ditches. Improvements will include construction of
collector grade hct-mix asphaltic concrete pavement with concrete curb, gutter
and driveway approaches on a 40-foot wide roadway., Storm drain improvements
will consiat of approximately 2,134 feet of reinforced concrete culvert pipe
and appurtenances,
Assessments, and Enhancements
Most of the adjacent property is zoned residential and is being assessed
$8.50 per front foot for pavement, curb and gutter andior $4.25 per front foot
where the back of the lot is adjacent to the street (rear lots), all in
accordance with Standard City Policy, There was, however, some question as
to enhancement of a tract of land out of the 1. Flares Survey, being a 199-acre
farm (homestead) , zoned agricultural, of which only the first 500-feet in depth

The property fronts on West �',Aeburne Road for some 990-feet in Unit I and
2,589 feet in Unit II , An independent land appraiser was retained to assist
the staff :1n making recommendations as to enhancement to the above property.
The appr,aiser, Daniels, Highfield & Associates, have submitted their appraisal
report- indicating that Lhe property in question ould enhance in value in the
amount of $50,000,00 (13,,97 per front foot) rather than the proposed assess-
ment of $116,353,29 (32.51 per front fout) , The Public Works Director agrees
with the appraisal report, which will be available for Council consideration
at the benefit hearing,, The assessment rolls have been prepared to reflect
both the standard assessment and the enhancement amounts on the above property.
It is the opinion of the Public Works Director that the remaining properties
will enhance in value 'by an amount aqual to or greater than the proposed
assessments,
Recommendation
It is recommended that an ordinance be adopted closing the benefit hearing and
levying the assessments as proposed andior as the Council may determine,
