Ordinance No. 1 7 1 31-08-2006 AN ORDINANCE INCREASING APPROPRIAT[ONS [N THE ENVIRONMENTAL MANAGEMENT OPERATING FUND IN THE AMOUNT OF $400,000 AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE ENVIRONMENTAL MANAGEMENT PROJECTS FUN^ TO EXECUTE A CONTRACT WITH ENERCON SERVICES, INC. FOR ENVIRONMENTAL AND ENGINEERING SERVICES FOR MISCELLANEOUS PROJECTS; PROVIDING FOR A SEVERAi31LITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased appropriations in the Environmental Management Operating Fund in the amount of $400,000 and decreasing the unreserved, undesignated fund balance by the same amount, for the purpose of transferring said funds to the Environmental Management Projects Fund to execute a contract with Enercan Services, Inc. for environmental and engineering services far miscellaneous projects. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in thane instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental Management Operating Fund (R103) by $ 400,000.00 and decreasing the unreserved, undesignated fund balance fram available funds; 2. Approve the transfier of $400,000.00 in undesignated funds fram the Environmental Management Operating Fund to the Environmental Management Project 1=und (R101}; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $400,000.00; and 4. Authorize the City Manager to execute a contract with Enercon Services, Inc., far enviranmental and engineering services far miscellaneous projects not to exceed amount of $400,000.00 per year. The contract services will be performed on an as-needed basis far a period of one year with two one-year renewal options. ©IISCUSSION: The City's compliance with state and federal environmental regulations for the Clean Air Act, Clean Water Act, hazardous waste issues, the City's petroleum storage tank remediation program and other environmental projects requires that the various projects be completed in a timely manner. To facilitate the City's compliance, the services of an environmental and engineering consulting firm are required. The City has contracted for enviranmental and engineering services since 1989. Over the years, services have included oversight of various site cleanupslclasures, upgrade and replacement of City-owned underground storage tanks, groundwater monitoring at contaminated sites, site assessments, corrective action plans, reviews of various structural storm waterlfiood control devices, spill prevention control and countermeasures plan preparation, review and certification, remediation system design, air modeling, air sampling and coordination with the State to develop clean-up strategies. Projects planned for the taming year include: o Voluntary Cleanup Program (VCP) site assessments, monitoring and reporting to the Texas Commission on Environmental Quality at five actives sites; a Texas Risk Reduction Program (TRRP} and former Leaking Petroleum Storage Tank (LPST) site assessments, monitoring and reporting to the TCEQ at four active sites; Lognazxze: 52ENERCON Page 1 of 3 ® Professional consulting services regarding Nitrogen Oxide (NOX) reductions at city owned airports; . Site assessments far the SH'121 expansion project; and ~ Other projects as they arise during the course of business. A Request far Qualifications was advertised an May 1, 2006. Responses were submitted by the following eleven firms on June 1, 2006: ATC Associates, lne. Camp, Dresser & McKee, lnc. Carter & Burgess, lnc. ECS ~- Texas, LLP Enercon Services, Inc. ENSRIAECOM Freeze & Nichols, Inc. SC5 Engineers Shaw Environmental and Infrastructure, Inc. IJRS Corporation W & M Environmental Group The qualifications packages were evaluated based an apre-determined combination of qualitative and quantitative {point) measures. These measures included, but were not limited to, experience, qualifications, legal history and work history. Based on the total point distribution of the measures, four firms were selected to make oral presentations. City staff recommends the contract be awarded to Enercon Services, Inc., because of their broad experience and innovative approach to solving environmental issues. Their experience includes: a Extensive knowledge of the Texas Risk Reduction Program (TRRP) and Petroleum Storage Tank (PST) rules and regulations; ~ Several Voluntary Cleanup Program (VCP) and ]nnocent OwnerlOpera#ar Program (IOP) site applications, assessments, monitoring efforts and/ar closures; Phase I ESA work on commercial, industrial, residential and undeveloped lands; ® Phase ll ESA work including sail, water and air sampling for a range of contaminants including, but not limited to, volatile organic compounds, hydrocarbons, metals, pesticides, herbicides, etc.; ® Spill Prevention Control and Countermeasure (SPCC} Plan development and implementation; e National Environmental Protection Act (NEPA} Categorical Exclusion and Environmental Assessment work including report preparation, submittal and approval with the applicable federal agency; and ® Air pollution experience including emissions source testing and calculation for compliance with and development of, air permit information. RENEWAL OPTIONS -This contraG# may be renewed for up to two successive one-year terms at the City's option. Renewal may be effective by notice in writing by the City Manager or his designated representative to the contractor within 30 days of the expiration of the prior term. This action does not require specific City Council approval, provided that the City Council has appropriated sufficient funds to satisfy the City`s nbligatians during the renewal term. Enercon Services, Inc., is in compliance with the city's M/WBE Ordinance by committing to 16% M/WBE participation. The City's goal on this project is 15%.
