AUTHORIZING AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $596,796.00, WITH
FEDERAL PARTICIPATION IN THE AMOUNT OF $316,219.00, STATE
PARTICIPATION IN THE AMOUNT OF $100,448.00 AND LOCAL
PARTICIPATION IN THE AMOUNT OF $180,129.00, FOR ENGINEERING,
ENVIRONMENTAL SERVICES AND CONSTRUCTION OF BUS287 AT NORTHSIDE
DRIVE HIGHWAY SAFETY IMPROVEMENT PROJECT
WHEREAS, federal law establishes federally funded programs for transportation improvements
to implement its public purposes, and
WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall
design, construct and operate a system of highways in cooperation with local governments, and Section
222.052 authorizes the Texas Transportation Commission to accept contributions from political
subdivisions for development and construction of public roads and the state highway system within the
political subdivision, and
WHEREAS, federal and state laws require local governments to meet certain contract standards
relating to the management and administration of State and federal funds, and
WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56
that describe federal, state, and local responsibilities for cost participation in highway improvement and
other transportation projects, and
WHEREAS, the Texas Transportation Commission passed Minute Order Number 115814
authorizing the State to undertake and complete a highway improvement or other transportation project
generally described as construct intersection improvements; and
WHEREAS, the City of Fort Worth identified the need for signal rebuild including Audible
Pedestrian System (APS), Flashing Yellow Arrow (FYA) for
northbound/southbound/eastbound/westbound left turns, construct raised median for westbound
approach for access management with QT gas station, construct American with Disabilities Act (ADA)
ramps, refresh existing markings, and install advance signal warning signs for the westbound and
northbound approaches; and
WHEREAS, the City of Fort Worth and Texas Department of Transportation have
negotiated terms of an Advance Funding Agreement in the amount of $596,796.00, with
federal participation in the amount of $316,219.00, state participation in the amount of
$100,448.00 and local participation in the amount of $ 180,129.00, for engineering,
environmental services and construction of BUS287 at Northside Drive highway safety
improvement project improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, THAT:
The City Manager is hereby authorized to execute an Advance Funding Agreement
with the Texas Department of Transportation (CSJ: 0014-01-028) in the approximate
amount of $596,796.00, with federal participation in the amount of $316,219.00, state
participation in the amount of $100,448.00 and local participation in the amount of
$180,129.00, plus cost overruns, for engineering, environmental services and construction
of BUS287 at Northside Drive highway safety improvement project improvements.
Adopted this 27th day of September 2022.

Improvement Project(2018 Bond Program)
RECOMMENDATION:
It is recommended that the City Council adopt the attached Resolution authorizing execution of an advance funding agreement(CSJ#0014-01-
028)with the Texas Department of Transportation in the amount of$596,796.00,of which$180,129.00 is City participation for the Business United
States Highway 287 at Northside Drive Highway Safety Improvement project(City Project No. 103641).
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement
(AFA)with the Texas Department of Transportation(TXDOT)in the amount of$596,796.00,of which federal participation in the amount of
$316,219.00, state participation in the amount of$100,448.00 and$180,129.00 is City of Fort Worth's(City) participation for the Business United
States(BUS) Highway 287 at Northside Drive Highway Safety Improvement project(City Project No. 103641).
The scope of this project includes signal rebuild including Audible Pedestrian System(APS), Flashing Yellow Arrow(FYA)for northbound/
southbound/eastbound/westbound left turns,construct raised median for westbound approach for access management with QT gas station,
construct American with Disabilities Act(ADA) ramps, refresh existing markings,and install advance signal warning signs for the westbound and
northbound approaches.
This project will be led by TXDOT in June 2023.The State will be responsible for securing the federal and State share of the funding required for
the development and construction of the project. City funds have been appropriated to this project for design, right-of-way, utilities and project
management purposes.The City bears the responsibility to pay for cost overruns.

This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt
is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No.23209-05-2018)
and subsequent actions taken by the Mayor and Council.
Funding for the required City participation will be from the 2014&2018 Bond Programs of which a portion of this funding will be appropriated to
the project in a separate M&C.
This project is located in COUNCIL DISTRICT 2.
A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:

FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget,as previously appropriated,in the 2014 Bond Program Fund
and the 2018 Bond Program Fund for the BUS287 at Northside Dr project to support the approval of the above recommendation and execution of
the advance funding agreement. Prior to any expenditure being incurred,the Transportation&Public Works Department has the responsibility to
validate the availability of funds.
