AN ORDINANCE CLOSING THE HEARING ON SPECIAL BENEFITS TO BE RECEIVED FROM PROPOSED STREET IMPROVEMENTS, AND ON OTHER MATTERS WITH REFERENCE THERETO, ORDERED TO BE MADE PURSUANT TO ORDINANCES PASSED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, NOTICES OF THE ENACTMENT OF WHICH ARE OF RECORD IN VOLUME 1471, PAGES 214 TO 240, AND VOLUME 1383, PAGE 437, DEED OF TRUST RECORDS OF TARRANT COUNTY, 'TEXAS, AS AMENDED, AND PURSUANT TO SUBSEQUENT PROCEEDINGS OF SAID CITY COUNCIL; LEVYING SPECIAL ASSESSMENTS; PROVIDING FOR THE ISSUANCE OF ASSESSMENT CERTIFICATES; RATIFYING AND CONFIRMING ALL PROCEEDINGS HERETOFORE TAKEN BY THE CITY COUNCIL OF THE CITY OF FORT WORTH IN CONNECTION WITH SUCH STREET IMPROVEMENTS AND THE ASSESSMENTS WITH REFERENCE THERETO; MAKING OTHER FINDINGS AND ENACTING OTHER PROVISIONS INCIDENT AND RELATING TO THE SUBJECT; PROVIDING THAT SHOULD ANY SECTION OF OR PART OF ANY SECTION OF THIS ORDINANCE BE HELD VOID, THE REMAINING PORTION SHALL NOT BE AFFECTED; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY. and determined that such estimate and report as to ea­1h improvement unit was correct and adopted said AMR& estimate as the basis for levying the assessments for such street improvements, except as otherwise provided therein; and WHEREAS, the City Council of the City of Fort Worth has exarr-1 ,1-.1ed -into the rrianner and time of the giving and publishing of the notice of suc..h hearing and has found that due and legal notice of said hearing was duly, properly and legally given as required by law, said having been given by advertisement inserted at least three times prior to the date of such hearing in a news- pape • p�,tblished and of general circulation in the City of Fort Worth, Tarrant Cc�unty, Texas, the first of which publications was made at least ten days before the date of the hearing; and WHEREAS, said hearing was duly opened at the time and Place mentioned in said ordinance calling said hearing, and in the notices th.ere,,:,�f which were duly published; and WHEREAS, at said hearing all owners and all persons owning or claiming any Interest in or lien against arty property abutting the streets or avenues or portions thereof, hereinafter named, within the limits hereinafter defined, and all other inter- ested parties a.nd their agents and attorneys, desiring to contest said proposed assessment-s, the lien and liability thereof, the special benefits (,' f the abutting property and the owners thereof by means of said improvements, the accuracy, regularity, suffici- ency and validity of the proceedings in connection with such im- provements and the contracts therefor., and all matters with ref- erence thereto, were d7aly heard and their claims were duly con- sidered; A1015PI, WHEREAS, all errors, mistakes and other matters requiring rectificaticl)n, which were brought to the attention of the City Council, have been corrected; and WHEREAS, said City Council is of the opinion and finds that the proposed assessments as set out in the Engineer 's estimate and roll should be adjusted in those instances where the proposed improvements will abut property which is zoned residential or non- commercial so that the maximum assessment per front foot shall be at a rate no greater than $5.50 per front foot for curb, gutter and paving, and so that the assessment against any such lot which abuts any street sidewise for a distance of more than 100 feet shall be adjusted in such a manner so that no such lot shall be assessed at a rate greater than a residential lot ,which fronts on such a street for _100 feet; and WHEREAS, such adjustments have been made and are herein- after reflected it., this ordinance; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: Section 1 The City Council of the City of Fort Worth, Texas, hereby finds and determines that the assessments herein levied and the personal liabilities hereby declared are just and equitable, and that no assessment is made herein in any case against any parcel of property abuttIng any street or avenue or portion thereof to be im- proved in excess of' the special benefits of such property and its owners in the enhalylced value thereof by means of such proposed im- provements and that all proceedings in connection with such improve- ments and said assessments, including the contract for the construc- tion of the improvements, are in all respects regular and valid; and that the assessmerCits herein made against said properties abutting said streets, avenues or portions thereof and the real and true owners thereof are lawful, just and equitable; and in levying the same against the abutting properties and the owners thereof, the City Council adopts the apportionment set forth below and finds t-hat the division of the costs of said improvements between said abutting properties and the real and true owners thereof is lawful, just and equitable and provides substantial equality considering the benefits to be received and the burdens to be imposed thereby. Section 2 There being no further protests or testimony for or against or with reference to such improvements, benefits or proceed- ings, said hearing as to all units of improvement is hereby closed, and all protests and objections, whether specifically mentioned in the minutes of the hearing or not shall be and the same are hereby overruled and denied. Section 3 The respective itemized amounts hereinafter shown oppo- site the name or names of the person or persons hereinafter listed and opposite the description of the parcel or parcels of property hereinafter listed, which parcels of property abut the hereinafter listed streets or avenues or portions thereof of the City of Fort Worth, shall be and the same are hereby assessed., levied and charged against said respective properties hereinafter listed, and against the real and true owners of such respective properties, whether the real and true owners of such properties are correctly named below or not. Each such street or avenue or portion thereof of the City of Fort Worth which constitutes a unit of improvement is de- scribed below and there is shown the unit number given to each such unit. Each lot or parcel of property abutting on each such street or avenue or portion thereof is hereunder described whenever practicable by the Block number, if any, and by the Lot number of each such Block wherein such lot lies, and by the Addition or Sub- division, if any, wherein such lot in such block lies, in the City of Fort Worth, Tarrant County, Texas, as shown by the plats on file in the Office of the Assessor and Collector of Taxes of the City of Fort Worth and by the Plat and Deed Records of the County Clerk of Tarrant County, Texas, and by also referring to the units of im- provement in which the streets or avenues to be improved (which are abutted by said respective properties ) are situated; and the frontage of each of said lots or parcels of abutting property on the streets and avenues or portions thereof of the City of Fort Worth to be improved is shown hereunder in feet in the column head- ed "Frontage " and each such description and assessment shall be held to extend back from the property line abutting on said street or avenue or portion thereof to be improved, and to include the entire depth and area of each such respective parcel, lot or lots of abutting property as same were owned and bounded on the date the improvements were ordered by ordinances and notices of the en- actment thereof filed with the County Clerk of Tarrant County, Texas. Such descriptions of said property, the names of the owners thereof, where known, and said amounts respectively assessed against, said and said properties, all as corrected and adjusted by this City Cc,-I.-,,i-,�­,i1, ;al(l after allowing, the credit shown below for exist4_'.'!C, "111'.0 inl'111/:, - guttei, e,,cistinLz base abutting the properties oppc,,site which said curb and/or gutter and/or base is already laid, which credit is referred to below as "curb and/or gut,'-1-er credit, " all as follows, to-wit: - Section 4 It is hereby determined that no assessment is made in any case against any abutting property and the owners thereof in excess of the special benefits of such property and its owners in the en- hanced value thereof by means of such improvements as determined at said hearing. The amounts assessed against the various properties and the owners thereof" do not exceed the amounts which may be as- sessed under the Laws of the S"6ate of Texas, and the proceedings heretofore held with reference to such improvements and assessments, and do not exceed the estimates prepared by the City Engineer, and are approved and adopted 'by the City Council. Section 5 The amounts hereby assessed against the abutting properties and the owners thereof' shall be and become due and payable in five ( 5) equal (or as nearly equal as possible) installments as follows : The first of said instal1ments shall be due and payable on or before twenty ( 20) days from the date the improvements have been accepted by ordinance by the City in the unit in which the street or avenue which is abutted by the property assessed lies, and the four ( 4) re- maining installment,,.,; shall be due and payable on or before one (1) , two ( 2) , three ( 3) and four (4) years, respectively, from the date of such acceptance. Interest shall run on the unpaid principal bal- ance until paid t he date of the acceptance of such improvements in each such unit at the rate of six (6%) per cent per annum, which interest shall be diae and payable at the time the principal install- ments become due as above set out (or at the time of payment of such installments in the event of prepayment) . Past due principal and interest shall bear i.nterest at the rate of eight (8%) per cent per annum. If default Ls made in the payment of any installment of principal, or interest when due, then at the option of the holder of the special assessment certificate issued to evidence such assessment, the entire amount of such certificate shall be and become immediately due and payable, together with reasonable attorneys ' fees and court costs, if incurred. The severa,i sums above assessed, together with interest as specified, and costs of collection, including reasonable attorneys , fees, if incurred, are hereby declared and ordained to be secured by good and lawful on said respective parcels of abutting proper- ties and to be a personal liability of the respective owners thereof, whether correctly named or not, to be paid and collected as provided by law, and such assessments and liens against such abutting proper- ties sh'.,.11 be superior to all other liens and claims except State, County, School District and City ad valorem taxes . Cookingham Re: Paving Streets at 28 Locations City Manager (AP 59-17), Byron Street, Building Unit No. 23 - Benefit Hearing Dear Sir: A petition for the assessment paving of Byron Street from Rockwood Drive to Deering Street was received, signed by the owners of 65.9 per cent of the property along the street, which was two blocks long. This street was placed in a project as Unit No. 23 of a total of 28 locations, a contract was awarded, and the Benefit Hearing for the project is to be held on November 20, 1959. In the meantime, a petition was received against the paving on the south block of this unit, signed by the owners of 64.1 per cent of the property in this one block, and includes 282.5 feet of the total of 845.5 feet in this block that were represented on the original petition requesting the paving. The basis of this petition against the paving is that the property owners do not want to pay the cost assessed against the property, which is iA-83 per front foot. A copy of the petition and a plat of the street are attached. During 1957-58, at the insistence of the property owners, a storm drain was constructed to serve this area at a contract cost of q�161,757.69. In order for this storm drain to serve at its capacity, and to prevent sand and other debris from washing into and stopping up the inlets and pipe, the paving of the streets is necessary. It is felt that the paving of both blocks of Byron Street is desirable on this basis, and is in the best interest of both the City and the property owners. It should be pointed out, also, that the assessment of $4.83 per front foot, which is for curb and gutter, a portion of the excavation and the 7-1/2 inch crusher- run crushed limestone base with 1-1/2 inch hot mix asphaltic concrete surface, is the lowest assessment for this type of paving in a number of years, and is not out of order. Because of this, and because of the construction of the storm drain, it is recommended that Byron Street, Unit No. 23 of the project, "Paving on Various Streets at 28 Locations", should be paved as set out in the original petition and Ordinance. Thelin Director Public Works Department Fort Worth, Texas Ret paving Byron Street Dear Sirs I have been advised to write you a letter and outline to you the problems we have had in the past 12 years in regard to the water and street conditions . We presented a petition with 60% of the people in favor of the paving of our street. After the City Council studied the petition, they adopted an ordinance ordering the paving. Now we have a problem of a Mr . Davis and a few others who are getting up a petition asking that it not be paved . Mr . Deis lives on Churchill Road but he has two rent houses on Byron Street. The block we live on we have 13 out of 14 lots who want it paved. During the construction of Irma Marsh Jr . High School , they diverted the natural flow of water and run it down on us , also Clyde Mays cut a street up the hill into Melbourne Drive and it turned water on houses on Churchill , Byron and even went over to Palmetto Street . A group of us on Churchill and Byron Street in the 300 block hired Marvin Brown, Jr. , Attorney, to enter a suit against River Oaks and the City of bort Worth, we also hired a engineer out of Pree'se & Nichols and also a photographer who took pictures of the water damage. The enginserft report was the water had been diverted. We were not seeking money, we only wanted relief from the water. , we paid Marvin Brown, Jr . but he would never enter the suit. Hester , and maybe you Mr. Thelia , also Roscoe Minton and the River Oaks Department. we were told that nothing could 1N done at that time , but after the levees were built , then they would put in storm severs to take the water off. 'this has been completed, at a great cost , and it has certainly kept all the over flow water off of our lots. The *and off of the hill and also on Byron Street has stopped Up the storm sewers and the City has had to send wen out to clean thew out, they worked once for about a week as you know that cost the City and the taxpayers as well. fte street up by the schools will be paved before long , the City will have the same problem on Byron Street. The street has to be graded after each rain which costs money. I have been advised that the City can order a street be paved if everybody protests the paving . I believe the City Council and you, Hr. Thelin after bowing the cost the city has went to for us out here and the cost of maintaining the dirt street, would feel fully justified in ordering this street paved regardless of the protests . I was advised that by writing this letter to you Mr. Thelin, that you would have time to read it and pass it on to the Couaeil, thereby you would have something to go on when the Council takes this problem up at their next jpeetinj . Cookingham Re: Paving Streets at 28 Locations City Manager (AP 59-17), Xay Street, Unit Building No. 3 Dear Sir: A petition for the assessment paving of Aay Street from Bewick S�reet to -­e ,e dead-end north of Devitt Street, as shown on the attached plat, was _- -eived, and was subsequently placed in a project as Unit No. 3 of 28 locations. A contract has been awarded and the Benefit hearing for the project is to be held on November 20, 1959. However, on November 9, 1959, a petition was received against the paving of the portion of liay Street from Devitt Street to the dead-end to the north on the grounds that the street would prevent any access directly into Berry Street on Play Street. At the present time, there is a gravel road on private property that is being used to provide this access. Signers of this petition represent 78.6 per cent of the property footage in this block. 'When the petition for the paving was received, several discussions were held between this Department) the Traffic Engineering Department, and Mr. W. h. Greenwood for the property owners in order to work out the most acceptable route of this portion of May Street. The property owners desired that the street be opened into Berry Street as stated above, but this Department and the Traffic Engineering Department concurred in recommending that this not be permitted because of a possible traffic hazard due to the close proximity of the railroad and the other intersecting streets. The City Council on January 9, 1957, accepted our report in this regard. The plan for the project is that a turn-around be constructed at the north end of the block so that any traffic in the area would not have to use private driveways to turn around, and would not be required to drive across private property to reach Berry Street. This will require the purchase of some right- of-way which will be secured if the property owners sign up to pay the assessments for the pavin`. r 4 L. P. Cooiringham Page Two November 16, 1959 The owners of the property along Devitt Street between May Street and Saint Louis Avenue have indicated a desire to pave this portion of Devitt Street. Should this street be paved, it will provide access from May Street to Saint Louis Avenue and on to Berry Street on paved streets, and will greatly help the traffic conditions in the area. However, even though Devitt Street may be paved, it is felt that all of May Street should be paved in order to provide as many paved streets in this "J-Light Industrial's area as possible. Several requests for grading of May Street north of Devitt Street have been received in the past, particularly after rains. Yours very truly, C. X.
