HomeMy WebLinkAboutContract 55946-A3 CSC No. 55946-A3 AMENDMENT No. 3 TO CITY SECRETARY CONTRACT No. 55946 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 55946, (the CONTRACT) which was authorized by M&C 21-0480 on the 22nd day of June, 2021 in the amount of $1,215,325.00; and WHEREAS, the CONTRACT was subsequently revised by Amendment No.1 in the amount of $17,802.00 authorized administratively on November 4, 2021 and Amendment No.2 in the amount of $1,585,391.00 authorized by M&C 22-0101 on February 8, 2022; and WHEREAS, the CONTRACT involves engineering services for the following project: Westside Water Treatment Plant Generators and Emergency Preparation Plan for Power Generation at the North and South Holly Water Treatment Plants; WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $1,945,967.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $4, 664,395.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. General: This amendment consists of three separate tasks associated with the Scope of Services regarding Fort Worth Water's (FWW) Emergency Preparedness Plan and Back-Up Power Improvements Project. They are as follows: 1. Design, bid, and construction phase services for Holly Complex for backup power includingelectrical switch ear and generator(s) for the plant. 9 g ( ) It is assumed that there are two contract documents: 1. Generators and generator paralleling switchgear will be prepurchased and assigned to the general contractor 2. Overall construction and installation (ductbanks, connections to the existing electrical distribution system, electrical buildings, etc.). The construction package will include effort for the entire project as described herein. Freese and Nichols, Inc. (FNI) will serve as a Prime consultant with Gupta and Associates, Inc. acting as a subconsultant. This scope and fee are based on providing Design, Bid and Construction phase services for a project at the Holly Treatment Complex with a project duration of 36-months. The basis of design is Holly Water Treatment Plant Backup Power Generators Technical Memorandum, date April 22, 2022. Holly Complex— Professional Services for Design, Bid and Construction Phases: Design of back up generation for the 120 MGD capacity to include sizing and siting of generator(s) and any electrical gear necessary to support the generators. The electrical gear is expected to have the capability to be expanded in the future, if necessary. The design will include all necessary generator(s) to support the Holly WTP's while operating at the max day capacity. The design will be completed by May 1, 2023. To determine necessary equipment to operate during the capacity (up to 120 MGD) of the treatment plant, coordination will be required to identify all necessary pump and motor combinations, and any necessary supporting processes and systems. City of Fort Worth,Texas Attachment A PMO Release Date:07.23.2012 Page 1 of 12 ATTACHMENT A DESIGN SERVICES FOR HOLLY BACKUP POWER GENERATION SERVICES CITY PROJECT NO.:103410 AMENDMENT 3 The generator system will be able to accommodate a minimum of 24 hours of continuous operation at maximum day capacity. The exact amount of time for back up generation will be coordinated with the CITY and finalized at the completion of the design phase. Additionally, the generators will meet City of Fort Worth Code of Ordinances Chapter 23-8 (noise). A maximum of two bid packages will be developed. One for the bid of the generators and associated generator paralleling switchgear, and one for the for the generator locations and switchgear buildings, ductbanks, connections to the existing electrical distribution system, etc. The first bid package (pre-selection/pre-purchase) will include specifications for the generators and associated generator paralleling switchgear. The first equipment that is procured with the first package will be assigned to the Contractor for management, coordination, and installation in a second bid package. The second bid package will include all necessary site plans, one-line diagram(s), and building floorplans for all equipment including the generator(s), switchgear, and all other necessary appurtenances. The site plan will identify a footprint for the generators, and the electrical building for the electrical gear for the generators. The one-line diagram(s) will show the generators and the connections to the existing electrical distribution system. The electrical rooms will be a stand-alone air-conditioned structure and will be for the electrical gear for the generators. The design plans will include floor plans, reflected ceiling plan and elevations, but all other components of the structure will be designed by the contractor based upon a performance specification. It is assumed that the existing plant O&M manual is available in electronic (MSWord) format. The CITY will provide the existing plant O&M manual to the Engineer. The CITY will provide a list of facilities and treatment units with backup power at the North and South Holly WTP. Design of SCADA improvements will be a part of this contract, but programming will be in the SCADA Integrator's contract (part of the construction contract). The transfer from utility power to generator power will be manual for the North Holly High Service Pump Station, Middle Holly High Service Pump Station, and South Holly High Service Pump Station. Kirk key interlocks will be used to transfer power where appropriate. Existing equipment may need to be modified to accommodate this. It is assumed that the City will manage bring loads onto generation through existing plant O&M and standard operating procedures rather than through a new SCADA control strategy. Coordinate with the electric utility company for any connection to the electrical service(s) to the treatment plant. Site improvements including site grading, paving and fencing/security. Each plan sheet shall be stamped, dated, and signed by the ENGINEER registered in the State of Texas. ENGINEER will develop the prepurchase specification for the generators and generator paralleling switchgear as follows: • Development of generator and generator paralleling switchgear Specifications, for the North and South Holly Treatment plant generator(s) and associated generator paralleling switchgear, shall include the following: O Detail sheets for one-lines, buildings, site plans, interconnection diagrams, and necessary appurtenances O Plans, sections, elevations, special details and special notes for the generator paralleling switchgear. O All specifications necessary for the prepurchase of the generators and generator paralleling switchgear. Upon approval of the Final plans, ENGINEER will prepare construction plans, for one design package. This estimate shall use ONLY standard CITY bid items. ASSUMPTIONS • 10 specifications will be delivered for the 90% prepurchase package. • A DWF file for the 100% Design will be created from design CAD drawings and will be uploaded to the project folder in BIM360. • The prepurchase specifications will include necessary general notes, site layouts, one-line diagrams, and detail sheets • City will provide pre-purchase standard specifications at design kickoff DELIVERABLES • 90% prepurchase specifications for the generators and generator paralleling switchgear. • 100% prepurchase specifications for the generators and generator paralleling switchgear. • A final specification for the project including electrical gear and generator(s). • Detailed estimates of probable construction costs including summaries of bid items and quantities using the CITY's standard bid items and format. G PRELIMINARY DESIGN (60 PERCENT) Preliminary plans and specifications shall be submitted to CITY per the approved Project Schedule. �I • ENGINEER will develop the preliminary design of the infrastructure as follows. • Development of Preliminary Design Drawings and Specifications shall include the following: o Cover Sheet o Overall site plan showing each improvement, coordinates and elevations of each improvement, items such as pipes and duct banks that run between improvements. o Grading plan showing the existing and proposed grading, contours for the 25- year and 100-year floods. If needed, proposed drainage structures will be shown. o Paving plan and details for generator and appurtenance access. o Utility relocation plans and details for storm drain below generator footprint and buried jail. o Plan sheets which show the following: site plans, building plans, one-line diagrams, interconnection diagrams, and details. o Plans, sections, elevations, special details and special notes for each design discipline. o All specifications. The prepurchase specifications will be in an appendix for the construction specifications. o The ENGINEER will prepare standard and special detail sheets for generator and switchgear installation. These may included connection details between City of Fort Worth,Texas Attachment A PMO Release Date:08.1.2014 Page 4 of 12 ATTACHMENT A DESIGN SERVICES FOR HOLLY BACKUP POWER GENERATION SERVICES CITY PROJECT NO,:103410 AMENDMENT 3 various parts of the project, details unique to the construction of the project, trench details, and foundation details. • Electrical o Develop electrical design for the installation of the generators, generator paralleling switchgear, and associated electrical gear for connection to the existing electrical distribution system at the North and South Holly Treatment Plant. o Coordinate with Electrical Utility for the North Holly, South Holly, and Middle Holly utility connections if necessary for interception and connection. o Design of ductbanks and electrical connections to the existing electrical distribution system. o There are anticipated to be two electrical buildings, one for the North Holly Treatment plant and the second electrical building will be for the South Holly Treatment plant. • Mechanical o Provide specification language and plan details for HVAC wall packs with duct work for air distribution at the electrical building. Plumbing will be limited to floor drains and condensate drains. • SCADA/Instrumentation o Develop control narratives for generator operation for generators and switchgear. Interconnect the generator to the Holly Treatment Plant SCADA system. o Coordinate any instrumentation with recommended manufacturers. o Modifications to the existing site communication and Fort Worth SCADA Network for the North Holly and South Holly is not included as a part of this project. • Structural o Prepare plans, list of specifications and required main structural members quantities o Design one generator pad for the Holly Treatment Complex according to the Geotechnical data and recommendations. Provide structural plan and sections. o Design foundation for precast concrete electrical buildings at the North Holly and South HollyTreatment plant sites according to Geotechnical data and p g recommendations. Provide structural plan and sections. o It is assumed that the new electrical buildin gs will I be a standalone structure and will not interfere with any of the existing features/structures. • Architecture o Prepare plan and elevations of electrical buildings and specification language on architectural elements/equipment. o Provide code analysis of electrical buildings. • Geotechnical Investigation o The proposed geotechnical scope of work for the project will consist of field exploration, laboratory testing, engineering analysis, and reporting foundation recommendations for one electrical building (assumed at 50'x50') and up to four generator pads. ■ Field Exploration City of Fort Worth,Texas Attachment A PMO Release Date:08.1.2014 Page 5 of 12 ATTACHMENT A DESIGN SERVICES FOR HOLLY BACKUP POWER GENERATION SERVICES CITY PROJECT NO.:103410 AMENDMENT 3 • Select and mark 3 boring locations and notify Texas 811 and the plant manager to request location and marking of existing underground utilities prior to the field exploration. • Subcontract with a geotechnical drilling contractor to drill a total of 3 borings to a depth of 25 feet. Samples will be collected intermittently using continuous flight augers and either split-spoon or tube samplers. Rock and rock-like materials will be tested insitu using a TxDOT Cone Penetration Test, as appropriate for the material. At completion, the boreholes will be backfilled with auger cuttings. • Provide an Engineer or Geologist experienced in logging borings to direct the drilling, log the borings, and handle and transport the samples. Visual classification of the subsurface stratigraphy shall be provided per the Unified Soil Classification System (USCS). ■ Laboratory Testing • Testing shall be performed on samples obtained from the borings to determine soil classification and pertinent engineering properties of the subsurface materials. FNI will select samples for laboratory testing, assign tests, and review the test results. Testing will be performed by a geotechnical testing subcontractor. • Laboratory tests will be assigned based on the specific subsurface materials encountered during exploration. Test type and quantity may vary, but are expected to include: • Classification tests (liquid and plastic limits and percent passing the no. 200 sieve or gradation) • Moisture content • Dry unit weight • Unconfined compressive strength ■ Engineering Analysis • Prepare a technical memorandum of the geotechnical investigation to include: • Attachment with the boring locations, boring logs, laboratory test results, and a key to the symbols used. • Discussion of subsurface conditions and soil properties indicated by the field and laboratory work, and the implications for design. • Foundation and site preparation recommendations for the proposed EB and GP. • Building Pad recommendations for use during development of the plans and d specifications. • Subsurface Utility Engineering Levels A, B, C or D o QL "B" SUE services within 3 locate areas at the Holly complex. Each area is approximately 2-, 3, and 1.75 acres. The ENGINEER shall summarize the CITY's comments from the field visit and submit this information to the CITY in writing. ASSUMPTIONS • 1 public meeting(s) will be conducted or attended during the preliminary design phase. • 2 sets of 11"x17" size plans will be delivered for the Constructability Review. • 2 sets of 11"x17" size plans will be delivered for the Preliminary Design (60% design). • 10 sets of specifications will be delivered for the Preliminary Design (60% design). • DWF files created from design CAD drawings will be uploaded to the designated project folder in BIM360. City will use the DWF files for Utility Clearance. • The CITY's front end and technical specifications will be used. The ENGINEER shall supplement the technical specifications if needed. • ENGINEER shall not proceed with Final Design activities without written approval by the CITY of the Preliminary Design plans. ENGINEER will support the bid phase of the project as follows. The .pdf will consist of one file of the entire plan set. • The City shall host the contract documents on its BIM 360 site and maintain a plan holder register. • The ENGINEER will develop and implement procedures for receiving and answering bidders' questions and requests for additional information. The procedures shall include a log of all significant bidders questions and requests and the response thereto. The log shall be housed and maintained in the project's BIM 360 folder titled Request for Information. The ENGINEER will provide technical interpretation of the contract bid documents and will prepare proposed responses to all bidders questions and requests, in the form of addenda. The ENGINEER shall upload all approved addenda onto BIM 360 and mail addenda to all plan holders. • Attend the prebid conference in support of the CITY. • Assist the CITY in determining the qualifications and acceptability of prospective contractors, subcontractors, and suppliers. • When substitution prior to award of contracts is allowed in the contract documents, the ENGINEER will advise the CITY as to the acceptability of alternate materials and equipment proposed by bidders. • Attend the bid opening in support of the CITY. • Tabulate and review all bids received for the construction project, assist the CITY in evaluating bids, and recommend award of the contract. Compensation A. The ENGINEER shall be compensated a total lump sum fee of $1,846,867 as summarized in Exhibit B-1 — Engineer Invoice and Section IV—Summary of Total Project Fees. The total lump sum fee shall be considered full compensation for the services described in Attachment A, including all labor materials, supplies, and equipment necessary to deliver the services. B. DISCUSSION: The February 2021 Deep Freeze caused power failures to Eagle Mountain Water Treatment Plant (EMWTP), the Westside Water Treatment Plant(WSWTP) and affected the North and South Holly Water Treatment Plants, along with power supply and freezing issues at some pump stations. In response to the power outages, the Water Department implemented a series of projects to minimize the effects of future power failures and/or freezing temperatures on Water Facilities. In addition, the State of Texas enacted a law,.Senate Bill 3 (SB3), requiring the submittal of an Emergency Preparedness Plan by March 1, 2022. On June 22, 2021, Mayor and Council Communication (M&C) 21-0480 authorized an engineering agreement with Freese and Nichols, Inc. (City Secretary Contract No. 55946) in the amount of $1,215,325.00 for the Westside Water Treatment Plant Generators and Emergency Preparation Plan for Power Generation at the North and South Holly Water Treatment Plants project. The original scope of service included the following: Preparation of the required SB3 Emergency Preparedness Plan by March 1, 2022 for responding to extended electric power failures; Design and j preparation of construction documents for the installation of emergency electric generators at the Westside Water Treatment Plant; and Study and prepare a plan for emergency power at the North and South Holly Water Treatment Plants. The agreement was subsequently revised by Amendment No. 1 in the amount of$17,802.00 administratively authorized November 4, 2021 to provide for additional coordination and review of ONCOR's design load sheet for an electrical service connection on the west property line of the Eagle Mountain Water Treatment Plant, and Amendment No. 2 in the amount of$1,585,391.00 (M&C 22-0101, February 8, 2022) to provide for design, bid, and construction phase services for backup power including electrical switchgear and generators in order to maintain functionality of these assets in the event of future deep freezes at the following Water Department pump stations: Alta Mesa, Edwards Ranch, Eastside and Como. The amendment also allowed for construction phase services for the installation of Westside Water Treatment Plant Backup Generators project. Amendment No. 3 will allow for design, bid, and construction phase services for the installation of emergency back-up power consisting of generators and electrical switchgear at the North and South Holly Water Treatment plants. The proposed scope of services include the sizing and siting of the generators and all electrical gear necessary for support, site improvements including grading and fencing/security and construction phase services. Freese & Nichols, Inc. proposes to perform the additional services for a fee not to exceed $1,845,867.00. Staff considers the fee to be fair and reasonable for the services proposed. In addition to the amendment amount, $100,000.00 is necessary for material testing. It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the fiscal year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants.
