A RESOLUTION DETERMINING THE NECESSITY FOR ACQUIRING REAL
PROPERTY AND AUTHORIZING ITS APPROPRIATION OR
CONDEMNATION FOR PUBLIC USE
WHEREAS,the Fort Worth City Council on September 27, 2022, in M&C 22-0787, ordered and
decreed that a public necessity existed to acquire 0.395 acres in permanent water facility easements from
real property located at 9857 and 9965 Saginaw Boulevard in the Benjamin Thomas Survey,Abstract No.
1497, Tracts 4804 and 4B07, Tarrant County, Texas, as described in the exhibits attached to the above-
referenced M&C; those exhibits are incorporated herein for all purposes (the "Property");
WHEREAS,the Fort Worth City Council has determined that:
- the Property is needed for the Northside IV 24" Water Main Phase 1B project (the "Project")
that will provide water to new development in the northern part of the City of Fort Worth;
- the land rights in the Property are needed for new water line facility improvements;
- public necessity required the acquisition by condemnation of the Property, located within the
alignment of the Project;
- the use of the Property will be a public use; and
- the Real Estate Division of the Property Management Department is authorized to acquire by
negotiation the Property needed for the Project.
WHEREAS, negotiations between the City of Fort Worth and the property owner, E-Steel II,
LLC, were unsuccessful due the inability to negotiate agreeable terms for the property interests being
acquired by the City of Fort Worth; and
WHEREAS, on this 27th day of September, 2022, at a regular meeting of the Fort Worth City
Council, upon Motion of Councilmember Firestone, to wit:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of
eminent domain to acquire 0.395 acres in permanent water facility easements from real property owned
by E-Steel II, LLC. The property interests are needed for the Northside IV Water Transmission Main
project, a public use that will provide water to new development in the northern part of the City of Fort
Worth. The land rights in the subject properties are needed for the construction, operation, maintenance,
replacement, upgrade and repair of the permanent water line,facility as necessary. The properties are
located at 9857 and 9965 Saginaw Boulevard in the Benjamin Thomas Survey,Abstract No. 1497,Tracts
41304 and 41307, Tarrant County, Texas. The property interests to be acquired are described by metes
and bounds and depicted by survey exhibits attached to this Mayor and Council Communication."
Seconded by Councilmember Bivens,duly put and carried:RESOLUTION.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH,TEXAS THAT:
The City of Fort Worth, Texas, is authorized to use the power of eminent domain to acquire the
Property for the public use and inclusion in the Project; and
The City Attorney be and is hereby authorized and directed to file or cause to be filed,to spend all
reasonable and necessary legal expenses, and to carry through to final judgment proceedings in eminent
domain for the acquisition of the property interest listed above and attached to the M&C.

WATER FACILITY EASEMENT
Being part of the Benjamin Thomas Survey, Abstract No. 1497, situated in the City of Fort
Worth, Tarrant County, Texas and being a portion of a called 6.466 acre tract of land conveyed
to E-STEEL II LLC, as described in Instrument Number D209280915 of the Official Public
Records of Tarrant County, Texas(O.P.R.T.C.T.), hereinafter referred to as E-Steel Tract 1, and
being more particularly described as follows:
COMMENCING at a capped iron rod with red cap stamped "KHA" found for the southeast
corner of a tract conveyed to JLM OF TAMPA INC by Instrument Number D220323937
(O.P.R.T.C.T.), hereinafter referred to as JLM Tract 1 and in the northeast corner of a called
5.986 acre tract of land conveyed to E-STEEL STEEL II LLC, as described in Instrument
Number D209280915 (O.P.R.T.C.T.), hereinafter referred to as E-Steel Tract 2, said point also
being in the west right of way line of U.S. Highway No. 287 (Business) also from which a
capped iron rod with red cap stamped "KHA" found for the northwest corner of a 5.0 acre tract
conveyed to ASPS HOLDINGS LLC by Instrument Number D211080927 (O.P.R.T.C.T.) bears
S 89°26'20" W, a distance of 1355.39 feet, said iron rod with red cap stamped "KHA" also being
the northwest corner of E-Steel Tract 1 and being in the east line of a tract of conveyed to
LENNAR HOMES OF TEXAS LAND AND CONSTRUCTION LTD by Instrument Number
D220319529 (O.P.R.T.C.T.);
THENCE S 89026'20" W, along the south line of JLM Tract 1 and the north line of E-Steel Tract
2, a distance of 607.86 feet to a 1/2" iron rod with plastic cap stamped " BRITATIN AND
CRAWFORD" in the south line of JLM Tract 1 and the northwest corner of E-Steel Tract 2 and a
northeast corner of a tract conveyed to JLM OF TAMPA INC by Instrument Number
D196090409 (O.P.R.T.C.T.), hereinafter referred to as JLM Tract 2;
THENCE S 00034'00" E, departing the south line of JLM Tract 1 and along the east line of JLM
Tract 2 and the west line of E-Steel Tract 2, a distance of 379.28 feet to a 1/2" iron rod found for
the POINT OF BEGINNING said point being in the east line of JLM Tract 2 the southwest corner
of E-Steel tract 2 and the northwest corner of E-Steel Tract 1;

RECOMMENDATION:
It is recommended that the City Council:
1. Declare that negotiations between the City and the property owner to acquire 0.395 acres in permanent water facility easements from real
property owned by E-Steel II,LLC,located at 9857 and 9965 Saginaw Boulevard in the Benjamin Thomas Survey,Abstract No. 1497,
Tarrant County,Texas,were unsuccessful due to the inability to negotiate agreeable terms for the property interests being acquired by the
City;
2. Declare the necessity to acquire the described property interests for the Northside IV 24"Water Main Phase 1 B project(City Project No.
102687);
3. Adopt the attached resolution authorizing the City to use its power of eminent domain to acquire the property for public use;
4. Authorize the City Attorney to institute condemnation by eminent domain proceedings to acquire the described property interests from the
property owner;
5. Authorize a payment pursuant to an award of commissioners or a negotiated settlement;and
6. Authorize the City Manager or his designee to accept and record the appropriate instruments.

DISCUSSION:
The land rights in the subject properties are needed for the construction,operation,maintenance, replacement,upgrade and repair of the
permanent water line facility on the Northside IV 24"Water Main Phase 1 B project as necessary.This new 24-inch water transmission line will be
constructed for public use,providing water to new development in the northern part of the City of Fort Worth(City).The line extends from Heritage
Trace Parkway and generally follows the west side of Business 287(Saginaw Boulevard)north to Bonds Ranch Road.The project includes a flow
transfer station at Muscogee Drive that will maintain water quality in the line and allow for emergency transfer of water between the Northside III and
Northside IV pressure planes.
A new Eagle Mountain-Saginaw Independent School District high school,located along Bonds Ranch Road,will also be relying on the water from
the Northside IV transmission line.The new school is scheduled to open in the Fall of 2024,contingent upon the City being able to acquire the
necessary easements and construct the water line in time.
An independent appraisal established fair market value for the water facililty easement property interests(shown below)in the total amount of
$73,651.00. Negotiations were unsuccessful due to the inability to negotiate agreeable terms for the property interests being acquired by the City.
Upon approval,a condemnation action will be brought and a Special Commissioners'hearing held to acquire the permanent water facility
easement interests on the property.

To approve this Mayor and Council Communication(M&C),the Council Member making a motion to authorize condemnation by eminent domain
should say:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of eminent domain to acquire 0.395 acres in permanent
water facility easements from real property owned by E-Steel 11, LLC.The property interests are needed for the Northside IV Water Transmission
Main project,a public use that will provide water to new development in the northern part of the City of Fort Worth.The land rights in the subject
properties are needed for the construction,operation, maintenance,replacement,upgrade and repair of the permanent water line facility as
necessary.The properties are located at 9857 and 9965 Saginaw Boulevard in the Benjamin Thomas Survey,Abstract No. 1497,Tracts 4804 and
4807,Tarrant County,Texas.The property interest to be acquired is described by metes and bounds and depicted by survey exhibits attached to
this Mayor and Council Communication."
Funding is budgeted in the Water Dept Public Utility Department's W&S Rev Bonds Series 2021 Fund for the purpose of funding the NS IV 24"
Water Main Phase 1 B project,as appropriated.
This property is located in COUNCIL DISTRICT 7.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget,as previously appropriated, in the W&S Rev Bonds Series
2021 Fund for the NS IV 24"Water Main Phase 1 B project to support the approval of the above recommendations and acquistion of easements.
Prior to any expenditure being incurred,the Water and Property Management Departments have the responsibility to validate the availability of
funds.
