HomeMy WebLinkAboutOrdinance 25650-08-2022 ORDINANCE NO.25650-08-2022 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORMWATER CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE COMANCHE TRAIL HAZARDOUS ROADWAY OVERTOPPING MITIGATION PROJECT(CITY PROJECT NO. 103396)IN THE AMOUNT OF$2,200,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SW HAZARDOUS RD OVERTOPPING PROGRAMMABLE PROJECT (CITY PROJECT NO. P00120) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Stormwater Capital Projects Fund,by increasing estimated receipts and appropriations in the Comanche Trail Hazardous Roadway Overtopping Mitigation project (City Project No. 103396) in the amount of $2,200,000.00 and decreasing estimated receipts and appropriations in the SW Hazardous Rd Overtopping Programmable Project(City Project No. P00120)by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the execution of a contract with Klutz Construction, LLC in the amount of$1,894,090.00 for Comanche Trail Hazardous Roadway Overtopping Mitigation project(City Project No. 103396); 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund, by increasing estimated receipts and appropriations in the Comanche Trail Hazardous Roadway Overtopping Mitigation project(City Project No. 103396), in the amount of$2,200,000.00,and decreasing estimated receipts and appropriations in the SW Hazardous Rd Overtopping Programmable project(P00120) by the same amount;and 3. Amend the Fiscal Years 2022-2026 Capital Improvement Program. DISCUSSION: Approval of this Mayor and Council Communication (M&C)will authorize the execution of a construction contract with Klutz Contruction,LLC in the amount of$1,894,090.00 to improve drainage at a flood-prone section of Comanche Trail between Malaga Drive and Marina Drive. The project is part of the Stormwater Hazardous Road Overtopping Mitigation(HROM) Program,which is an ongoing effort to identify hazardous road flooding locations, prioritize them based on risk and,where feasible,develop solutions to make them safer. The HROM program was created in response to life-threatening and fatal incidents associated with flooded roads, usually at stream crossings. The drainage improvements at this location will be to raise,widen,and straighten a flood-prone section of Comanche Trail over the waterway to improve flood protection from Comanche Creek and replace the existing culvert with concrete arches.Additional improvements are to provide a safe pedestrian crossing,extra lighting,guardrails,and a ramp to access a drop structure for maintenance. This project is adjacent to the City of Lake Worth,and relocation of that city's water and sewer infrastructure in the project limits will be a necessary part of construction.The cities of Fort Worth and Lake Worth have an Interlocal Agreement in which Lake Worth grants Fort Worth temporary right-of access to design and reconstruct the Comanche Trail culvert crossing; Lake Worth allows Fort Worth a permanent drainage easement to maintain the improvements; and the cities collaborated throughout the entire project. The project was advertised for bid in the Fort Worth Star-Telegram on June 16,2022,and June 23_2022. On July 7,2022,the following bids were received: Bidder Amount Klutz Contractors, LLC $1,894,090.00 Fort Worth Civil $2,410,869.00 IBCTX $2,436,251.00 GROD Construction LLC $2,637,822.00 Jackson Construction LTD $3,774,713.00 Construction is expected to begin in October 2022 and be completed by October 2023. Funding for design and Right of Way acquisition for the Comanche Trail HROM project in the amount of$717,165.00 was provided by M&C-0553, which amended the Fiscal Years(FY)2021-2025 Capital Improvement Program.Additional funding in the amount of$2,200,000.00 is needed to fully fund the project through construction. In addition to the contract amount,$347,000.00 is required for project management,material testing, inspection,and contingency.This project is funded by Stormwater Revenue Bonds 2020 and Stormwater Capital Projects Funds. The project was originally funded through design only. It was anticipated additional funds would be required for construction.
