HomeMy WebLinkAboutOrdinance 6200 ORDINANCE NO . � 0 AN ORDINANCE PROVIDING THAT THE PORTION OF MONT- GOMERY STREET ADJACENT TO BLOCK 18, ROSS HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUN'T'Y, TEXAS, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF TIC INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1. That the portion of Montgomery Street adjacent to Block 18, Ross Heights Addition to the City of Fort Worth, Tarrant County, Texas , described as follows : A tract of land in the City of Fort Worth, Tarrant County, Texas, embracing a portion of the former Byers Avenue closed by Ordinance No. 3589 and a part of the tract conveyed to Double Seal Ring Company by deed recorded in Vol. 2906, page 549, of the Deed Records of Tarrant County, Texas, more particularly described as follows : Beginning at an iron in the south line of Lot 20 in Block 18 of Ross Heights Addition and 10 feet east from the southwest corner of said Lot 20; Thence south 23 degrees 56 minutes east 52-72/100 feet to an iron in the south line of said former Byers Avenue and the north line of said tract in the T. White Survey; Thence south no degrees 49 minutes east 29 feet to an iron; Thence north 61 degrees 31 minutes west 23--5/10 feet; Thence north 1 degree west 66 feet to the place of beginning, and containing 975 square feet. , be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or char- acter whatever, save and except that the vacated right-of-way is retained for any and all existing utilities . SECTION 2 . That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall re- vert to the adjacent owner of the fee as provided by law. SECTION 3 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. The area requested to be vacated �s described. as follows: A tract in Fort Worth in Tarrant County, Texas , and embracing a portion of the farmer Byers Avenue closed by Ordinance No. 3589 and a part of the tract conveyed to Rouble Seal Ring Company by the deed recorded in volume 2906, page 549 of the Tarrant County Deed Records. Beginning at an iron in the south line of Lot 20 in Block 18 of Ross Heights Addition and 10 feet east from the southwest corner of said Lot 20. Thence south 23 degrees-56 minutes east 52-72/100 feet to an iron in the south line of said former Byers Avenue and the north line of said tract in the T. White Survey; Thence south no degrees-49 minutes east 29 feet to an iron.. Thence north 61 degrees-31 minutes west 23-5/10 feet. Thence north 1 degree west 66 feet to the place of beginning and con- taining 975 square feet. Subject right-of-way, acquired by dedication, is not paved. This request is made to provide additional yard and parking area. City Departments and private utility companies have reviewed this request and have no objection to this vacation provided the Applicant plats the vacated right- of-way with adjoining property and retains an easement for existing utilities. The City flan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested, subject to the con- ditions recommended above by the City Departments and private utility companies. The Applicant has submitted a satisfactory replat. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Flan Commission.
