TO CITY SECRETARY CONTRACT No . 55399
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols,
Inc. , (ENGINEER) made and entered into City Secretary Contract No . 55399,
(the CONTRACT) which was authorized by M&C 21-0128 on the 16th day of
February, 2021 in the amount of $1 , 001 ,447 .00; and
WHEREAS , the CONTRACT was subsequently revised by Amendment No. l
in the amount of $94,871 .00 administratively authorized on October 8,
2021; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
3rd Barrel Parallel Sanitary Sewer to the Twin 90- inch Sewers
Serving the Village Creek Wastewater Treatment Plant, Bank
Protection at the Village Creek Wastewater Treatment Plant and
Pipeline Erosion Analysis at Five Low Water Crossings Project; and
WHEREAS , it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE , CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $169, 005. 00.
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,265,323. 00.
3 .
All other provisions of the Contract, which are not express y

Dear Ms. Poudyal:
Freese and Nichols, Inc. (FNI) is providing this proposal to amend the Engineering Design Services for the
3rd Barrel/Village Creek Bank Stabilization/5 Sites (City Project Number 103128).The following fee
includes the costs for additional design management for an additional five (5) months, design services
for the proposed 10-inch sewer replacement and for a soil-supporting concrete encasement for the 120-
inch FRP adjacent to the pond, additional geotechnical investigations including drilling and laboratory
tests, additional archeological surveying as required by THC, topographical surveying for the pond and
the proposed 10-inch sewer replacement, alignment study and Level A SUE along the existing 90-inch
gravity mains, and a credit for reducing the proposed flow transfer junction boxes from two to one. FNI
records show that this proposal would serve as Contract Amendment No. 2.

The scope set forth herein defines the work to be performed by the ENGINEER in completing
the project. Both the CITY and ENGINEER have attempted to clearly define the work to be
performed and address the needs of the Project. Task Nos. 1-15 were previously defined
under the original contract. Although not included here the language in the original contract
apply to this amendment, as if included herein.
The purpose of this amendment is to amend Task 1.0 (Design Management) due to project
schedule being extended five (5) additional months; to amend Task 3.0 (Preliminary Design
— 60%) and Task 4.0 [Final Design (90 Percent) and Final Construction Documents (100
Percent)] by including additional effort for design of the proposed 10-inch sewer main,
additional geotechnical investigations, credit for reduction of flow transfer junction boxes from
two to one, and design of a soil-supporting concrete encasement to protect the 120-inch FRP
adjacent to the pond; and to amend Task 7.0 (Survey/SUE Level D) by including additional
topographical survey for the pond and for the design of the proposed 10-inch sewer, and for
including Level A potholes downstream of the project to identify alignment issues of next
phase of design.

Task 7.2 Additional Level A potholes for future alignment downstream of project
TASK 1. DESIGN MANAGEMENT.
The project has been on hold for design since the 60% review workshop, held on January 5,
2022, when discussions ensued regarding shifting the horizontal alignment of the 120-inch
FRP, obtaining additional geotechnical bores for the junction box and soil-supporting concrete
encasement design adjacent to the pond, and obtaining Level A SUE potholes downstream
of the project location to identify critical conflicts that could affect the 120-inch FRP future
alignment. This effort has extended the project schedule by approximately five (5) additional
months. Additional effort for design management includes:
1.1. Managing the Team
• Lead, manage and direct design team activities.
• Ensure quality control is practiced in performance of the work.
• Communicate internally among team members.
• Task and allocate team resources.
1.2. Communications and Reporting
• Prepare invoices and submit monthly in the format acceptable to the CITY.
• Prepare exhibits for options for alignment modifications, location of potholes, etc.
• Meet with City staff to discuss revised scope.
• Prepare and submit additional monthly progress reports while project was on
hold.
• Complete additional monthly M/WBE Report Form while project was on hold.
TASK 3. PRELIMINARY DESIGN (60 PERCENT) FOR GRAVITY MAIN.
ENGINEER will develop the preliminary design of the 10-inch pipeline and a soil-supported
concrete encasement around the 120-inch FRP, near the pond, as follows:
3.1. Additional Design of 10-inch Sewer
The Engineer will design approximately 700 LF of 10-inch sewer to reroute the existing 10-
inch sewer to avoid conflict with proposed 120-inch FRP sewer. Design shall include all plan-
profile sheets, necessary details and specifications, in compliance with Task 3.1 in the original
contract.

3.2. Geotechnical Investigation
The additional geotechnical investigation will provide information for the 120-inch sewer
installation near the existing pond. Additional information will be used to aid in design of the
flow transfer junction box located at the upstream end of the project. Additional bores will also
aid in the design of the soil-supported concrete encasement for the alignment near the pond.
The additional geotechnical services are as follows:
■ 1 boring to 50 feet maximum.
a. 1 boring at northern flow transfer junction box
■ 3 borings to 50 feet or less depending upon depth to rock.
a. These borings are along the pipeline route near the existing pond.
■ Laboratory tests on recovered soil and rock samples for shear strength determination
and soil classification.
■ The Geotechnical Report (GR), per the original contract, will be modified as follows:
a. Add additional borings
b. Update the plan of borings and subsurface diagram
c. Adjust technical memorandum as appropriate
3.5(a). Structural Design (CREDIT)
A credit will be provided for reducing the number of flow transfer junction boxes, from two to
one. The structure adjacent to the existing pond will be eliminated from the design.
3.5.(b) Additional Design for Soil-supported Concrete Encasement
The Engineer will design a soil-supported concrete encasement with the following design
parameters:
O Protect the pipe from damage due to inadvertent equipment operation on or
digging operations near the pipe.
O Protect the pipe from partial exposure and loss of lateral and/or vertical support
within the approximately 150- to 200-foot zone immediately adjacent to the
pond. The exposure and partial loss of support may occur anywhere along this
zone but will be limited to a maximum exposed length.
O The design will assume any exposed length of encasement will be repaired
before the exposed length grows longer than the design length used. The
design exposed length will be as determined in coordination with the City based
on a preliminary design by FNI to explore the practical limits.
O Design does not include calculations or account for deep foundations, tiebacks
or anchors.

3.7. Additional Archeological Investigation.
The number of archeological surveys originally included in the original contract was rejected
by the Texas Historical Commission (THC) as requested in the archeological permit
application, submitted by the archeological sub-consulted. The permit was rejected due to the
presence of an existing known site, which necessitated the additional survey. This scope
represents the additional number of excavations and its associated costs.
TASK 4. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION
DOCUMENTS (100 PERCENT).
Engineer will further develop the design of the 10-inch sewer and the soil-supporting concrete
encasement and incorporate into the plans, as follows:
4.2. Draft Final plans (90%)and specifications shall be submitted to CITY per the approved
Project Schedule.
4.3. The ENGINEER shall submit a final design estimate of probable construction cost with
both the 90% and 100% design packages. This estimate shall use ONLY standard
CITY bid items.
TASK 7. SURVEY/ SUBSURFACE UTILITY ENGINEERING SERVICES (LEVEL D).
7.1. Design Survey
To provide additional information to the bidding contractors, a more-in-depth survey of the
existing pond will be necessary. In addition, due to the vertical conflict between the existing
10-inch sewer that currently ties into the existing Twin 90-inch sewers, an additional ground
survey will be required for the design of the rerouting of the 10-inch sewer.
7.2. Subsurface Utility Engineering (SUE)
Sixteen (16) Level A potholes will be performed along the two existing 90-inch gravity mains,
just downstream of the east end of the existing pond, where this project terminates. The
purpose of the potholes is to identify the exact location of the Twin 90-inch gravity mains and
to determine if the alignment of the proposed 120-inch FRP needs to be modified during
design.

RECOMMENDATION:
It is recommended that the City Council:
1.Authorize execution of Amendment No. 2, in the amount of$169,005.00, to City Secretary Contract
No. 55399, an engineering agreement with Freese and Nichols, Inc. for the Design of the 3rd Barrel
Parallel Sanitary Sewer to the Twin 90-inch Sewers Serving the Village Creek Wastewater
Treatment Plant, Bank Protection at the Village Creek Wastewater Treatment Plant and Pipeline
Erosion Analysis at Five Low Water Crossings project for a revised contract amount of
$1,265,323.00; and
2.Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the
Water& Sewer Revenue Bonds Series 2021 Fund, by increasing estimated receipts and
appropriations in the 3rd Main to W Fork Trunk Mains project(City Project No.103128) in the
amount of$169,005.00 and decreasing appropriations in the Unspecified project (City Project No.
UNSPEC) by the same amount to effect a portion of Water's contribution to the Fiscal Years 2022-
2026 Capital Improvement Program.
DISCUSSION:
On February 16, 2021, Mayor and Council Communication (M&C 21-0128) authorized an engineering
agreement with Freese and Nichols, Inc., (City Secretary Contract No. 55399) in the amount of
$1,001,447.00 for the preparation of plans and specifications for the design of the 3rd Barrel Parallel
Sanitary Sewer to the Twin 90-inch Sewers Serving the Village Creek Wastewater Treatment Plant, Bank
Protection at the Village Creek Wastewater Treatment Plant and Pipeline Erosion Analysis at Five Low
Water Crossings Project. The agreement was subsequently revised by Amendment No. 1 in the amount
of$94,871.00, administratively authorized on October 8, 2021, that provided for additional design efforts
for the preparation of a necessary individual permit from the United States Army Corps of Engineers,
additional tree and topographic survey and additional archeological survey.
Amendment No. 2 will provide for design and survey services for a soil-supporting concrete encasement
for the portion of the project sewer main that is adjacent to an existing pond, additional geotechnical
investigation, additional archeological survey and design for the replacement of an existing conflicting 10-
inch sanitary sewer main.
It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan
throughout the fiscal year, instead of within the annual budget ordinance, as projects commence,
additional funding needs are identified, and to comply with bond covenants. The actions in the M&C will
appropriate funds in support of the Water Department's portion of the City of Fort Worth's Fiscal Years
2022-2026 Capital Improvement Program, as follows:

Business Equity: Freese and Nichols, Inc. agrees to maintain its initial M/WBE commitment of 12
percent that it made on the original agreement and extend and maintain that same M/WBE commitment
of 12 percent to all prior amendments up to and inclusive of this Amendment No. 2. Therefore Freese and
Nichols, Inc. remains in compliance with the City's M/WBE Ordinance and attests to its signature on the
Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its
company.
The project is located in COUNCIL DISTRICT 3, 4, 5 and 7.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the UNSPEC project within the W&S
Rev Bonds Series 2021 Fund and upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the W&S Rev Bonds Series 2021 Fund for the
3rd Main to W Trunk Mains project to support the approval of the above recommendations and execution
of the amendment. Prior to an expenditure being incurred, the Water Department has the responsibility of
verifying the availability of funds.
