AN ORDINANCE APPROPRIATING REVENUE OF THE CITY OF FORT
WORTH IN THE SUM OF $7 ,869 .00 FROM THE GENERAL FUND FUND
BALANCE TO FINANCE THE CITY'S PARTICIPATION WITH OTHER
TEXAS MUNICIPAL LEAGUE CITIES IN JOINT OPPOSITION TO A
RATE-INCREASE REQUEST OF SOUTHWESTERN BELL TELEPHONE
COMPANY BEFORE THE PUBLIC UTILITY COMMISSION OF TEXAS ;
PROVIDING A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ORDINANCES
IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS :
SECTION 1 .
That the City Manager of the City of Fort Worth shall be
provided with such revenue as may be secured from various sources
included in Ordinance No. 7787 and in the Budget of the City
Manager ; and in addition thereto there is appropriated $7 ,869 .00
of excess revenue and/or unappropriated surplus from the General
Fund balance to fund the city 's pro-rata cost of a joint effort
through the Texas Municipal League in opposition to a rate increase
requested by Southwestern Bell Telephone Company pending before the
PUC in Docket No . 2672 .
SECTION 2 .
Should any part, portion, section or part of a section of this
ordinance be declared invalid or inoperative or void for any reason
by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way affect the remaining portions , parts,
sections or parts of sections of this ordinance, which provisions
shall be, remain and continue to be in full force and effect .
SECTION 3 .
That this ordinance shall be cumulative of Ordinance No . 7737 ,

SECTION 4 .
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is
so ordained .

On June 28, 1979, Sourh,restcrn Bell Telephone Company filed with the Public
Utility Commission of Texas a request (Docket PUC-2672) to increase statewide
telephone rates to generate increased Y,.e,venue in, the amount of $145.2 million.
This request comes e1e'i,,,'cn 1110rLLhs after Che company had received a $124.5 million
increase. The Comp,,.iny claCants iA has been unable tt,,j earn the 9,5% rate of return
authorized by the Public Utility Ccimmission in its August, 1978, decision and
has been earning only 8, 35%.
In the last two Lases filed befuurct the Commission durdrig 1976 and 1978, many
Texas Cities served by the Bell system worked tOgeLher through the Texas
Municipal League in oppo.,;!,Lt:ioa to the proposed increases and were quite success-
ful in their opposition. In 1976, a rate increase of only $58 million was
granted as opposed to the $298 riiJUon request of the company; in 1978, a rate
increase of $124.5 mill-iori wa s, granted as opposed to the $214,3 million
requested.
In these pre,,rious cases before the, PUC, EUnds for the intervention efforts
were contributed by all affected TML member' CitiES to a trust fund administered
by the TML, and the pro-Lata assessiruents were based on the 1970 census figures
(393,450 for Fort Worth) , 11 he per capita assessment on the 1976 case was
3q, and in 1978, the rate was red ,aced to 2!�Q, FVrt Worths contributions
amounted to $1.1,804 an id $9,336, nr,,spec_tiveiy. These allocations were approved
by City Council on Seprember 21, 1.976 (M&C G-3181) and April 4, 1978
(M&C G-3776) ,
The attached communicatic'.)n fr(.,ml the TML details a funding proposal for the
current case, which will r°equire an expenditure of an estimated $7,869 based
on a rate of 2r per capita, using the 1970 population figures, This amount
will be adequate to, retain the e)pert consultants necessary in the case, when
added to some $15,000 unexj.)ended funds remaining from the last case.

Recommendation
It is recommended that:
1) The proposed participation and funding described above
be approved; and
2) A sum of $7,869 be appropriated for this purpose by
adoption of the attached supplemental, appropriation
ordinance.
