Ordinance No. 17132-08-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT PROJECTS FUND IN THE AMOUNT OF $400,000 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH ENERCON SERVICES, INC. FOR ENVIRONMENTAL AND ENGINEERING SERVICES FOR MISCELLANEOUS PROJECTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addifion to those amounts allocated to the various City departments for Fiscal Year 2005- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Projects Fund in the amount of $400,000 from available funds for the purpose of executing a contract with Enercon Services, Inc. far environmental and engineering services for miscellaneous projects. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18582 and all other ordinances and appropria#ions amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances -and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental Management Operating Fund (R103) by $ 400,000.00 and decreasing the unreserved, undesignated fund balance from avaiiable funds; 2. Approve the transfer of $400,000.00 in undesignated funds from the Environmental Management Operating Fund to the Environmental Management Project Fund (R101); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in fhe Environmental Management Project Fund by $400,000.00; and 4. Authorize the City Manager to execute a contract with Enercon Services, lnc., far environmental and engineering services for miscellaneous projects not to exceed amount of $400,000.00 per year. The contract services will be performed an an as-needed basis for a period of one year with two one-year renewai options. DISCUSSION: The City's compliance with state ahd federal environmental regulations for the Clean Air Act, Clean Water Act, hazardous waste issues, the City's petroleum storage tank remediatian program and other environmental projects requires that the various projects be completed in a timely manner. To fiacilitate the City's compliance, the services of an environmental and engineering consulting i:lrm are required. The City has contracted for environmental and engineering services since 1989. Over the years, services have included oversight of various site cleanupslciosures, upgrade and replacement of City-owned underground storage tanks, groundwater monitoring at contaminated sites, site assessments, corrective action plans, reviews of various structural storm water/flood control devices, spill prevention control and countermeasures plan preparation, review and certification, remediatian system design, air modeling, air sampling and coordination with the State to develop clean-up strategies. Projects planned for the coming year include: ~ Voluntary Cleanup Program (VCP) site assessments, monitoring and reporting fo the Texas Commission on Environmentai Quality at five actives sites; Texas Risk Reduction Program (TRRP} and former Leaking Petroleum Storage Tank (LPST} site assessments, monitoring and reporting to the TCEQ at four active sites; Lognarrie: 52ENERCON Page 1 of 3 ® Professional consulting services regarding Nitrogen Oxide (NOX} reductions at city owned airports; ® Site assessments for the SH121 expansion project; and . Other projects as they arise during the course of business. A Request for Qualifications was advertised on May 1, 2006. Responses were submitted by the fioilowing eleven firms an June 1, 2006: ATC Associates, inc. Camp, Dresser & McKee, [nc. Carter & Burgess, Inc. ECS -Texas, LLP Enercon Services, Inc. ENSRIAECOM i=reeze & Nichols, Inc. SCS Engineers Shaw Environmental and Infrastructure, inc. URS Corporation W & M Environmental Group The qualifications packages were evaluated based on apre-determined combination of qualitative and quantitative (point) measures. These measures included, but were not limited to, experience, qualifiications, legal history and work history. Based on the total point distribution of the measures, four firms were selected to make oral presentations. City staff recommends the contract be awarded to Enercon Services, Inc., because of their broad experience and innovative approach to solving environmental issues. Their experience includes: ® Extensive knowledge of the Texas Risk Reduction Program (TRRP} and Petroleum Storage Tank (PST) rules and regulations; ® Several Voluntary Cleanup Program (VCP} and Innocent OwnerlOperator Program (IOP) site applications, assessments, monitoring efforts andlor closures; Phase I E5A work on commercial, industrial, residential and undeveloped lands; ® Phase II ESA work including soil, water and air sampling for a range of contaminants including, but not limited to, volatile organic compounds, hydrocarbons, metals, pesticides, herbicides, etc.; ® Spill Prevention Control and Countermeasure (SPCC) Plan development and implementation; National Environmental Protection Act {NEPA) Categorical Exclusion and Environmental Assessment work including report preparation, submittal and approval with the applicable federal agency; and ~ Air pollution experience including emissions source testing and calculation for compliance with and development nf, air permit information. RENEWAL OPTIONS ~- This contract may be renewed far up to two successive one-year terms at the City's option. Renewal may be effective by native in writing by the City Manager or his designated representative to the contractor within 30 days of the expiration of the prior term. This action does oat require specific City Council approval, provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term. Enercon Services, inc., is in compliance with the City's MIWBE Ordinance by committing to 15% M/WBE participation. The City's goal on this project is 15%.
