AN ORDINANCE AMENDING ORDINANCE NO. 3011 , BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AT. FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011 ; PRE- SCRIBING A SAVINGS CALUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE- IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH , TEXAS: SECTION 1 . That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described areas be altered, changed and amended as follows to wit: Z-65-191 East one-half of Lot 3, H. M. Lewis Subdivision of Block 1 , Baldwin Addition (Rear of 311 Rand Street) FROM "B" TO "Ell Z-65-192 Tracts 1 , 2, 5, 6A, 6B, 6C, 6D, 6E, 6F and 6 (City Tax Records ) W. H. Hudson Survey more fully described as follows ; and a portion of Blocks T-1 and 2-1 , Carver Heights Addition and Lots I thru 13, Block 3, and Block 3B, Rosedale Park Addition Beginning at a point in the East line of Lot 1 , Block 3, Rosedale Park Addition to the City of Fort Worth, said point being 51 .8 feet South from the Northeast corner of Lot 1 , Block 3, said point also being in the South line of Hart Street; Thence South along the East line of said Block 3, in all 509.8 feet to an iron for corner in the North right-of-way of State Highway 303, said iron being in the West line of Block Z-1 , Carver Heights Addition; Thence Easterly along the North line of said Highway South 82'31 ' East 16.5 feet, North 87035' East 198.9 feet, East 92.2 feet, South 77'35 ' East 108.2 feet, South 89c'14' East 498.1 feet; North 82029' East 101 .4 feet, South 88'45' East 100 feet and South 75'18' East 37 feet to an iron pin for corner; Thence North to and along the East line of Tracts I and 2 a distance of 568 feet to a point for corner, said point being in the North line of said Hudson Survey, North 89'51 West 236.2 varas from the Northeast corner of said survey; Thence North 89'51 ' West along the North line of said survey 326.7 feet to an iron pin; Thence South 0007' West 50.9 feet to an iron pin; Thence South 89'58' West along the South line of said Hart Street 824. 2 feet to the point of beginning and containing 13.8 acres of land, more or less . The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed to lessen congestion in the streets ; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use if land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. This ordinance will take effect and be in full force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM AND LEGALITY: CITY ATTORNEY Adopted:
