HomeMy WebLinkAboutOrdinance 25684-09-2022 ORDINANCE NO.25684-09-2022 AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2018 BOND PROGRAM FUND IN THE AMOUNT OF $162,350.00, BY INCREASING APPROPRIATIONS IN THE BUSINESS 287 AT NORTHSIDE DRIVE PROJECT (CITY PROJECT NUMBER 103641), AND DECREASING APPROPRIATIONS IN THE TRAFFIC SIGNALS PROGRAMMABLE PROJECT (CITY PROJECT NUMBER PB0006) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be adjusted appropriations in the 2018 Bond Program Fund in the amount of$162,350.00,by increasing appropriations in the Business 287 at Northside Drive Project(City Project Number 103641), and decreasing appropriations in the Traffic Signals programmable project(City Project Number PB0006)by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance adjusting appropriations in the 2014 Bond Program Fund in the amount of$150,551.00,by increasing appropriations in the State Highway 183 at Green Oaks Road Project(City Project Number 103640)and decreasing appropriations in the Fund 34014 Approp Only Project(City Project No. U34014)by the same amount; 2. Adopt the attached appropriation ordinance adjusting appropriations in the 2014 Bond Program Fund in the amount of$173,420.00, by increasing appropriations in the Business 287 at Northside Drive Project(City Project Number 103641)and decreasing appropriations in the Fund 34014 Approp Only Project(City Project No. U34014)by the same amount; 3. Adopt the attached appropriation ordinance adjusting appropriations in the 2018 Bond Program Fund,by increasing appropriations in the State Highway 183 at Green Oaks Road Project(City Project Number 103640)in the amount of$158,000.00 and decreasing appropriations in the Traffic Signals programmable project(City Project No. PB0006)by the same amount; 4. Adopt the attached appropriation ordinance adjusting appropriations in the 2018 Bond Program Fund, by increasing appropriations in the Business 287 at Northside Drive Project(City Project Number 103641) in the amount of$162,350.00 and decreasing appropriations in the Traffic Signals Programmable project(City Project No. PB0006)by the same amount;and 5. Amend the Fiscal Year 2022-2026 Capital Improvement Program. DISCUSSION: The Texas Department of Transportation(TxDOT)approved funding to construct six Highway Safety Improvement Projects in November 2021.The projects include the design and construction of traffic signals,turn lanes,and pedestrian facility improvements at six intersections within the City. The City will fund design engineering,right of way, utility relocations,environmental studies,and project management for these projects,of which three are being advanced through this M&C. The collective$498,390.00 appropriated in this Mayor and Council Communication (M&C)will fund the following three projects through final design.The funding for the preliminary design of all the six intersections has already been appropriated. The following table summarizes the funding for State Highway 183 at Green Oaks Road project: Fund Existing Additional Project Funding Funding Total 34014-2014 $0.00 $150,551.00$150,551.00 Bond Program Fund 34018-2018 $136,000.00 $0.00 $136,000.00 Bond Program Fund Project Total $136,000.00 $150,551.00 $286,551.00 The following table summarizes the funding for Business 287 at Northside Drive project: Fund Existing Additional Project Funding Funding Total 34014-2014 $0.00 $173,420.00 $173,420.00 Bond Program Fund 34018-2018 $140,350.00 $0.00 $140,350.00 Bond Program Fund Project Total $140,350.00 $173,420.00 $313,770.00 Approval of recommendations 3-4 would adjust appropriations between a programmable project and convert the State Highway 183 at Green Oaks Road project and the Business 287 at Northside Drive project into static capital projects.This action is needed as future funding for the State Highway 183 at Green Oaks Road project and the Business 287 at Northside Drive project is anticipated from other funding sources and the scope of this project differs from that of the current programmable project. Approximately$323,973.88 is available in the 2014 Bond Intersections Unspecified Project and$585,237.91 in the 2018 Bond Traffic Signals Unspecified Project.Adopting these appropriation ordinances totaling$498,390.00 will reduce the available amount in 2014 Bond Intersections Unspec to$2.88 and in the 2018 Bond Traffic Signals PB0006 to$410,818.91.The funding for these projects was not included in the Fiscal Year 2022-2026 Capital Improvement Program because these projects were not identified for funding by TxDOT at the time the Capital Improvement Program plan was developed.The action in this M&C will amend the Fiscal Year 2022-2026 Capital Improvement Program as approved in connection with Ordinance 25073-09-2021. These projects are located in COUNCIL DISTRICTS 2,3,and 4. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Fund 34014 Approp Only project within the 2014 Bond Program Fund and available in the Traffic Signals project within the 2018 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the SH0183 at Green Oaks Rd, BUS0287 at Northside Dr and SH0183 at N Beach St projects.Prior to an expenditure being incurred,the Transportation and Public Works Department has the responsibility of verifying the availability of funds.
