Home My WebLink AboutOrdinance 25704-09-2022 ORDINANCE NO.25704-09-2022 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $989,711.00, TRANSFERRED FROM AVAILABLE FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE WATER AND SANITARY SEWER REHABILITATION ON DESIGN SERVICES CONTRACT 2020 PROJECT (CITY PROJECT NO. 103324); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$989,711.00,transferred from available funds in the Water and Sewer Fund,for the purpose of funding the Water and Sanitary Sewer Rehabilitation on Design Services Contract 2020 project(City Project No. 103324). SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with William J.Schultz, Inc.dba Circle C Construction Company,in the amount of$808,115.57 for the Water and Sanitary Sewer Rehabilitation on Design Services Contract 2020 project;and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$989,711.00,transferred from available funds within the Water and Sewer Fund,for the purpose of funding the Water and Sanitary Sewer Rehabilitation on Design Services Contract 2020 project(City Project No. 103324)to effect a portion of Water's contribution to the Fiscal Years 2022-2026 Capital Improvement Program. DISCUSSION: This Mayor and Council Communication(M&C)is to authorize a construction contract with William J.Schultz,Inc.dba Circle C Construction Company for the replacement of the deteriorated water and sanitary sewer main located in the following easements: Location From To Scope of Work Easement between Mistflower Lane Penscola Ewing (private street)and Leafsage Lane Avenue(public Avenue Water/Sewer (private street) street) (public street) Easement between Pensacola Avenue Leafsage Lane 180 LF West Sewer and Ewing Avenue (private street) The project was advertised for bids on June 16,2022,and June 23,2022,in the Fort Worth Star-Telegram.On July 28,2022,the following bids were received: Bidder Amount Time of Completion William J.Schultz,Inc.dba Circle C 120 Construction Company $808,115.57 Calendar Days In addition to the contract amount,$100,784.42(Water:$41,508.59;Sewer:$59,275.83)is necessary for project management, inspection and material testing and$80,811.00(Water:$34,304.00;Sewer:$46,507.00)is provided for project contingencies.The sewer component of this project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. This project will have no impact on the Water Department's operating budgets when completed. Business Equity: William J.Schultz,Inc.dba Circle C Construction Company,is in compliance with the City's Business Equity Ordinance by committing to seven percent Business Equity participation and documenting good faith effort.William J.Schultz, Inc.dba Circle C Construction Company identified several subcontracting and supplier opportunities. However,the firms contacted in the areas identified did not respond or did not submit the lowest bids.The City's Business Equity goal on this project is 12 percent. The project is located in COUNCIL DISTRICT 3. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are available in the Water&Sewer Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the W&S Capital Projects Fund for the Design Services Contract 2020 project to support the approval of the above recommendations and execution of the contract.Prior to any expenditure being incurred,the Water Department has the responsibility of verifying the availability of funds.
