HomeMy WebLinkAboutOrdinance 25642-08-2022 ORDINANCE NO.25642-08-2022 AN ORDINANCE REALLOCATING APPROPRIATIONS IN THE MUNICIPAL COURT DEPARTMENT OF THE GENERAL FUND BY DECREASING THE SALARY AND BENEFITS CATEGORY IN THE AMOUNT OF S250,000.00, AND INCREASING THE TRANSFER AND OTHER CATEGORY BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING TO THE GENERAL CAPITAL PROJECTS FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager, there shall also be adjusted appropriations in the Municipal Court Department of the General Fund by decreasing the Salary and Benefit category in the amount of $250,000.00, and increasing the Transfer and Other category by the same amount, for the purpose of transferring to the General Capital Projects Fund for funding the FWMC Lake Worth Boat Storage project(City Project No. 104113). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to designate and transfer funding for design and construction of a boat storage facility at Lake Worth. The Fort Worth Marshals lake patrol has a fleet of 3 boats.The current storage facility is only capable of storing 1 boat. Currently the other two assets are being stored outdoors exposed to weather elements and unauthorized access. Erecting a new structure will ensure that city assets are stored properly and protected out of the elements;improving the security and extending the service life of the boats. Property Management Department has worked with Quorum Architects,selected through the City's Annual Architectural Service Agreement,to plan design and provide a cost estimate for the project. In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived." This M&C does not request approval of a contract with a business entity. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Municipal Court Department Salary&Benefits category within the General Fund,and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the General Capital Projects Fund FWMC Lake Worth Boat Storage project.
