AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. 56722
WHEREAS, the City of Fort Worth (CITY) and Garver, LLC,
(ENGINEER) made and entered into City Secretary Contract No.
56722 , (the CONTRACT) which was authorized by M&C 21-0876 on the
9tn day of November, 2021 in the amount of $217,498 . 00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Water and Sanitary Sewer Replacement Contract 2019, WSM-N;
WHEREAS , it has become necessary to execute Amendment No. 1
to the CONTRACT to include an increased scope of work and revised
fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives , enter into the
following agreement, which amends the CONTRACT:
1 .
Article I of the CONTRACT is amended to include the
additional engineering services specified in proposal attached
hereto and incorporated herein. The cost to City for the
additional design services to be performed by Engineer totals
$71,325. 00.
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be an
amount of $288,823. 00.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Dear Mr. Norwood and Ms. Poudyal:
Enclosed with this letter is the request for Amendment 1 for the above referenced project.
Upon completion of the 30%workshop, it was identified that water utilities located in the vicinity of the
project area to be in poor condition and original infrastructure dating more than 50 years old. On May
101h, 2022, the City provided correspondence directing the inclusion of the identified infrastructure for
replacement and to be included in the design package of the project.
The proposed additional infrastructure is shown in the table below:

Garver proposes to incorporate survey work recently performed as part of the project that overlaps
the proposed improvements along with additional field survey where no recent field survey exists.
Garver will also conduct record drawing and utility research in the proposed improvement areas to
identify utility conflicts and challenges.
The proposed improvements are located in the existing City right of way and no additional easements
are anticipated. Coordination and detailed efforts will be required to determine the approach to
isolate and replace the 24-inch water line.

Upon acceptance and approval of this amendment Garver will immediately mobilize the surveyor and
conduct design efforts with the intent of including the amendment improvements in the overall 60%
deliverable package.
It is anticipated that this work will be conducted alongside the project basic scope of services at the
60% deliverable package till project completion and no separate bid package will be created.
The proposed fee and increase to the Contract is detailed in the table below:

Water and Sanitary Sewer Replacement Contract 2019, WSM-N, Located in the Westcliff Addition Area,
and Effect a Portion of Water's Contribution to the Fiscal Years 2022-2026 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated
receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$71,325.00,
transferred from available funds within the Water and Sewer Fund, for the purpose of funding the Water
and Sanitary Sewer Replacement Contract 2019, WSM-N (City Project No. 103358) and effect a portion
of Water's contribution to the Fiscal Years 2022-2026 Capital Improvement Program.
DISCUSSION:
On November 09, 2021, Mayor and Council Communication (M&C) 21-0876, the City Council authorized
an engineering agreement in the amount of$217,498.00 with Garver, LLC. (City Secretary Contract No.
56722) and an additional $117,975.00 for related expenses for a project total of$335,473.00 for the
Sanitary Sewer Replacement Contract 2019, WSM-N.
The additional appropriations in this M&C will provide for funding costs associated with proposed
Amendment No. 1 to the engineering agreement in the amount of$71,325.00 for additional survey and
design for the replacement of deteriorated water and sanitary sewer mains on the following streets
located in the immediate vicinity of the project:

It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of
within the annual budget ordinance, as projects commence, additional funding needs are identified, and
to comply with bond covenants. The actions in the M&C will appropriate funds in support of the Water's
portion of the City of Fort Worth's Fiscal Years 2022-2026 Capital Improvement Program, as follows:

FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Water& Sewer Fund and upon
approval of the above recommendation and adoption of the attached appropriation ordinance, funds will
be available in the W&S Capital Projects Fund for the Contract 2019 WSM-N project. Prior to any
expenditure being incurred, the Water Department has the responsibility to validate the availability of
funds.
